The CRFB Fiscal Quiz

I’ve shared all sorts of online quizzes that supposedly can detect things such as whether you’re a pure libertarian.

Or even whether you’re a communist.

Today, courtesy of the folks at the Committee for a Responsible Budget, you can agree or disagree with 24 statements to determine your “budget personality.”

I have some quibbles about some of the wording (for instance, I couldn’t answer “neither” when asked to react to: “The government should spend more money on children than on seniors”).

But I can’t quibble with the results. Given the potential outcomes, I’m glad to be a “Minimalist” who is “in favor of smaller government.”

Though I’m disappointed that I apparently didn’t get a perfect score on “Size of Government.”

And I need to explain why I got a mediocre score on the topic of “Fiscal Responsibility.”

The budget geeks at the Committee for a Responsible Federal Budget (CRFB) have a well-deserved reputation for rigorous analysis. I regularly cite their numbers and appreciate the work that they do.

That being said, they mistakenly focus on deficits and debt when the real problem is too much government.

I agree with Milton Friedman, who wisely observed that ““I would rather have government spend one trillion dollars with a deficit of a half a trillion dollars than have government spend two trillion dollars with no deficit.”

The folks at CRFB would disagree.

Indeed, they are so fixated on red ink that they would welcome tax increases.

At the risk of understatement, that would be a very bad approach.

The evidence from Europe shows that higher taxes simply lead to higher spending. And more debt.

Indeed, Milton Friedman also commented on this issue, warning that, “History shows that over a long period of time government will spend whatever the tax system raises plus as much more as it can get away with.”

The bottom line is that CRFB not only has the wrong definition of “Fiscal Responsibility,” but they also support policies that would make matters worse – even from their perspective!

Progressives have gone crazy over the minimum wage.

President Obama got the ball rolling when he called for hiking the federal minimum wage from $7.25 to $10.10 per

hour. Now, bothDemocratic presidential candidates are trying to one-up him, with Bernie Sanders demanding a $15 federal wage and Hillary Clinton $12. Meanwhile, California and New York have already passed laws mandating the Bernie rate, and scores of cities across the country are clamoring to follow suit.

And all the while, minimum wage advocates are making increasingly fanciful claims on behalf of their beloved laws.

The left’s minimum wage obsession dovetails with a shifting academic consensus that until the 1990s considered such hikes a recipe for killing jobs, especially for low-skilled workers. For a long time, the generally accepted rule of thumb was that, all else remaining equal, every 10 percent increase in the minimum wage would decrease low-skilled employment by 1 to 2 percent, since the more employers had to pay these employees, the fewer jobs they could afford to provide.

This consensus began to fray with a 1992 study by economists David Card and Alan Kreuger, who found that New Jersey’s minimum wage hike—from $4.25 to $5.05—did not lead to expected job losses in the state’s fast food restaurants. This finding has been hotly contested, but even if it were true, it doesn’t mean there are no other downsides to minimum wage laws. For example, sometimes employers don’t respond to minimum wage hikes by laying off workers, but instead by raising prices for consumers. (Minimum wage opponents haven’t helped their case by hitching it almost exclusively to job losses while ignoring the other, equally pernicious, adjustment responses by businesses.)

There is only one scenario, according to Naval Postgraduate School economist David Henderson, under which a modest legally mandated minimum wage might do more good than harm: when employers enjoy monopsony power (a monopoly on the buying side) in the labor market, either because there are very few of them or because workers can’t leave for some reason. Employers then have a relatively free hand to hold wages down. A mandated minimum wage under those circumstances merely diverts the firm’s “excess profits” to the worker, something that would have happened automatically in a more competitive market. But it doesn’t diminish a company’s productivity or its incentive for additional hiring—thereby actually boosting job growth. But genuine monopsony isn’t common and would require a very finely calibrated and skillfully crafted minimum wage, which is not how blanket policies work in the real world.

America’s federal minimum wage of $7.25 per hour works out to about 42 percent of its $17.40 hourly median wage. Even the most gung-ho academics only advocate raising it to 50 percent of the median — which means a little over $8.70. This in itself is a crude benchmark that lumps together high-wage service occupations with low-wage construction and other non-service ones whose market realities are completely different. Be that as it may, it is inconceivable that a $15 minimum wage—equal to 86 percent of America’s median wage, and the highest in the Western world—wouldn’t kill jobs, especially in small towns and cities where wages tend to be lower. Witness the chronic double-digit unemployment rate that a far less insane minimum wage has generated in France, Spain, Belgium, and other European countries.

And yet, minimum wage enthusiasts are abandoning all caution and making increasingly extravagant claims. Here are four of their sillier arguments:

False: Minimum wage hikes will lead to productivity-boosting automation

The standard rap against minimum wage laws is that by raising the cost of hiring workers, they prompt companies to invest in labor-saving technologies, throwing people out of work. But Matthew Yglesias claims that this would by no means be a “bad thing.” Why? Because productivity is the engine of economic progress. And if machines are more productive than people, then policies that prod employers to replace people with machines would mean more wealth without toil for everyone. This is the reverse of the Luddite fallacy that seeks to boost jobs by eschewing labor-saving technologies. Nobel laureate Milton Friedman once heard a Third World bureaucrat, suffering from this fallacy, defend his decision to have poor workers dig a massive canal with shovels rather than earth movers because that meant more jobs. Friedman asked: Why don’t you replace their shovels with spoons?

Increasing productivity is not simply a matter of increasing output, but doing so in the most cost-effective way. You do not encourage that with policies that force investments in capital equipment when labor is plentiful. Indeed, this raises the overall opportunity cost, rendering an economy less efficient. If Friedman were alive, he may well have asked Yglesias why, by his logic, he doesn’t just advocate a ban on all manual labor.

False: Minimum wage hikes helps firms make more money

This claim strains credulity. How would a $15 mandate that almost doubles a company’s labor costs actually boost profits? The argument that former Labor Secretary Robert Reich offers is that higher wages means happier employees and lower turnover, something that saves a company money. If so, the million-dollar question is why aren’t greedy companies doing this already? Are they too stupid or sadistic or both to pass up on a win-win deal for both themselves and their workers?

False: Minimum wage hikes will stimulate the economy

Michael Reich, an economist at the University of California, Berkeley, claims not only that a $15 minimum wage wouldn’t produce job losses in the short run, but would actually stimulate the economy, resulting in job gains in the long run. “They’d (employees) have more money to spend, the overall level of demand for goods and services would be higher, and so would the level of employment,” he claims.

But shifting wealth around doesn’t generate real economic growth. Boosting productivity does. Indeed, ordering employers to give artificial raises means that they would have less money to spend or invest, cancelling out any extra spending by workers.

False: Minimum wage hikes will diminish the strain on welfare programs

Advocates of the minimum wage claim that without a suitably high minimum, low-income workers are forced to rely on food stamps and health care programs to make ends meet. In essence, they argue, welfare programs end up subsidizing McDonald’s low-wage workforce, which is hardly fair to taxpayers. Forcing companies to pay something resembling “living” wages would diminish low-wage workers’ dependence on government programs.

This assumes that boosting the minimum wage would hand more workers a raise than it would throw people out of work, of course — which is hardly a reasonable assumption, as pointed out earlier. Indeed, notesUniversity of California, Irvine’s David Neumark, the probability that a family will escape poverty due to higher wages will be offset by the probability that another will enter poverty because it has been priced out of the labor market.

The core fallacy in this line of reasoning is that employers can set wages based on employee needs rather than market forces. Hence, they can simply be forced to hand over more money to their workers. That, however, is not how things work, especially in a globalized world where forcing employers to cough up wages higher than the market can bear would undermine their competitiveness—not something that helps anyone in the long run.

The IMF, the Laffer Curve, and Supply-Side Economics

The Laffer Curve is a very straightforward concept.

It graphically illustrates why politicians are wrong if they think you can double tax revenue by doubling tax rates (or that revenues will drop by 50 percentif tax rates are cut in half).

Simply stated, you also have to look at what happens to taxable income.

In cases where taxpayers have a lot of control over the timing, level, and composition of their income, changes in tax rates may cause big changes in taxable income (or “tax base” in the jargon of economists).

None of this should be controversial. Even Paul Krugman agrees that the Laffer Curve exists.

Today, we are going to see that the pro-taxInternational Monetary Fund also admits there is a Laffer Curve.

Indeed, a new study authored by David Amaglobeli, Valerio Crispolti, and Xuguang Simon Sheng openly states that politicians should be very cognizant of the fact that some tax policy changes can have a big effect on the “tax base.”

This paper investigates the potential revenue impact of different tax policy changes using the Tax Policy Reform Database (TPRD)… Revenue responses to tax policy changes depend on many factors… However, one of most important factorsis the nature of the tax policy change itself. For example, while a tax rate cut will directly lower revenue intake, it could also encourage more economic activity, hence expand the tax base. Estimating the revenue response to a tax policy change, therefore, requires granular information on the nature of this change, including on the tax instrument used (e.g., VAT or personal income tax), the type of change adopted (e.g., tax base, tax rate), and its timing and size.

Here are some of the findings.

We assess the impact of tax policy changes on tax revenues using Jordà (2005)’s local projections method. Our baseline results are based on tax shocks identified in the year when a tax change is announced. Our main empirical findings suggest that the revenue yield of tax policy changes varies significantly across taxes and types of changes, with tax rate changes generally having a more transitory revenue impact than tax base changes for most taxes. Specifically, base broadening changes in PIT, CIT, EXE, and PRO have on average a more significant and long-lasting impact on tax collection than rate changes. At the same time, rate hikes have relatively more significant effects on taxes in the case of VAT and SSC measures.

Most notably, the report finds tax increases hurt prosperity, especially higher marginal tax rates.

Gechert and Groß (2019) conclude that measures to broaden the tax base are less harmful to economic growth than tax hikes. Dabla-Norris and Lima (2018) find that during fiscal consolidations, tax base-broadening measures lead to smaller output and employment declines compared to measures to increase tax rates.

And we learn that it is very foolish to raise corporate tax rates.

Mertens and Ravn (2013) find that…increases in CIT are approximately revenue neutral for the United States. …Announcements of CIT increases are associated with a somewhat transitory rise in tax collection, suggesting that companies have quickly adapted their business to reduce the tax burden.

For wonky readers, here’s a chart from the study. Note how, in many cases, there’s not much difference in revenue between tax increases (blue line) and tax cuts (red lines).

P.S. One big takeaway is that there is not a single Laffer Curve. There are multiple Laffer Curvesdepending on the tax that’s being changed and the ability of taxpayers to change their behavior.

P.P.S. A less-obvious takeaway is that class-warfare taxes cause the most economic damage, meaning the most harm to ordinary people.

P.P.P.S. You can call it the “Khaldun Curve” if you prefer.

Corporate Tax Rates and Taxable Income

In the case of business taxation, the most visually powerful evidence for the Laffer Curve is what happened to corporate tax revenue in Ireland after the corporate tax rate was slashed from 50 percent to 12.5 percent.

Tax revenue increased dramatically. Not just in nominal terms. Not just in inflation-adjusted terms.

Corporate receipts actually climbed as a share of GDP.

And this was during the decades when economic output was rapidly expanding.

In other words, the Irish government got a much bigger slice of a much bigger pie after tax rates were dramatically lowered.

Now let’s look at some evidence from a new study. Three professors from the University of Utah (Jeffrey Coles, Elena Patel, and Nather Seegert), and a Treasury Department economist (Matthew Smith) estimated what happens to taxable income for U.S. companies when there is a change in the corporate tax rate.

In response to a 10% increase in the expected marginal tax rate, private U.S. firms decrease taxable income by 9.1%, which indicates a discernibly more elastic response than prevailing estimates. This response reflects a decrease in taxable income of 3.0%arising from real economic responses to a firm’s scale of operations and 6.1% arising from accounting transactions via (for example) revenue and expense timing. Responsiveness to the corporate tax rate is more elastic if a firm uses cash (9.9%) rather than accrual accounting (7.4%), if the firm is small (9.9%) rather than large (8.6%), and if the firm discounts future cash flows at a lower rate.

The paper is filled with equation, graphs, and jargon, but the above excerpt tells us everything we need to know.

When tax rates go up, taxable income goes down (both because there is less economic activity and because companies have more incentive to manipulate the tax code).

Thus confirming what I wrote back in 2016 about taxable income being the key variable.

By the way, this does not mean that lower tax rates lead to more revenue. Or that higher tax rate produce less revenue.

Such big swings only happen in rare circumstances.

But it does mean that politicians will not grab as much money as they hope when they increase tax rates. And that they won’t lose as much revenue as they fear when they lower tax rates (and we saw that most recently with the 2017 tax reform).

I’ll close by noting that this is additional evidence for why we should be thankful that Biden’s proposal for higher corporate tax rates was not enacted.

P.S. The chart at the beginning of this column may be the most visually powerful evidence for the corporate Laffer Curve. The most empirically powerful evidence, however, comes from very unlikely sources – the pro-tax IMF and the pro-tax OECD.

I’m thinking of inventing a game, sort of a fiscal version of Pin the Tail on the Donkey.

Only the way it will work is that there will be a map of the world and the winner will be the blindfolded person who puts their pin closest to a nation such asAustralia or Switzerland that has a relatively low risk of long-run fiscal collapse.

That won’t be an easy game to win since we have data from the BIS, OECD, and IMF showing that government is growing far too fast in the vast majority of nations.

We also know that many states and cities suffer from the same problems.

A handful of local governments already have hit the fiscal brick wall, with many of them (gee, what a surprise) from California.

The most spectacular mess, though, is about to happen in Michigan.

The Washington Post reports that Detroit is on the verge of fiscal collapse.

After decades of sad and spectacular decline, it has come to this for Detroit: The city is $19 billion in debt and on the edge of becoming the nation’s largest municipal bankruptcy. An emergency manager says the city can make good on only a sliver of what it owes — in many cases just pennies on the dollar.

This is a dog-bites-man story. Detroit’s problems are the completely predictable result of excessive government. Just as statism explains the problems of Greece. And the problems of California. And the problems of Cyprus. And theproblems of Illinois.

I could continue with a long list of profligate governments, but you get the idea. Some of these governments are collapsing at a quicker pace and some at a slower pace. But all of them are in deep trouble because they don’t follow my Golden Rule about restraining the burden of government spending so that it grows slower than the private sector.

Detroit obviously is an example of a government that is collapsing sooner rather than later.

Why? Simply stated, as the size and scope of the public sector increased, that created very destructive economic and political dynamics.

More and more people got lured into the wagon of government dependency, which puts an ever-increasing burden on a shrinking pool of producers.

Meanwhile, organized interest groups such as government bureaucrats used their political muscle to extract absurdly excessive compensation packages, putting an even larger burden of the dwindling supply of taxpayers.

But that’s not the main focus of this post. Instead, I want to highlight a particular excerpt from the article and make a point about how too many people are blindly – perhaps willfully – ignorant of the Laffer Curve.

Check out this sentence.

Property tax collections are down 20 percent and income tax collections are down by more than a third in just the past five years — despite some of the highest tax rates in the state.

This is a classic “Fox Butterfield mistake,” which occurs when someone fails to recognize a cause-effect relationship. In this case, the reporter should have recognized that tax collections are down because Detroit has very high tax rates.

The city has a lot more problems than just high tax rates, of course, but can there be any doubt that productive people have very little incentive to earn and report taxable income in Detroit?

And that’s the essential insight of the Laffer Curve. Politicians can’t – or at least shouldn’t – assume that a 20 percent increase in tax rates will lead to a 20 percent increase in tax revenue. They also have to consider the degree to which a higher tax rate will cause a change in taxable income.

In some cases, higher tax rates will discourage people from earning more taxable income.

In some cases, higher tax rates will discourage people from reporting all the income they earn.

In some cases, higher tax rates will encourage people to utilize tax loopholes to shrink their taxable income.

In some cases, higher tax rates will encourage migration, thus causing taxable income to disappear.

Here’s my three-part video series on the Laffer Curve. Much of this is common sense, though it needs to be mandatory viewing for elected officials (as well as the bureaucrats at the Joint Committee on Taxation).

Astounding Example of White House Chutzpah

While Donald Trump issued some inanely illiteratetweets to promote protectionism, Joe Biden has made a fool of himself with tweets on a wider range of issues.

Jaw-dropping economic illiteracy about gas prices.
Using make-believe numbers to promote class warfare.
Adding to the debt while claiming to do the opposite.
Once again using make-believe numbers on taxation.

The easy response to all this nonsense is to jump on the Biden-is-a-befuddled-old-man bandwagon.

That may be good for a few laughs, and I’m a big fanof political humor (even when it targets my side).

But the more accurate assessment is that Biden is a politician and he’s doing what comes naturally to politicians – which is to spin, lie, dissemble, and prevaricate.

And if you think I’m being too critical, we have a new tweet from the White House that breaks all records for chutzpah.

I don’t know what’s most galling about this tweet.

Is it that the White House is taking credit for Social Security’s automatic COLAs (cost of living adjustments) even though that’s been part of the law for 50 years?
Is is that the White House is trying to make it seem like good news that we’ve had very high inflation, which is the only reason why the COLAs are so large?

In either case, the only thing Biden actually did was to preside over a period of rising prices (which, in the interest of fairness, is mostly not his fault).

I’ll close with the observation that I would be happy if politicians basically did nothing other than make false claims of “leadership.” It’s when they start enacting new laws that things usually get worse (and that’s definitely been true during the Biden years).

P.S. We’ve also seen brassy tweets from the campaign arm for Democratic members of the House of Representatives.

Assessing the Biden Economy

According to polling data, President Biden is not getting good grades for economic policy.

Part of that is because of inflation, though I’ve repeatedly pointed out that the blame belongs with the Federal Reserve rather than Biden. And the big mistake from the Fed took place before Biden even took office.

Unfortunately, the President is not trying to make things better. His appointments to the Fed suggest he doesn’t understand the need for good monetary policy.

And all of his major legislative initiatives (the so-called stimulus, the misnamed Inflation Reduction Act, the pork-filled infrastructure legislation, and the cronyist handouts to the semiconductor industry) have increased the size and scope of government.

For what it’s worth, I think Biden’s big challenge – both politically and economically – is that Americans are losing ground. Simply stated, prices are increasing faster than incomes.

But that isn’t stopping the Administration from trying to turn a sow’s ear into a silk purse.

Alan Rappeport of the New York Times reported a few days ago that the Biden’s Treasury Secretary, Janet Yellen, is claiming that Bdenomics is a big success.

…the Biden administration is pivoting to recast its stewardship of the U.S. economy as a singular achievement. …The case was reinforced on Thursday by Treasury Secretary Janet L. Yellen… Ms. Yellen said the legislation that Mr. Biden signed this year to promote infrastructure investment, expand the domestic semiconductor industry and support the transition to electric vehicles represented what she called “modern supply-side economics.” …After months of being on the defensive in the face of criticism from Republicans who say Democrats fueled inflation by overstimulating the economy, the Biden administration is fully embracing the fruits of initiatives such as the $1.9 trillion American Rescue Plan of 2021.

The editors at the Wall Street Journal are not impressed.

Janet Yellen…tenure as Treasury Secretary hasn’t enhanced her reputation. …the White House is rolling her out in election season to portray the U.S. economy as a Valhalla of growth, fairness and optimism. …If you’re in a green business the White House likes, you’re in clover. If not, you’ll endure the costs of more regulation and taxes. In the Biden era, big government and big business are in political business together.…Ms. Yellen’s whoppers, …including a claim that “the causes of inflation are largely global.” …U.S. inflation has been substantially home-grown. …The Federal Reserve kept the money spigots open for too long, in part to finance the borrowing needed for all of the spending. …Ms. Yellen is also at pains to stress how much fairer the economy is since Mr. Biden took office… She fails to mention that the U.S. economy contracted by about 1% of GDP in the first six months of this year, even as real wages were falling. Real average hourly earnings declined 3% over the 12 months through July, and average weekly earnings by 3.6%. They’ve fallen 4.2% since Mr. Biden took office.

Meanwhile, the latest inflation data has not strengthened Biden’s case.

Jim Tankersley of the New York Times wrote aboutthe issue yesterday.

Hotter-than-expected inflation in August was unwelcome news for President Biden, who has sought to defuse Republican attacks over rising prices in the run-up to November’s midterm elections. …Mr. Biden has claimed progress in the fight against inflation, including with the signing last month of an energy, health care and tax bill that Democrats called the Inflation Reduction Act.…But polls continue to show inflation is hurting Mr. Biden and his party… Mr. Biden threw a belated celebration at the White House on Tuesday to mark his signing of the Inflation Reduction Act. …But the country’s economic reality remains more muddled, as the inflation report underscored. Food prices are continuing to spike, straining lower-income families in particular. …Most importantly — and perhaps most damaging for Mr. Biden and Democrats — Americans’ wages have struggled to keep pace with fast-rising prices, an uncomfortable truth for a president who promised to make real wage gains a centerpiece of his economic program.

Let’s close with this chart, which shows what has happened to inflation-adjusted weekly earnings since Biden took office.

Yes, there was one recent month with good data, but that doesn’t seem like a big cause for celebration.

P.S. Paul Krugman’s defense of Bidenomics is just as weak as Janet Yellen’s (and his criticisms of good presidents are equally weak).

I enjoyed this article below because it demonstrates that the Laffer Curve has been working for almost 100 years now when it is put to the test in the USA. I actually got to hear Arthur Laffer speak in person in 1981 and he told us in advance what was going to happen the 1980’s and it all came about as he said it would when Ronald Reagan’s tax cuts took place. I wish we would lower taxes now instead of looking for more revenue through raised taxes. We have to grow the economy:

What Mitt Romney Said Last Night About Tax Cuts And The Deficit Was Absolutely Right. And What Obama Said Was Absolutely Wrong.

Mitt Romney repeatedly said last night that he would not allow tax cuts to add to the deficit. He repeatedly said it because over and over again Obama blathered the liberal talking point that cutting taxes necessarily increased deficits.

Romney’s exact words: “I want to underline that — no tax cut that adds to the deficit.”

Meanwhile, Obama has promised to cut the deficit in half during his first four years – but instead gave America the highest deficits in the history of the entire human race.

I’ve written about this before. Let’s replay what has happened every single time we’ve ever cut the income tax rate.

The fact of the matter is that we can go back to Calvin Coolidge who said very nearly THE EXACT SAME THING to his treasury secretary: he too would not allow any tax cuts that added to the debt. Andrew Mellon – quite possibly the most brilliant economic mind of his day – did a great deal of research and determined what he believed was the best tax rate. And the Coolidge administration DID cut income taxes and MASSIVELY increased revenues. Coolidge and Mellon cut the income tax rate 67.12 percent (from 73 to 24 percent); and revenues not only did not go down, but they went UP by at least 42.86 percent (from $700 billion to over $1 billion).

That’s something called a documented fact. But that wasn’t all that happened: another incredible thing was that the taxes and percentage of taxes paid actually went UP for the rich. Because as they were allowed to keep more of the profits that they earned by investing in successful business, they significantly increased their investments and therefore paid more in taxes than they otherwise would have had they continued sheltering their money to protect themselves from the higher tax rates. Liberals ignore reality, but it is simply true. It is a fact. It happened.

Then FDR came along and raised the tax rates again and the opposite happened: we collected less and less revenue while the burden of taxation fell increasingly on the poor and middle class again. Which is exactly what Obama wants to do.

People don’t realize that John F. Kennedy, one of the greatest Democrat presidents, was a TAX CUTTER who believed the conservative economic philosophy that cutting tax rates would in fact increase tax revenues. He too cut taxes, and he too increased tax revenues.

So we get to Ronald Reagan, who famously cut taxes. And again, we find that Reagan cut that godawful liberal tax rate during an incredibly godawful liberal-caused economic recession, and he increased tax revenue by 20.71 percent (with revenues increasing from $956 billion to $1.154 trillion). And again, the taxes were paid primarily by the rich:

“The share of the income tax burden borne by the top 10 percent of taxpayers increased from 48.0 percent in 1981 to 57.2 percent in 1988. Meanwhile, the share of income taxes paid by the bottom 50 percent of taxpayers dropped from 7.5 percent in 1981 to 5.7 percent in 1988.”

So we get to George Bush and the Bush tax cuts that liberals and in particular Obama have just demonized up one side and demagogued down the other. And I can simply quote the New York Times AT the time:

Sharp Rise in Tax Revenue to Pare U.S. Deficit By EDMUND L. ANDREWS Published: July 13, 2005

WASHINGTON, July 12 – For the first time since President Bush took office, an unexpected leap in tax revenue is about to shrink the federal budget deficit this year, by nearly $100 billion.

A Jump in Corporate Payments On Wednesday, White House officials plan to announce that the deficit for the 2005 fiscal year, which ends in September, will be far smaller than the $427 billion they estimated in February.

Mr. Bush plans to hail the improvement at a cabinet meeting and to cite it as validation of his argument that tax cuts would stimulate the economy and ultimately help pay for themselves.

Based on revenue and spending data through June, the budget deficit for the first nine months of the fiscal year was $251 billion, $76 billion lower than the $327 billion gap recorded at the corresponding point a year earlier.

The Congressional Budget Office estimated last week that the deficit for the full fiscal year, which reached $412 billion in 2004, could be “significantly less than $350 billion, perhaps below $325 billion.”

The big surprise has been in tax revenue, which is running nearly 15 percent higher than in 2004. Corporate tax revenue has soared about 40 percent, after languishing for four years, and individual tax revenue is up as well.

And of course the New York Times, as reliable liberals, use the adjective whenever something good happens under conservative policies and whenever something bad happens under liberal policies: ”unexpected.” But it WASN’T ”unexpected.” It was EXACTLY what Republicans had said would happen and in fact it was exactly what HAD IN FACT HAPPENED every single time we’ve EVER cut income tax rates.

The truth is that conservative tax policy has a perfect track record: every single time it has ever been tried, we have INCREASED tax revenues while not only exploding economic activity and creating more jobs, but encouraging the wealthy to pay more in taxes as well. And liberals simply dishonestly refuse to acknowledge documented history.

Meanwhile, liberals also have a perfect record … of FAILURE. They keep raising taxes and keep not understanding why they don’t get the revenues they predicted.

The following is a section from my article, “Tax Cuts INCREASE Revenues; They Have ALWAYS Increased Revenues“, where I document every single thing I said above:

The Falsehood That Tax Cuts Increase The Deficit

Now let’s take a look at the utterly fallacious view that tax cuts in general create higher deficits.

Let’s take a trip back in time, starting with the 1920s. From Burton Folsom’s book, New Deal or Raw Deal?:

In 1921, President Harding asked the sixty-five-year-old [Andrew] Mellon to be secretary of the treasury; the national debt [resulting from WWI] had surpassed $20 billion and unemployment had reached 11.7 percent, one of the highest rates in U.S. history. Harding invited Mellon to tinker with tax rates to encourage investment without incurring more debt. Mellon studied the problem carefully; his solution was what is today called “supply side economics,” the idea of cutting taxes to stimulate investment. High income tax rates, Mellon argued, “inevitably put pressure upon the taxpayer to withdraw this capital from productive business and invest it in tax-exempt securities. . . . The result is that the sources of taxation are drying up, wealth is failing to carry its share of the tax burden; and capital is being diverted into channels which yield neither revenue to the Government nor profit to the people” (page 128).

Mellon wrote, “It seems difficult for some to understand that high rates of taxation do not necessarily mean large revenue to the Government, and that more revenue may often be obtained by lower taxes.” And he compared the government setting tax rates on incomes to a businessman setting prices on products: “If a price is fixed too high, sales drop off and with them profits.”

And what happened?

“As secretary of the treasury, Mellon promoted, and Harding and Coolidge backed, a plan that eventually cut taxes on large incomes from 73 to 24 percent and on smaller incomes from 4 to 1/2 of 1 percent. These tax cuts helped produce an outpouring of economic development – from air conditioning to refrigerators to zippers, Scotch tape to radios and talking movies. Investors took more risks when they were allowed to keep more of their gains. President Coolidge, during his six years in office, averaged only 3.3 percent unemployment and 1 percent inflation – the lowest misery index of any president in the twentieth century.

Furthermore, Mellon was also vindicated in his astonishing predictions that cutting taxes across the board would generate more revenue. In the early 1920s, when the highest tax rate was 73 percent, the total income tax revenue to the U.S. government was a little over $700 million. In 1928 and 1929, when the top tax rate was slashed to 25 and 24 percent, the total revenue topped the $1 billion mark. Also remarkable, as Table 3 indicates, is that the burden of paying these taxes fell increasingly upon the wealthy” (page 129-130).

Now, that is incredible upon its face, but it becomes even more incredible when contrasted with FDR’s antibusiness and confiscatory tax policies, which both dramatically shrunk in terms of actual income tax revenues (from $1.096 billion in 1929 to $527 million in 1935), and dramatically shifted the tax burden to the backs of the poor by imposing huge new excise taxes (from $540 million in 1929 to $1.364 billion in 1935). See Table 1 on page 125 of New Deal or Raw Deal for that information.

FDR both collected far less taxes from the rich, while imposing a far more onerous tax burden upon the poor.

It is simply a matter of empirical fact that tax cuts create increased revenue, and that those [Democrats] who have refused to pay attention to that fact have ended up reducing government revenues even as they increased the burdens on the poorest whom they falsely claim to help.

Let’s move on to John F. Kennedy, one of the most popular Democrat presidents ever. Few realize that he was also a supply-side tax cutter.

Kennedy said:

“It is a paradoxical truth that tax rates are too high and tax revenues are too low and the soundest way to raise the revenues in the long run is to cut the rates now … Cutting taxes now is not to incur a budget deficit, but to achieve the more prosperous, expanding economy which can bring a budget surplus.”

“Lower rates of taxation will stimulate economic activity and so raise the levels of personal and corporate income as to yield within a few years an increased – not a reduced – flow of revenues to the federal government.”

– John F. Kennedy, Jan. 17, 1963, annual budget message to the Congress, fiscal year 1964

“In today’s economy, fiscal prudence and responsibility call for tax reduction even if it temporarily enlarges the federal deficit – why reducing taxes is the best way open to us to increase revenues.”

– John F. Kennedy, Jan. 21, 1963, annual message to the Congress: “The Economic Report Of The President”

“It is no contradiction – the most important single thing we can do to stimulate investment in today’s economy is to raise consumption by major reduction of individual income tax rates.”

– John F. Kennedy, Jan. 21, 1963, annual message to the Congress: “The Economic Report Of The President”

“Our tax system still siphons out of the private economy too large a share of personal and business purchasing power and reduces the incentive for risk, investment and effort – thereby aborting our recoveries and stifling our national growth rate.”

– John F. Kennedy, Jan. 24, 1963, message to Congress on tax reduction and reform, House Doc. 43, 88th Congress, 1st Session.

“A tax cut means higher family income and higher business profits and a balanced federal budget. Every taxpayer and his family will have more money left over after taxes for a new car, a new home, new conveniences, education and investment. Every businessman can keep a higher percentage of his profits in his cash register or put it to work expanding or improving his business, and as the national income grows, the federal government will ultimately end up with more revenues.”

– John F. Kennedy, Sept. 18, 1963, radio and television address to the nation on tax-reduction bill

Which is to say that modern Democrats are essentially calling one of their greatest presidents a liar when they demonize tax cuts as a means of increasing government revenues.

So let’s move on to Ronald Reagan. Reagan had two major tax cutting policies implemented: the Economic Recovery Tax Act (ERTA) of 1981, which was retroactive to 1981, and the Tax Reform Act of 1986.

Did Reagan’s tax cuts decrease federal revenues? Hardly:

We find that 8 of the following 10 years there was a surplus of revenue from 1980, prior to the Reagan tax cuts. And, following the Tax Reform Act of 1986, there was a MASSIVE INCREASEof revenue.

So Reagan’s tax cuts increased revenue. But who paid the increased tax revenue? The poor? Opponents of the Reagan tax cuts argued that his policy was a giveaway to the rich (ever heard that one before?) because their tax payments would fall. But that was exactly wrong. In reality:

“The share of the income tax burden borne by the top 10 percent of taxpayers increased from 48.0 percent in 1981 to 57.2 percent in 1988. Meanwhile, the share of income taxes paid by the bottom 50 percent of taxpayers dropped from 7.5 percent in 1981 to 5.7 percent in 1988.”

So Ronald Reagan a) collected more total revenue, b) collected more revenue from the rich, while c) reducing revenue collected by the bottom half of taxpayers, and d) generated an economic powerhouse that lasted – with only minor hiccups – for nearly three decades. Pretty good achievement considering that his predecessor was forced to describe his own economy as a “malaise,” suffering due to a “crisis of confidence.” Pretty good considering that President Jimmy Carter responded to a reporter’s question as to what he would do about the problem of inflation by answering, “It would be misleading for me to tell any of you that there is a solution to it.”

Reagan whipped inflation. Just as he whipped that malaise and that crisis of confidence.

Doctor Compares Crisis Pregnancy Centers to ‘Terrorists’ During Democrat-Led Hearing

Alexis Sneller, policy analyst at the Pennsylvania Family Institute, told The Daily Signal on Monday that “while pregnancy care centers are providing critical services to tens of thousands of women and families in Pennsylvania, they’re also facing unprecedented attacks by the pro-abortion lobby.”

“It is shameful that pro-abortion politicians with the [Pennsylvania] Senate Democratic Policy Committee in Harrisburg are designing numerous taxpayer-funded hearings to attack pregnancy care centers that are providing such outstanding pregnancy help,” Sneller added.

“During these biased hearings,” she continued, “it has been inferred that people working at pregnancy centers are terrorists, along with making a slew of other false claims intended to vilify these essential centers. This should be a call for everyone to enhance their support of your local pregnancy care center.”

The Perelman School of Medicine touts Schreiber’s credentialing as clinical expertise in “family planning,” “miscarriage,” and “ectopic pregnancy.” Penn Medicine also says she has expertise in “transgender care,” including female-to-male sex change surgeries and transgender hormone replacement therapy.

During the hearing, Schreiber further decried state funding directed to crisis pregnancy centers, claiming that the state is funding “fake health care facilities.” She also told a story of a woman who went to a crisis pregnancy center and criticized the pro-life center for showing the pregnant mother ultrasounds of her baby, claiming that the pregnancy center lied about how old the baby was.

Schreiber repeatedly referred to the unborn baby as a “baby”— noticeable since many of her peers avoid such humanizing terminology.

In past testimony for the Women’s Law Project, she claimed that abortion “is almost always safer for a woman than carrying a pregnancy to term,” adding that “induced abortion is markedly safer than childbirth.”

A University of Pennsylvania doctor appeared to compare crisis pregnancy centers to “terrorists” during a Friday hearing, accusing these pro-life centers of harming and targeting mothers.

Courtney Schreiber, chief of the Division of Family Planning at the University of Pennsylvania and a professor of obstetrics and gynecology at the Perelman School of Medicine, spoke Friday at the Pennsylvania Senate Democratic Policy Committee hearing on “Deceptive Practices of Anti-Abortion Centers II.”

Schreiber repeatedly criticized pro-life crisis pregnancy centers without mentioning that scores of these pro-life organizations have been vandalized with pro-abortion graffiti, attacked, or firebombed since the May leak of the draft Supreme Court opinion indicating that Roe v. Wade would soon be overturned.

She also expressed concerns that pro-life groups are nefariously using private data that they collect from the pregnant women who come to their organizations.

Apparently comparing crisis pregnancy centers to terrorists, she asked, “Who knows what they are doing with that information, if they may be selling it, if they may be making data available to other terrorists or activists that can cause harm to patients or the providers to whom they actually wind up going to eventually to seek care.”

Schreiber and Penn Medicine did not immediately respond to requests for comment from The Daily Signal asking if the doctor stood by these remarks.

Arizona Dem gov nominee Katie Hobbs appears to support abortion up to birth

Hobbs accused her Republican opponent Kari Lake of misconstruing her position on late-term abortion, saying the procedure is ‘extremely rare’

Democratic Arizona gubernatorial candidate Katie Hobbs, during a Sunday appearance on CBS’ “Face the Nation,” appeared to suggest that she was in favor of no limits on abortion.

Host Major Garrett noted that her Republican opponent Kari Lake has labeled Hobbs as an “extremist” for her view on abortion. He asked Hobbs whether she supported the current 15-week ban in Arizona or would seek a higher limit as governor.

Hobbs, who currently serves as Arizona’s Secretary of State, said Lake had misconstrued her position and said late-term abortion is “extremely rare.”

“If it’s being talked about, it’s because something has gone incredibly wrong in the pregnancy. A doctor’s not going to perform an abortion late in pregnancy just because somebody decided they want one. That is ridiculous,” Hobbs said before suggesting that Arizonans would have “government-mandated forced births that risk women’s lives” under a Kari Lake administration.

Asked what her administration’s week limit for abortion access would be, Hobbs evaded answering directly saying that abortion “is a very personal decision that belongs between a woman and her doctor.”

“The government and politicians don’t belong in that decision,” Hobbs said. “We need to let doctors perform the care that they are trained and take an oath to perform.”

“So, if an Arizona voter were to conclude from your previous answer that you do not favor any specific week limit on abortion, would they be correct?” Garrett asked.

Hobbs repeated her initial answer: “I support leaving the decision between a woman and her doctor and leaving politicians entirely out of it.”

Arizona doctors stopped performing abortions late last month after a judge in Tucson ruled that prosecutors can enforce a law dating to 1864 that bans abortion unless it’s necessary to save a woman’s life. Arizona also has a law passed this year that bans abortion after 15 weeks, creating speculation about what’s allowed.

Democrats have seized on the ruling, which revived the issue ahead of next month’s midterm elections. Democratic lawmakers sent a letter on Tuesday asking Republican Gov. Doug Ducey to call a special session of the Legislature to repeal the 1864 abortion ban.

Lake has spoken positively of Arizona’s total ban on abortion, which she called “a great law that’s already on the books.” She has called abortion “the ultimate sin,” said abortion pills should be illegal and that she would sign a bill banning abortion as soon as fetal cardiac activity can be detected, usually around six weeks gestational age and before many women know they’re pregnant.

I really do respect you for trying to get a pulse on what is going on out here. I know that you don’t agree with my pro-life views but I wanted to challenge you as a fellow Christian to re-examine your pro-choice view.

In the past I have spent most of my time looking at this issue from the spiritual side. In the film series “WHATEVER HAPPENED TO THE HUMAN RACE?” the arguments are presented against abortion (Episode 1), infanticide (Episode 2), euthanasia (Episode 3), and then there is a discussion of the Christian versus Humanist worldview concerning the issue of “the basis for human dignity” in Episode 4 and then in the last episode a close look at the truth claims of the Bible.

Recently I have been revisiting my correspondence in 1995 with the famous astronomer Carl Sagan who I had the privilege to correspond with in 1994, 1995 and 1996. In 1996 I had a chance to respond to his December 5, 1995letter on January 10, 1996 and I never heard back from him again since his cancer returned and he passed away later in 1996. Below is what Carl Sagan wrote to me in his December 5, 1995 letter:

Thanks for your recent letter about evolution and abortion. The correlation is hardly one to one; there are evolutionists who are anti-abortion and anti-evolutionists who are pro-abortion.You argue that God exists because otherwise we could not understand the world in our consciousness. But if you think God is necessary to understand the world, then why do you not ask the next question of where God came from? And if you say “God was always here,” why not say that the universe was always here? On abortion, my views are contained in the enclosed article (Sagan, Carl and Ann Druyan {1990}, “The Question of Abortion,” Parade Magazine, April 22.)

The issue had been decided years ago. The court had chosen the middle ground. You’d think the fight was over. Instead, there are mass rallies, bombings and intimidation, murders of workers at abortion clinics, arrests, intense lobbying, legislative drama, Congressional hearings, Supreme Court decisions, major political parties almost defining themselves on the issue, and clerics threatening politicians with perdition. Partisans fling accusations of hypocrisy and murder. The intent of the Constitution and the will of God are equally invoked. Doubtful arguments are trotted out as certitudes. The contending factions call on science to bolster their positions. Families are divided, husbands and wives agree not to discuss it, old friends are no longer speaking. Politicians check the latest polls to discover the dictates of their consciences. Amid all the shouting, it is hard for the adversaries to hear one another. Opinions are polarized. Minds are closed.

Is it wrong to abort a pregnancy? Always? Sometimes? Never? How do we decide? We wrote this article to understand better what the contending views are and to see if we ourselves could find a position that would satisfy us both. Is there no middle ground? We had to weigh the arguments of both sides for consistency and to pose test cases, some of which are purely hypothetical. If in some of these tests we seem to go too far, we ask the reader to be patient with us–we’re trying to stress the various positions to the breaking point to see their weaknesses and where they fail.

In contemplative moments, nearly everyone recognizes that the issue is not wholly one-sided. Many partisans of differing views, we find, feel some disquiet, some unease when confronting what’s behind the opposing arguments. (This is partly why such confrontations are avoided.) And the issue surely touches on deep questions: What are our responses to one another? Should we permit the state to intrude into the most intimate and personal aspects of our lives? Where are the boundaries of freedom? What does it mean to be human?

Of the many actual points of view, it is widely held–especially in the media, which rarely have the time or the inclination to make fine distinctions–that there are only two: “pro-choice” and “pro-life.” This is what the two principal warring camps like to call themselves, and that’s what we’ll call them here. In the simplest characterization, a pro-choicer would hold that the decision to abort a pregnancy is to be made only by the woman; the state has no right to interfere. And a pro-lifer would hold that, from the moment of conception, the embryo or fetus is alive; that this life imposes on us a moral obligation to preserve it; and that abortion is tantamount to murder. Both names–pro-choice and pro-life–were picked with an eye toward influencing those whose minds are not yet made up: Few people wish to be counted either as being against freedom of choice or as opposed to life. Indeed, freedom and life are two of our most cherished values, and here they seem to be in fundamental conflict.

Let’s consider these two absolutist positions in turn. A newborn baby is surely the same being it was just before birth. There ‘s good evidence that a late-term fetus responds to sound–including music, but especially its mother’s voice. It can suck its thumb or do a somersault. Occasionally, it generates adult brain-wave patterns. Some people claim to remember being born, or even the uterine environment. Perhaps there is thought in the womb. It’s hard to maintain that a transformation to full personhood happens abruptly at the moment of birth. Why, then, should it be murder to kill an infant the day after it was born but not the day before?

As a practical matter, this isn’t very important: Less than 1 percent of all tabulated abortions in the United States are listed in the last three months of pregnancy (and, on closer investigation, most such reports turn out to be due to miscarriage or miscalculation). But third-trimester abortions provide a test of the limits of the pro-choice point of view. Does a woman’s “innate right to control her own body” encompass the right to kill a near-term fetus who is, for all intents and purposes, identical to a newborn child?

When I was in high school the book and film series named WHATEVER HAPPENED TO THE HUMAN RACE? came out and it featured Doctor C. Everett Koop and Francis Schaeffer and they looked at the issues of abortion, infanticide, and youth euthanasia and they looked at comments from such scholars as Peter Singer and James D. Watson.

Peter Singer, an endowed chair at Princeton’s Center for Human Values, said, “Killing a disabled infant is not morally equivalent to killing a person. Very often it is not wrong at all.”

In May 1973, James D. Watson, the Nobel Prize laureate who discovered the double helix of DNA, granted an interview to Prism magazine, then a publication of the American Medical Association. Time later reported the interview to the general public, quoting Watson as having said, “If a child were not declared alive until three days after birth, then all parents could be allowed the choice only a few are given under the present system. The doctor could allow the child to die if the parents so choose and save a lot of misery and suffering. I believe this view is the only rational, compassionate attitude to have.”

On August 30, 1995 I mailed a letter to Carl Sagan that probably prompted this discussion on abortion and it enclosed a lengthy story from Adrian Rogers about an abortion case in Pine Bluff, Arkansas that almost became an infanticide case:

An excerpt from the Sunday morning message (11-6-83) by Adrian Rogers in Memphis, TN.

I want to tell you that secular humanism and so-called abortion rights are inseparably linked together. We have been taught that our bodies and our children are the products of the evolutionary process, and so therefore human life may not be all that valuable to begin with. We have come today to where it is legal and even considered to be a good thing to put little babies to death…15 million little babies put to death since 1973 because of this philosophy of Secular Humanism.

How did the court make that type of decision? You would think it would be so obvious. You can’t do that! You can’t kill little babies! Why? Because the Bible says! Friend, they don’t give a hoot what the Bible says! There used to be a time when they talked about what the Bible says because there was a time that we as a nation had a constitution that was based in the Judeo-Christian ethic, but today if we say “The Bible says” or “God says “Separation of Church and State. Don’t tell us what the Bible says or what God says. We will tell you what we think!” Therefore, they look at the situation and they decide if it is right or wrong purely on the humanistic philosophy that right and wrong are relative and the situation says what is right or what is wrong.

This little girl just 19 years old went into the doctor’s office and he examined her. He said, “We can take take of you.” He gave her an injection in her arm that was to cause her to go into labor and to get rid of that protoplasm, that feud, that little mass that was in her, but she wasn’t prepared for the sound she was about to hear. It was a little baby crying. That little baby weighed 13 ounces. His hand the size of my thumbnail. You know what the doctor did. The doctor put that little baby in a grocery sack and gave it to Maria’s two friends who were with her in that doctor office and Said, “It will stop making those noises after a while.”

They took that grocery sack and Maria home and one hour passed and two hours passed and that baby was still crying and panting for his life in that grocery sack. They took that little baby down to the hospital there in Pine Bluff, Arkansas, and they called an obstetrician and he called a pediatrician and they called nurses and they began to work on that little baby. Today that baby is alive and well and healthy, that little mass of protoplasm. That little thing that wasn’t a human being is alive and well. I want to tell you they spent $150,000 to save the life of that baby. NOW CAN YOU EXPLAIN TO ME HOW THEY CAN SPEND $150,000 TO SAVE THE LIFE OF SOMETHING THAT SOMEBODY WAS PAYING ANOTHER DOCTOR TO TAKE THE LIFE OF? The same life!!! Are you going to tell me that is not a baby? Are you going to tell me that if that baby had been put to death it would not have been murder? You will never convince me of that. What has happened to us in America? We have been sold a bill of goods by the Secular Humanists!

Carl Sagan asked, “Does a woman’s “innate right to control her own body” encompass the right to kill a near-term fetus who is, for all intents and purposes, identical to a newborn child?”

This message “A Christian Manifesto” was given in 1982 by the late Christian Philosopher Francis Schaeffer when he was age 70 at D. James Kennedy’s Corral Ridge Presbyterian Church.
Listen to this important message where Dr. Schaeffer says it is the duty of Christians to disobey the government when it comes in conflict with God’s laws. So many have misinterpreted Romans 13 to mean unconditional obedience to the state. When the state promotes an evil agenda and anti-Christian statues we must obey God rather than men. Acts
I use to watch James Kennedy preach from his TV pulpit with great delight in the 1980’s. Both of these men are gone to be with the Lord now. We need new Christian leaders to rise up in their stead.

The religious and political freedom’s we enjoy as Americans was based on the Bible and the legacy of the Reformation according to Francis Schaeffer. These freedoms will continue to diminish as we cast off the authority of Holy Scripture.
In public schools there is no other view of reality but that final reality is shaped by chance.
Likewise, public television gives us many things that we like culturally but so much of it is mere propaganda shaped by a humanistic world and life view.

I was able to watch Francis Schaeffer deliver a speech on a book he wrote called “A Christian Manifesto” and I heard him in several interviews on it in 1981 and 1982. I listened with great interest since I also read that book over and over again. Below is a portion of one of Schaeffer’s talks on a crucial subject that is very important today too.

Infanticide and youth enthansia ———So what we find then, is that the medical profession has largely changed — not all doctors. I’m sure there are doctors here in the audience who feel very, very differently, who feel indeed that human life is important and you wouldn’t take it, easily, wantonly. But, in general, we must say (and all you have to do is look at the TV programs), all you have to do is hear about the increased talk about allowing the Mongoloid child — the child with Down’s Syndrome — to starve to death if it’s born this way. Increasingly, we find on every side the medical profession has changed its views.

The view now is, “Is this life worth saving?”I look at you… You’re an older congregation than I am usually used to speaking to. You’d better think, because — this — means — you! It does not stop with abortion and infanticide. It stops at the question, “What about the old person? Is he worth hanging on to?” Should we, as they are doing in England in this awful organization, EXIT, teach older people to commit suicide? Should we help them get rid of them because they are an economic burden, a nuisance? I want to tell you, once you begin chipping away the medical profession…

The intrinsic value of the human life is founded upon the Judeo-Christian concept that man is unique because he is made in the image of God, and not because he is well, strong, a consumer, a sex object or any other thing. That is where whatever compassion this country has is, and certainly it is far from perfect and has never been perfect. Nor out of the Reformation has there been a Golden Age, but whatever compassion there has ever been, it is rooted in the fact that our culture knows that man is unique, is made in the image of God. Take it away, and I just say gently, the stopper is out of the bathtub for all human life.

Now I wanted to make some comments concerning our shared Christian faith. I respect you for putting your faith in Christ for your eternal life. I am pleading to you on the basis of the Bible to please review your religious views concerning abortion. It was the Bible that caused the abolition movement of the 1800’s and it also was the basis for Martin Luther King’s movement for civil rights and it also is the basis for recognizing the unborn children.

The Politicization of the Department of Justice

The following is adapted from a speech delivered on September 16, 2022, in Washington, D.C., at Hillsdale College’s Constitution Day Celebration.

The seal of the U.S. Department of Justice reads, “Qui Pro Domina Justitia Sequitur”—“Who prosecutes for Lady Justice.” Depictions of Lady Justice are as familiar as they are instructive: she stands blindfolded while holding the scales of justice, representing her unyielding devotion to equal justice under the law. Contrary to this ideal, the DOJ today appears to be increasingly motivated by partisanship. Compounding the problem, it has access to the powers of the modern surveillance state. As someone passionate about the Constitution and the Bill of Rights, I believe there is no higher priority than addressing this danger.

The tragic events of 9/11 marked a turning point in our nation’s recent civil rights history. First the terrorists attacked us—and then, in the name of national security, we began to attack ourselves. It has become almost cliché to say that we live in a surveillance state, but we do. Ever since Congress, on a fully bipartisan basis, enacted the Patriot Act six weeks after the attacks on 9/11, the ever-present eye of the government has been searching for new and creative ways to spy on American citizens. The government has the technology to monitor all of our electronic devices, listen to our phone calls, and read our emails and text messages—all under the auspices of national security.

This special law designed for an emergency has become a permanent addition to the government’s investigatory toolbox. The unfortunate reality is that the bulk of the actions taken by law enforcement under the Patriot Act have almost nothing to do with combating terrorism. Once-rare applications for surveillance warrants to the Foreign Intelligence Surveillance Court have multiplied many times in relative peacetime. Most of the spying conducted under the Patriot Act is for run-of-the-mill crimes that we’ve long expected law enforcement to address without special surveillance authority.

Now, it is bad enough to have a politically-neutral surveillance state controlled by the national security crowd and their DOJ cousins. But take that panopticon and put it in the hands of an executive branch willing to weaponize its reams of information against its perceived political enemies, and we’ve got a frightening problem on our hands.

Laws such as the Patriot Act were designed to fight the unique problem of terrorism. But they quickly morphed into a mechanism by which the government keeps constant tabs on law-abiding Americans and threatens to disrupt their lives if they dare act contrary to those in power. And it’s within this world of omnipotent oversight and control that the U.S. Department of Justice now operates. They have all the tools of the surveillance state at their disposal, and the only thing standing in their way is an independent judiciary willing to enforce our constitutional rights. But we all saw how easy it is to spy on Americans—with virtually no judicial oversight—from the disgraceful episodes of broad surveillance applications, on flimsy and sometimes falsified pretexts, against citizens such as Carter Page.

Let me discuss three recent examples that illustrate the threats we face from a politicized DOJ: the DOJ raid on Project Veritas journalists, the DOJ raid on Mar-a-Lago, and the DOJ’s efforts to undermine election integrity and chill free speech.

Project Veritas Raid

In July 2021, Attorney General Merrick Garland issued a memo forbidding federal prosecutors from seizing journalists’ records. He did this with much fanfare, hauteur, and virtue signaling. But even as Mr. Garland was decrying the seizure of journalists’ records as a “wrong” his department would “not let . . . happen,” the DOJ was in the midst of a year-long campaign of spying on Project Veritas—a campaign that involved no fewer than 19 clandestine subpoenas, orders, and warrants obtained from nine magistrate judges. The secrecy of this spying campaign was maintained through the use of wide-ranging gag orders, including at least two that were obtained without notice to the judge overseeing the Project Veritas case. Through this spying campaign, we now know that the DOJ obtained approximately 200,000 Project Veritas emails from Microsoft and countless text messages (and heaven knows what else) from Apple, Google, Uber, and other still unknown companies.

Only six months after Mr. Garland’s memo was issued, the DOJ raided the homes of three Project Veritas journalists, seizing 47 electronic devices. And how did the world learn about this? Conveniently, someone leaked information about the raids to The New York Times—which Project Veritas happens to be suing. Indeed, The New York Times called Project Veritas for comment as the raids were still in progress.

What was the pretext for the raids? In the fall of 2020, confidential sources had approached Project Veritas journalists with a diary and other materials supposedly belonging to Ashley Biden, the President’s daughter. The sources said that the materials had been in their possession prior to contacting Project Veritas. The Project Veritas journalists proceeded to investigate whether the materials were authentic and whether the allegations they contained against Joe Biden were true. Ultimately, Project Veritas decided it could not sufficiently verify the allegations and that it would not publish the diary’s contents. It then turned the items over to local law enforcement in Florida.

The DOJ claims that Ashley Biden’s belongings were stolen. Project Veritas was told they weren’t, but even this is legally irrelevant. In the 2001 case Bartnicki v. Vopper, the U.S. Supreme Court held unequivocally that as long as journalists did not commit an alleged theft themselves, they were entitled to receive, investigate, and publish (or not publish) supposedly stolen materials. In the more recent case DNC v. Russian Federation, a federal court made it clear that the reporter could even ask for the stolen materials. This is not a crime—it’s called journalism.

Compare the DOJ’s treatment of Project Veritas to the DOJ’s inaction earlier this year when a Politico reporter was given a U.S. Supreme Court draft opinion overturning Roe v. Wade. The Politico reporter behaved precisely with this purloined document as the Project Veritas reporters had behaved with the diary, except that the Politico reporter did decide to publish the draft opinion. The different reactions on the part of the DOJ seemed to hinge entirely on whose ox was being gored.

But to repeat, the Garland Justice Department was rifling through the emails and phone messages of Project Veritas journalists before Project Veritas even knew of Ashley Biden’s diary. These documents contain donor information, source communications—including communications from whistleblowers within the federal government—and attorney-client communications. In its actions, the DOJ was not only ignoring court decisions and its own policies, it was violating the Privacy Protection Act, the common law Reporter’s Privilege, and the First and Fourth Amendments to the Constitution.

The Project Veritas matter is ongoing. Thanks to the DOJ’s leaks to The New York Times, which themselves violate federal law, Judge Analisa Torres overruled the DOJ’s objections and ordered the appointment of a special master to review the seized materials for various privileges. It’s a hollow victory, because Project Veritas has to pay tens of thousands of dollars for the privilege, so to speak, of being able to protect its own privileged documents.

Mar-a-Lago Raid

Although I have represented and continue to represent President Trump in several matters, I do not represent him on the matter of the DOJ’s raid on his Florida home, Mar-a-Lago. But that raid is significant and worth some attention.

Consider first the raid’s timing. President Biden’s approval ratings have been abysmal, and it is a mid-term election year. Bloombergreports that the DOJ will likely delay “charging” Trump with anything arising from the raid on his home until after the mid-terms. The effect of this is to create a cloud of perceived guilt running up to November 8, and use that as a political tool to smear pro-Trump voters and candidates. The DOJ hides behind its longstanding policy of not taking politically portentous actions close to an election—but how could the raid itself be construed as anything but such a portentous action?

President Trump and his lawyers were engaged in a cooperative dialogue with both the DOJ and National Archives representatives on the issue of storing and archiving confidential documents. He went as far as to invite the DOJ to survey the documents he had on his property, and the DOJ seemed to have expressed little urgency in pursuing the matter.

This latest episode of G-men gone wild is not all that different from the FBI strategy before and after Trump’s election in 2016, when the FBI was weaponized to investigate claims of Russian collusion that ultimately proved to have been made up by Democrat operatives. But more importantly, the raid raises serious constitutional objections.

The Fourth Amendment provides that the “right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

The American Founders were intensely concerned about government intrusion. Breaking into the homes of political opponents and depriving them of their possessions was common practice under the rule of the British king in colonial America. The use of general warrants and writs of assistance by the Crown was the ultimate interference with the colonists’ right to political and personal autonomy. Such invasions were so pervasive, and so universally despised, that the Founders saw fit to ensure that the Constitution expressly forbids such practices.

For over 180 years after the Founding, the Supreme Court applied the Fourth Amendment’s protections largely to places and things. Unsurprisingly, this meant that dwellings were given a heightened sense of protection against government intrusion. The Supreme Court has reiterated, in the 1980 case Payton v. New York, that “the physical entry of the home is the chief evil against which the wording of the Fourth Amendment is directed.”

In addition to where and what receives Fourth Amendment protection is the question of howthe government can conduct searches and seizures without offending the Constitution. Searches are only permitted if they are “reasonable,” and a search is generally considered “reasonable” only when the government first obtains a properly issued warrant. “Properly issued” means the warrant must describe with specificity the places to be searched and the things to be seized, must be supported by probable cause, and must be issued by a “neutral and detached magistrate.” Taken together, this is colloquially known as the “warrant requirement”—and it is central to any honest analysis of the Mar-a-Lago raid.

At its core, the problem with the FBI’s search of President Trump’s home is its inconsistency with the letter and the spirit of the Fourth Amendment. The shroud of secrecy surrounding the probable-cause affidavit used by the FBI to obtain the warrant prevents the public from judging whether the government had a valid reason for this unprecedented search. Even more, the list of places to be searched and things to be seized contained in the warrant application comprised a blanket sweep of the former president’s entire private residence and offices, targeting “any evidence” supporting a potential violation of a handful of federal statutes that are the usual suspects when it comes to politicized prosecutions.

While this alone doesn’t make the warrant defective, the Justice Department’s “just trust us” approach to support the raid makes it nearly impossible to determine the legitimacy of the government’s unprecedented actions. This leaves us no choice but to speculate. And based on the information publicly available, the DOJ’s actions have all the trappings and appearances of a vindictive and politically-motivated fishing expedition.

As in the Project Veritas case, the judge in the Mar-a-Lago case has issued an order appointing a special master. In doing so, the judge pointedly observed that some of the resultant delay the government complains of is caused by the government’s cutting corners, suggesting implicitly that the government abused the warrant process.

Election Integrity and Free Speech

As has been widely reported, the DOJ is currently issuing subpoenas to individuals who have dared to question the 2020 election results. This is occurring against the backdrop of President Biden’s vendetta against what he calls “ultra MAGA Republicans.” This is the type of behavior you’d expect in a third-world dictatorship.

Included in the DOJ’s crosshairs are those who participated in the political process as alternate electors; those in Congress who voted against certifying the election results; those who organized or peacefully attended a permitted rally on the Ellipse in Washington, D.C., on January 6, 2021, even if they had nothing to do with the activities at the Capitol on that day; and those who have raised funds from donors with a promise to investigate and challenge election fraud.

All of these activities have long historical precedents in our country and are protected by the First Amendment. Indeed, it was Democrats who challenged the presidential election results in 2000, 2004, and 2016. Let’s review the evidence.

In 2000, 15 House Democrats objected to counting Florida’s electoral votes. Several members of Congress called the 2000 election “fraudulent,” and Texas Representative Eddie Bernice Johnson vowed that there would be “no peace” because of the allegedly stolen election.

In 2004, Democrats in Congress forced a vote to recess the joint session of Congress counting electoral votes in order to debate perceived election irregularities in Ohio. Thirty-one House Democrats voted to reject Ohio’s electoral votes and were applauded for doing so by Illinois Senator Dick Durbin, among others.

In 2016, several Democrats objected to the certification of Trump electors based on “overwhelming evidence of Russian interference” in the election. Maryland Representative Jamie Raskin objected to ten of Florida’s electors based on a Florida statute that prohibits state legislators from being electors. Texas Representative Sheila Jackson Lee proclaimed, “If in that voting, you have glaring matters that speak to the failure of the electoral system, then it should be challenged.”

No DOJ action was taken in any of these previous years. What has changed, if not the politicization of the Justice Department?

Elections are the engine of our republic. They ensure the peaceful transfer of power and are the primary method for the people to influence their government. And our Constitution’s elections clause—Article I, Section 4, Clause 1—gives states the primary duty of regulating the time, places, and manner of elections for federal office. The DOJ’s role is very limited in this regard. It has the power to administer the Voting Rights Act, a power that was once necessary to push back on Jim Crow laws. But the era of Jim Crow is long gone, and it shouldn’t be up to a politicized DOJ to dictate what election integrity looks like.

The 2020 election was rampant with reports of irregularities. Some of these reports were more accurate than others. But states were right to take appropriate steps to increase the security of their elections in the wake of such reports. And yet, from its first days, the Biden administration has been bent on waging an intimidation campaign against states attempting to bolster election integrity.

Consider Georgia. The midnight ballot dump that pushed Biden ahead of Trump had all the appearances of manipulative ballot stuffing. That was followed by days of uncertainty about who won. Reports soon surfaced of massive ballot harvesting—illegal in Georgia—as well as deeply concerning evidence that Mark Zuckerberg-funded nonprofits had placed personnel in election operations in blue counties with the effect of decreasing signature-matching efforts.

Given the backdrop in which the 2020 election took place—with new and expansive vote-by-mail procedures—it’s not surprising that alarms went off and that many citizens questioned the final vote tally. So rather than allow this scenario to repeat itself in future elections, Georgia’s legislature took action, enacting a package of election-reform legislation designed to bolster ballot security.

President Biden denounced these reforms—which, as many commentators noted, made voting easier than in Biden’s home state of Delaware—as “Jim Crow 2.0.” The DOJ sued Georgia to block the new law and issued two new guidance documents intended to put states including Georgia on notice of potential violations of federal election laws. It has used similar tactics in Arizona and Texas.

It is not just political activists who are subject to DOJ intimidation. Attorney General Garland recently issued a guidance document prohibiting DOJ employees from speaking directly to members of Congress. This was plainly in response to at least 14 FBI whistleblowers reaching out to members of Congress—including Ohio Representative Jim Jordan and Iowa Senator Chuck Grassley—about misconduct within the DOJ. Garland’s action was highly improper, but it pales in comparison to the intimidation of concerned parents at local school board meetings.

On October 4, 2021, Garland issued a memorandum directing the FBI to address “threats” at local school board meetings. This was in response to a request from the National School Boards Association that the DOJ leverage the Patriot Act and other counterterrorism tools to investigate moms and dads who were voicing their displeasure with school policies at local school board meetings.

Despite Garland’s sworn testimony denying the use of counterterrorism tools to investigate concerned parents, whistleblower evidence tells a different story.

On October 20, 2021, Carlton Peeples, the Deputy Assistant Director for the FBI’s Criminal Investigation Division, sent an email directing FBI personnel to use the tag “EDUOFFICIALS” for all school board-related investigations. Whistleblowers say that the FBI opened investigations into parents in every region of the country. These included an investigation of a “right-wing mom” based on her participation in a “Moms for Liberty” group and personal ownership of a gun. Another investigation was opened when a dad was deemed to “fit the profile of an insurrectionist” after complaining about school mask mandates.

It is time to wake up to the danger.

On November 11, 1762, King George’s men had a warrant when they stormed and raided the home of pamphleteer John Entick. They broke open locked doors, boxes, chests, and drawers and seized his private papers and books—all because the Crown suspected Entick of fomenting political opposition against the King. If the FBI’s raid on Project Veritas journalists’ homes or President Trump’s home at Mar-a-Lago teaches us anything, it’s that the political oppression of the eighteenth century remains a threat today. But today, in addition to brute force, our government has the power of the modern surveillance state.

As a graduate of the University of Virginia Law School, I would be remiss in speaking about the Constitution and the Bill of Rights without quoting Thomas Jefferson, who wrote: “the most sacred of the duties of a government [is] to do equal and impartial justice to all its citizens.” We must find a way to return our Department of Justice to that central principle of American constitutionalism, as it carries out its duties in the name of Lady Liberty.

Hobbs, who currently serves as Arizona’s Secretary of State, said Lake had misconstrued her position and said late-term abortion is “extremely rare.”

Corporate Tax Rates and Taxable Income

Tax revenue increased dramatically. Not just in nominal terms. Not just in inflation-adjusted terms.

Corporate receipts actually climbed as a share of GDP.

And this was during the decades when economic output was rapidly expanding.

In other words, the Irish government got a much bigger slice of a much bigger pie after tax rates were dramatically lowered.

In response to a 10% increase in the expected marginal tax rate, private U.S. firms decrease taxable income by 9.1%, which indicates a discernibly more elastic response than prevailing estimates. This response reflects a decrease in taxable income of 3.0%arising from real economic responses to a firm’s scale of operations and 6.1% arising from accounting transactions via (for example) revenue and expense timing. Responsiveness to the corporate tax rate is more elastic if a firm uses cash (9.9%) rather than accrual accounting (7.4%), if the firm is small (9.9%) rather than large (8.6%), and if the firm discounts future cash flows at a lower rate.

The paper is filled with equation, graphs, and jargon, but the above excerpt tells us everything we need to know.

When tax rates go up, taxable income goes down (both because there is less economic activity and because companies have more incentive to manipulate the tax code).

Thus confirming what I wrote back in 2016 about taxable income being the key variable.

By the way, this does not mean that lower tax rates lead to more revenue. Or that higher tax rate produce less revenue.

I’m thinking of inventing a game, sort of a fiscal version of Pin the Tail on the Donkey.

That won’t be an easy game to win since we have data from the BIS, OECD, and IMF showing that government is growing far too fast in the vast majority of nations.

We also know that many states and cities suffer from the same problems.

A handful of local governments already have hit the fiscal brick wall, with many of them (gee, what a surprise) from California.

The most spectacular mess, though, is about to happen in Michigan.

The Washington Post reports that Detroit is on the verge of fiscal collapse.

After decades of sad and spectacular decline, it has come to this for Detroit: The city is $19 billion in debt and on the edge of becoming the nation’s largest municipal bankruptcy. An emergency manager says the city can make good on only a sliver of what it owes — in many cases just pennies on the dollar.

Detroit obviously is an example of a government that is collapsing sooner rather than later.

Why? Simply stated, as the size and scope of the public sector increased, that created very destructive economic and political dynamics.

More and more people got lured into the wagon of government dependency, which puts an ever-increasing burden on a shrinking pool of producers.

Check out this sentence.

Property tax collections are down 20 percent and income tax collections are down by more than a third in just the past five years — despite some of the highest tax rates in the state.

The city has a lot more problems than just high tax rates, of course, but can there be any doubt that productive people have very little incentive to earn and report taxable income in Detroit?

In some cases, higher tax rates will discourage people from earning more taxable income.

In some cases, higher tax rates will discourage people from reporting all the income they earn.

In some cases, higher tax rates will encourage people to utilize tax loopholes to shrink their taxable income.

In some cases, higher tax rates will encourage migration, thus causing taxable income to disappear.

Brett Favre, Redistribution, Welfare Reform, and Government-Enabled Corruption

I have repeatedly opined that big government enables corruption.

And I have also asserted over and over again that big government is a racket for the benefit of insiders.

So you can understand why I get upset when the rich and powerful use the coercive power of government to line their pockets at the expense of ordinary taxpayers.

Now I have a new reason to be angry.

Reporting for the New York Times, Neil MacFarquhar describes a scandal involving Mississippi bigwigs feeding at the public trough.

John Davis, who served as executive director of the Mississippi Department of Human Services under former Gov. Phil Bryant, pleaded guilty to both federal and state charges of embezzling federal welfare funds. Millions of dollars were transferred to friends and relatives, court documents say. According to a lawsuit filed by the state in May, around $5 million was diverted to Ted DiBiase, a flamboyant retired wrestler once known as “The Million Dollar Man,” and two of his sons…Much of the money went to fictitious services, bogus jobs, first-class travel arrangements and even one son’s stay at a luxury rehab center in Malibu, Calif., that cost $160,000, the suit claims. Similarly, the state claims that Marcus Dupree, a former high school football phenom and professional running back, who was paid to act as a celebrity endorser and motivational speaker, did not perform any contractual services toward the $371,000 he received to purchase and live in a sprawling residence with a swimming pool and adjacent horse pastures in a gated community. Mr. Favre, who earned more than $140 million in his Hall of Fame career, was paid $1.1 million for speeches he never gave, the suit said. He also orchestrated more than $2 million in government funds being channeled to a biotechnology start-up in which he had invested, according to the suit. …The case follows a state audit released in May 2020 suggesting that as much as $94 million of TANF funds might have gone astray.

Sounds like a typical story about big government and corruption, right?

That’s certainly true, but some of our friends on the left argue that it is also evidence that Bill Clinton’s welfare reform backfired.

Experts said the fraud was rooted in changes enacted in such programs in 1996, when cash benefits paid to poor families were replaced by block grants issued to states.

Since I have defended Clinton’s welfare reform(along with some of his other good policies), the above excerpt caught my attention.

So I looked for more information.

In a piece for the American Enterprise Institute, Angela Rachidi explains the underlying issues.

A scandal involving former NFL quarterback Brett Favre and the federal welfare program Temporary Assistance for Needy Families (TANF) exploded…following new revelations that Mississippi officials, including the former governor, misdirected federal TANF money to enrich themselves, their celebrity friends, and other well-connected individuals. …the scandal draws attention to the TANF program. Critics have partly blamed the welfare reform law from 1996, which created TANF, for allowing such fraud.…Instead of an entitlement where government officials distribute money to all eligible people, TANF is a block grant provided… As awful as this scandal is, the fraud and abuse on display in Mississippi is not unique to TANF and not caused by its block grant structure. The Government Accountability Office (GAO) estimated that from 2015–2017 the annual average amount of Supplemental Nutrition Assistance Program (SNAP) benefits (or food stamps) “trafficked,” meaning retailers taking a fraudulent profit, was $1.2 billion. The GAO also found that improper payments in Medicaid, including payments for services not provided, totaled $36.7 billion in 2017. Earlier this month, the Department of Justice charged a nonprofit organization in Minnesota with a $250 million scheme that took federal pandemic-relief money earmarked for a child nutrition program and instead pocketed the funds.

In other words, corruption is an inherent part of government programs, whether the money is distributed as block grants or sent directly to recipients.

But not all government spending is created equal. Some ways of spending money do more damage than other ways of spending money.

Ms. Rachidi points out that welfare reform produced good results. I don’t know if it saved money for taxpayers, but it led to progress as measured by variables such as labor force participation and child poverty.

None of this excuses what happened in Mississippi, but the context is important. Welfare reform, which created TANF, transformed a broken entitlement program—Aid to Families with Dependent Children—into a more effective system that gives states flexibility to address the underlying causes of poverty, including limited employment and unmarried parenthood. These reforms have significantly reduced dependence on cash welfare and increased employment among single mothers, which helped dramatically lower child poverty over the past two decades.

The obvious takeaway, as I pointed out back in 2015, is that we should we should be expanding on Bill Clinton’s success by replacing other federal entitlements with block grants.

The federal government maintains a Byzantine maze of redistribution programs, so there are lots of opportunities for progress. Medicaid is an obvious example, along with food stamps. Especially since both programs are riddled with fraud.

P.S. Unsurprisingly, Joe Biden wants to move in the wrong direction.

The Depressing Reincarnation of Build Back Better

One of the best things about 2021 was the fact that Congress did not approve Joe Biden’s economically debilitating plan to raise taxes and expand the welfare state.

His so-called Build Back Better plan was a very bad mix of class-warfare tax policy and redistributionist spending policy.

But one of the worst things about 2022 may be the reincarnation of a slimmed-down version of Biden’s plan.

Simply stated, the “slimmed-down version” of a terrible piece of legislation is bad news – even if it is possible to envision something even worse.

The Wall Street Journal‘s editorial on the package illustrates why it is bad news that Senator Joe Manchin is trying to rescue Biden’s statist agenda.

As the economy slouches near recession, Majority Leader Chuck Schumer and West Virginia Sen. Joe Manchin…unveiled a tax-and-spending deal that they call the Inflation Reduction Act.Is their aim to reduce inflation by chilling business investment and the economy? …A more accurate name would be the Business Investment Reduction and Distortion Act since that will be the result of its $433 billion in climate and healthcare spending, and $615 billion in new taxes and drug price-control “savings.”

The editorial highlights four terrible provisions.

First, there’s a big tax hike on American companies, with the biggest tax hike on firms that make new investments.

…the 15% minimum tax on corporate book income…will slam businesses whose taxable income is lower than the profits on their financial statements owing to the likes of investment expensing.

For all intents and purposes, politicians would be creating a second type of corporate income tax.

Heavy compliance costs for the business community, of course, but the rest of us probably care more about the estimated loss of 218,000 jobs according to the National Association of Manufacturers.

Second, there are corrupt “green energy” provisions that will degrade America’s energy efficiency and security.

…the bill’s $369 billion in climate spending, most of which is corporate welfare. …All of this will steer private investment into green energy at the cost of reduced investment in fossil fuels. Wind and solar subsidies are already creating distortions in power markets that make the electric grid less reliable and energy more expensive. The expansion of subsidies will compound these problems.

If you want to know why this is bad, just remember Solyndra.

Third, the legislation imposes back-door price controls on the pharmaceutical industry.

The bill will require the Health and Human Services Secretary to “negotiate” Medicare prices—i.e., impose price controls—for dozens of drugs. But the $288 billion in putative savings are fanciful. Manufacturers will hedge potential future losses by launching drugs at higher prices. …The bill will also discourage investment in innovative treatments that could reduce future healthcare spending.

For those of us who value the development of new drugs to fight problems like cancer and Alzheimer’s, this is very bad news.

Fourth, a very corrupt internal revenue service is rewarded for its bad behavior.

Speculative revenue of $124 billion will also come from an $80 billion boost for the IRS. Most of this will finance more audits. The rich can afford more tax lawyers, but middle and upper-middle class Americans will be inclined to settle IRS claims, however meritless, lest they spend even more to defend themselves.

P.S. I can’t resist sharing one final bit of information.

If you peruse the Joint Committee on Taxation’s analysis of the bill, you’ll find that Joe Biden is breaking his promise not to raise taxes on people making less than $400,000 per year.

Not that anyone should be shocked. I have repeatedly explained that the big spenders need to pillage lower-income and middle-class household if they want to finance bigger government.

Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

The federal government debt is growing so much that it is endangering us because if things keep going like they are now we will not have any money left for the national defense because we are so far in debt as a nation. We have been spending so much on our welfare state through food stamps and other programs that I am worrying that many of our citizens are becoming more dependent on government and in many cases they are losing their incentive to work hard because of the welfare trap the government has put in place. Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back. It seems to me we have to get back to the founding principles that made our country great. We also need to realize that a big government will encourage waste and corruption. The recent scandals in our government have proved my point. In fact, the jokes you made at Ohio State about possibly auditing them are not so funny now that reality shows how the IRS was acting more like a monster out of control. Also raising taxes on the job creators is a very bad idea too. The Laffer Curve clearly demonstrates that when the tax rates are raised many individuals will move their investments to places where they will not get taxed as much.

Why the IRS Persecuted the Tea Party and How to Fix the Problem

Did President Obama and his team of Chicago cronies deliberately target the Tea Party in hopes of thwarting free speech and political participation?

Was this part of a campaign to win the 2012 election by suppressing Republican votes?

Perhaps, but I’ve warned that it’s never a good idea to assume top-down conspiracies when corruption, incompetence, politics, ideology, greed, and self-interest are better explanations for what happens in Washington.

Writing for the Washington Examiner, Tim Carney has a much more sober and realistic explanation of what happened at the IRS.

If you take a group of Democrats who are also unionized government employees, and put them in charge of policing political speech, it doesn’t matter how professional and well-intentioned they are. The result will be much like the debacle in the Cincinnati office of the IRS. …there’s no reason to even posit evil intent by the IRS officials who formulated, approved or executed the inappropriate guidelines for picking groups to scrutinize most closely. …The public servants figuring out which groups qualified for 501(c)4 “social welfare” non-profit status were mostly Democrats surrounded by mostly Democrats. …In the 2012 election, every donation traceable to this office went to President Obama or liberal Sen. Sherrod Brown. This is an environment where even those trying to be fair could develop a disproportionate distrust of the Tea Party. One IRS worker — a member of NTEU and contributor to its PAC, which gives 96 percent of its money to Democratic candidates — explained it this way: “The reason NTEU mostly supports Democratic candidates for office is because Democratic candidates are mostly more supportive of civil servants/government employees.”

Tim concludes with a wise observation.

As long as we have a civil service workforce that leans Left, and as long as we have an income tax system that requires the IRS to police political speech, conservative groups can always expect special IRS scrutiny.

And my colleague Doug Bandow, in an article for the American Spectator, adds his sage analysis.

The real issue is the expansive, expensive bureaucratic state and its inherent threat to any system of limited government, rule of law, and individual liberty. …the broader the government’s authority, the greater its need for revenue, the wider its enforcement power, the more expansive the bureaucracy’s discretion, the increasingly important the battle for political control, and the more bitter the partisan fight, the more likely government officials will abuse their positions, violate rules, laws, and Constitution, and sacrifice people’s liberties. The blame falls squarely on Congress, not the IRS.

I actually think he is letting the IRS off the hook too easily.

But Doug’s overall point obviously is true.

…the denizens of Capitol Hill also have created a tax code marked by outrageous complexity, special interest electioneering, and systematic social engineering. Legislators have intentionally created avenues for tax avoidance to win votes, and then complained about widespread tax avoidance to win votes.

So what’s the answer?

The most obvious response to the scandal — beyond punishing anyone who violated the law — is tax reform. Implement a flat tax and you’d still have an IRS, but the income tax would be less complex, there would be fewer “preferences” for the agency to police, and rates would be lower, leaving taxpayers with less incentive for aggressive tax avoidance. …Failing to address the broader underlying factors also would merely set the stage for a repeat performance in some form a few years hence. …More fundamentally, government, and especially the national government, should do less. Efficient social engineering may be slightly better than inefficient social engineering, but no social engineering would be far better.

Amen. Let’s rip out the internal revenue code and replace it with a simple and fair flat tax.

But here’s the challenge. We know the solution, but it will be almost impossible to implement good policy unless we figure out some way to restrain the spending side of the fiscal ledger.

At the risk of over-simplifying, we will never get tax reform unless we figure out how to implement entitlement reform.

Happy Columbus Day! Remember Columbus Day? That’s the day that we celebrate the discovery of the New World by Christopher Columbus and all that happened after, which was the creation of the freest and most humane society in the history of man. We’re still celebrating it, but we’re also assessing what happened to that society because it is changing.

We want to tell you the story of a man called Paul Vaughn leading off tonight. Paul Vaughn does not fit the profile of a terrorist. You’d never guess. He’s 55 years old. He’s a former pastor who now runs a small Internet service business in middle Tennessee. He and his wife are gentle people. They’re faithful Christians. They spend most of their time raising their 11 children.

Last Wednesday morning, at about 7:15 a.m., a bucolic scene at the Vaughn household. Several of Paul Vaughn’s children are standing in the front yard about to head to school. Suddenly, out of nowhere, their world falls down around them. A team of FBI agents armed with automatic rifles swoop in in their SUVs and begins pounding on the front door of the family home.

Inside the house, Paul Vaughn is watching this and he shocked, as he said later, “When I opened the door and saw the guns pointed at me, I asked them what they wanted. They said they wanted me,” and they did. The agents led Paul Vaughn away. Inside the house, his wife who had been at the back with their newest child, an 18-month-old baby, ran to the front door. Confused and terrified, she asked what anyone would ask, “Who are you and why are you taking my husband away?” We don’t need to guess about the exchange because it’s on tape. Here’s what it looked like.

WIFE: No, you didn’t. You did not try. This is not acceptable. Can I have your name? You’re not going to give me your name? You’re not going to give me any information?

Body armor, little watch caps, automatic weapons held at the ready, taking off with her husband. “Why are you taking him? Who are you?“ she asks, but of course they completely ignore her. “No, we’re not going to answer. We tried” – when they didn’t. They don’t have to answer because when your husband is a domestic terrorist, the government doesn’t owe you an answer to the most basic questions. So, Paul Vaughn, we now learn, is a terrorist, but what did he do? You may be wondering that by this point.

Well, as the Department of Justice explained later in the statement, Paul Vaughn opposes abortion and not just in a quiet, personal way. That would be bad enough, but Paul Vaughn is outspoken about his views on abortion. He still believes, being 55, this is a free country with a Bill of Rights that allows you the freedom to say what you want and even have protests on behalf of your ideas. He believes that was the freedom that built this country. So, a year and a half ago, on March 5 2021, Vaughn and ten volunteers from a Christian pro-life group in Tennessee staged a protest at an abortion clinic in Mount Juliet. Now, we don’t need to speculate about what happened next, and that’s a good thing for Paul Vaughn. It was broadcast live on Facebook by one of the volunteers. That would be 73-year-old Chester Gallagher. Watch this:

So, you live in the United States and you watch nightly the chaos in your city, buildings burning, people being pushed in front of subway trains, people getting knocked in the face on the street for no reason, carjackings, murders up in every city in America. So, you look at that and you think, is that really it? That’s why armed FBI agents with automatic rifles arrived at Paul Vaughn’s home last Wednesday? Because of that? Because more than a year ago, a group of Christians, many of them elderly, sang hymns? Yeah, that’s it. That’s what he did wrong.

Now we should note that we only have this video evidence because of the hard work of Mia Cathell at Townhall, which broke this story. God bless. Without this documentary evidence, without this video, you might be tempted to believe the Biden administration when it tells you that Paul Vaughn “used force and physical obstruction to injure, intimidate and interfere with employees of the abortion clinic.”

Oh, but he didn’t. He didn’t use physical force. He sang hymns, but for doing that, Joe Biden’s Department of Justice now tells us Paul Vaughn deserves to spend 11 years in prison. 11 years? Vaughn’s “coconspirators” from that day in March of 2021, meaning other pro-life activists, are also facing long prison sentences.

This group would include 87-year-old Eva Edl. Now, if that name sounds familiar to you, it’s because she is something of a celebrity in Christian circles, pro-lifecircles, and that’s because she survived a Yugoslav concentration camp before escaping to this country, where she spent decades advocating against abortion. She has seen firsthand what happens when the government denies the essential humanity of a person. In this picture, you can see her sitting in front of an abortion clinic as a police officer towers over her. Within seconds, two officers are shoving this 87-year-old into the back of a car.

Now, again, contrast this with the country you watch every night on television or the one you experience if you live in a city where people are afraid to go to the grocery store, where Wendy’s burned down in the name of civil rights, and no one does a thing about it. Watch how they’re treated.

Same thing happened to 58-year-old Heather Idoni back in March of 2021. It took a whole team of police officers to remove her. Really? You wonder why. How dangerous does she look? Then there was 57-year-old evangelist Calvin John Zastrow. He was also arrested that day in March. Here’s a video he shot discussing it:

ZASTROW: When we have national revival, this is what every abortion clinic’s gonna look like right here, a field of rubble. Not through violence, through peace, through God bringing the high places down. So, let’s go show up in front of those high places, trust him, rescue, preach sing pray, and see this happen to the rest of ‘em.

Now, you may not share his views. Maybe you do, maybe you don’t, but be as honest as you can with yourself. Does that guy look dangerous and if so, compared to what? There are a lot of dangerous people wandering around completely unimpeded. In fact, they’re celebrated by this administration. Is that guy a dangerous person? Of course, he’s not. He’s a Christian. Maybe you’re not a Christian. Maybe you’re pro-choice.

But even if you are, you are not, if you’re being completely honest, going to conclude that that guy poses a threat to you or this country because he doesn’t and neither is his daughter, who’s 24 years old, Eva Darlene Zastrow. She was also apprehended at the clinic with her father. Here’s her violent manifesto.

DARLENE ZASTROW: I’d seen the pictures before, and I heard that it was murder before, but the connection went from knowing it here to knowing it in my heart. I just praise God that he gave me the opportunity to rescue, and Lord willing, abortion will end.

So imagine sitting back at Department of Justice headquarters assessing that video and saying to yourself, “You know what? They need an armed FBI raid. Get out the body armor. That’s a terror manifesto.” Apparently, they did conclude that because now Joe Biden’s Justice Department, the FBI, to its eternal shame, is rounding up everyone associated with Paul Vaughn’s entirely nonviolent Christian organization.

Take a look at the mug shots from the FBI’s investigation into this event in March of 2021. It’s on your screen right now. They’re telling you, the FBI is telling you, bragging about it, that these people are dangerous. and of course, you know what they know, which is in America 2022, whether you’re dangerous or not, depends almost entirely on who you voted for.

There are people in this country who molest children. True fact. You are hearing now that they are “minor-attracted persons.” You have people on television trying to minimize the gravity of child molestation. Why is that? Well, because they’re probably Biden voters. That’s the assumption anyway. Meanwhile, those people in the mug shots on the screen, those are the terrorists.

Keep in mind that Biden voters, who’ve actually killed people, are facing less jail time than these Christian protesters. Illinois BLM rioter Matthew Rupert received fewer than 11 years for setting fire to a cell phone store in Minneapolis. Oh, really? 26-year-old Montez Terriel Lee received fewer than 11 years in prison for setting fire to the Max It Prawn Shop in Minneapolis, a fire that wound up killing a 30-year-old man. He got less time than Paul Vaughn is facing.

RELIGIOUS CALIFORNIANS VOICE OPPOSITION TO PROPOSITION 1 MAKING ABORTION A RIGHT IN STATE CONSTITUTION

20-year-old Samuel Elliot Frey was sentenced to just over two years in federal prison for setting fire to a health food store, but it was for a good cause. It was for Joe Biden, so not a big deal. All of those crimes and countless others that are happening around the country at a scale we have not seen in our lifetimes, all of those crimes are being treated as less serious offenses than a man who sang hymns in an abortion clinic.

So, what’s going on here? Well, a day before the FBI’s raid on Paul Vaughn, Joe Biden and Kamala Harris announced their new policy, which is pro-lifers, because they disagree with Joe Biden and upset the base, are now terrorists.

VICE PRESIDENT KAMALA HARRIS: What we believe, and I certainly believe, that a woman should have the freedom to make decisions about her own body and that her government should not be making those decisions for her. Today’s extremist so-called leaders are attacking the freedom and liberty of millions of women.

PRESIDENT JOE BIDEN: We’re not going to sit by and let Republicans throughout the country enact extreme policies to threaten access to basic health care. My message to folks across the country who are worried about what we’re seeing is first, that we have your back.

JILL BIDEN TARGETS GOP WITH STORY OF HELPING FRIEND AFTER ABORTION WHEN IT WAS ILLEGAL: ‘DEVASTATING’

So, you think to yourself as you watch something like that, “Well, of course, there’s an election coming up in just a few weeks and a lot of the Democratic base believes that abortion is the key to freedom and happiness and they’re very upset about the Roe v. Wade decision. Roe v. Wade is no longer the law of the land and so Biden and Harris and the rest of the leaders of that party are pandering to them.” It’s okay. We’re on your side.

What you don’t think as you watch something like that, that its effect will mean sending guys with automatic weapons to Paul Vaughn’s house and scaring the hell out of his 11 children. You never would have imagined that in real life, people who sang hymns in an abortion clinic could be facing 11 years in prison. So, you have to ask, since the parallels are very clear, this is effectively the modern version of Bull Connor’s fire hoses and German Shepherds, has a single Democrat pointed out that this is insane, that an 11-year sentence for him singing might be a little punitive?

Has Sandy Cortez said anything? Wait a second. We’re pro-choice and everything but 11 years for a 55-year-old father of 11? Has Rashida Tlaib? What about George Gascon or Larry Krasner? The guys who think, “Well, we put away too many people in prison. We got to pull back a little bit. We got to rehabilitate them.” What about the compassion mongers at CNN or MSNBC? Have they said a word about this? As their country becomes totalitarian, have they even noticed? We checked. No. The only clip we could find was Nancy Pelosi, where she endorses violence against her political enemies. Here she is.:

REPORTER: There has been a number of attacks on churches, on crisis pregnancy centers. Republicans are going after Democrats for not saying anything and they’re saying that your rhetoric is contributing to these attacks on these crisis pregnancy centers.

HOUSE SPEAKER NANCY PELOSI: Well, let me just say this: a woman has a right to choose, to live up to her responsibility. It’s up to her, her doctor, her family, her husband, her significant other and her god. I’m a very Catholic person and I believe in every woman’s right to make her own decisions.

BIDEN DOJ INDICTS 11 PRO-LIFE ACTIVISTS FOR BLOCKING ACCESS TO ABORTION CLINIC

First of all, you’re not a Catholic. I mean, this is ridiculous. Let’s stop pretending. Second, you don’t believe at all of the right to choose. You applauded as nurses got fired because they didn’t want to take the mandatory vax because they did want to hurt their own fertility. They wanted to have children maybe some day and you thought that was great. So, it wasn’t their body, their choice. You’re a liar and a fraud. You’re not a Christian. Be quiet.

But what’s really stunning is nobody the people who’ve lectures for years, the criminal justice system is just to mean that MS-13 are children of God. They have a problem with us at all. The people who claim to hate mass incarceration, it turns out, are strongly for the mass incarceration of anyone who disagrees with them, and they’re doing it.

As Julie Kelly has reported relentlessly, judges have sentenced dozens of January 6 defendants to months in prison, followed by probation. Why? Oh, because they entered a public building as police officers stood by, lifted the ropes for them. What was that about, by the way? Don’t ask, shut up. They belong in jail.

As of this week, dozens of January 6 defendants are still being held in pretrial detention. No one notices. Where’s the Republican Party in that? Nowhere. At the same time, the FBI has made zero arrests, none to protect pro-lifers from actual violence, not hymn singing, firebombing. The CompassCare Pregnancy Services center in Buffalo was firebombed in June. No arrests have been made. In fact, the FBI seized surveillance footage from the facility and never gave it back.

REPORTER: This building was up in flames this morning when police and firefighters arrived and this is the aftermath: broken windows, shattered glass and graffiti which the CEO says gives him an indication as to who is behind this. CEO Jim Harden says this didn’t come as a shock. Recently, CompassCare has received threats online and in person. The graffiti on the side of the building says “Jane was here” and Harden says he thinks the abortion rights group Jane’s Revenge is behind the attack. It’s a reference to Jane’s Collective which was provided underground abortions in Chicago in the 60s. The group took responsibility for firebombing a pro-life facility in Wisconsin last month. Harden says it’ll take months to repair the $100k worth of damage to the facility.

See how this works? So, a group aligned with Joe Biden firebombs a building (firebombs!) and the FBI does nothing. Instead, they send agents with automatic rifles to the home of a 55-year-old man with 11 children because he sung hymns in an abortionclinic.

This is too much actually. There’s always going to be disparities in justice. There’s always going to be disparities in law enforcement. You have to believe they’re unintentional. This is not unintentional. This is intentional. It’s right in our face, and it’s completely unacceptable.

Chris Wray, who runs the FBI, purportedly a good guy, a decent man who cares about justice, what does he think of this? Is this all right, sending FBI agents automatic weapons to arrest hymn singer? So, we called Chris Wray’s office today and asked a simple question: Are you okay with this? You know this is happening? You run the FBI. No response just like Paul Vaughn’s wife just shut the door. We don’t have to answer your questions.

These are political raids, and they’re exactly what the most recent FBI whistleblower Steve Friend warned about last month. The FBI didn’t respond to those warnings from one of its own agents. It just suspended Steve Friend. So, the raids are continuing. People need to see this. This is going too far, and it’s getting scary.

40 Years Later, the Left Goes to Court in Dubious Bid to Resurrect, Ratify Bygone ERA

Under Article V of the Constitution, two-thirds of Congress can propose constitutional amendments and, after 50 years of trying, sent the Equal Rights Amendment to the states in March 1972 with a seven-year ratification deadline.

Even after a disputed deadline extension, only 35 of the necessary 38 states had approved the ERA, and five of those states quickly withdrew their support.

The Congressional Research Service has repeatedly said that, as a result, “the ERA formally died on June 30, 1982.” Maybe not. Four decades later, Illinois and Nevada are suing the archivist of the United States, claiming that the ERA is already part of the Constitution after all.

Their case was argued before the U.S. Court of Appeals for the District of Columbia Circuit this week.

What’s going on?

Constitutional amendments proposed by Congress begin as resolutions introduced in the House or Senate. Of the thousands of resolutions, on a host of subjects, introduced since America’s founding, only 33 had the two-thirds support of Congress to be proposed, and 27 of those were approved by three-fourths of the states.

Four of the unratified amendments are still pending before the states because Congress did not set a ratification deadline, though no states have ratified any of them for nearly a century. One amendment, proposed in 1978 to give the District of Columbia congressional representation, expired when only 16 states ratified it by its seven-year ratification deadline.

That leaves the ERA.

The last state to ratify the ERA before its expiration date was Indiana in 1977. Then, Illinois passed a resolution purporting to ratify in 2017, Nevada did so in 2018, and Virginia followed in 2020.

Advocates claim that these “ratifications” were valid even decades after the deadline, while ratification rescissions by five states before the deadline were invalid.

Do the math, they say, 38 total states means the ERA is officially part of the Constitution. On advice of the Justice Department, however, the archivist of the United States concluded that those approvals were not legally sufficient, and the three latecomers originally sued in 2020 to force the archivist to officially publish in the Federal Register that the ERA is part of the Constitution.

With Virginia now under more sensible political and legal leadership, Illinois and Nevada pressed on.

ERA advocates do not claim that Congress lacks authority to set a ratification deadline at all. Nearly one-third of the amendments in the Constitution were proposed and ratified under a deadline. More than a century ago, the Supreme Court held that Congress’ authority under Article V to propose constitutional amendments includes the power “to fix a definite period for the ratification.”

Nor do ERA advocates argue that Congress’ ratification deadline for the ERA was questioned or disputed by anyone when it was proposed. Resolutions to propose the ERA had included ratification deadlines since the 1940s.

Supporters said in 1972 that such a deadline was “customary,” and the National Woman’s Party, which originated the ERA in the 1920s, said that the ERA’s backers would have no objection to it.

In a 1977 report co-authored by then-professor Ruth Bader Ginsburg, the U.S. Commission on Civil Rights acknowledged that the ERA would become part of the Constitution only if ratified by enough states within Congress’ seven-year deadline.

And when Congress extended that deadline by 39 months, the President’s Advisory Committee for Women conceded “three more states must ratify the ERA by [the June 30, 1982, deadline] if it is to become an amendment to the Constitution.” The only federal court to rule on the question said that the original deadline was firm and that the extension was unconstitutional.

Nor can supporters dispute that the ERA’s extended ratification deadline ended decades ago. In June 1982, five days before the ERA’s final expiration date, The Washington Post reportedthat the National Organization for Women had “concede[d] defeat,” ending its battle for the ERA’s ratification.

The Justice Department’s Office of Legal Counsel concluded the obvious in a 2020 opinion: “Congress had the constitutional authority to impose a deadline on the ratification of the ERA and, because that deadline has expired, the ERA Resolution is no longer pending before the States.”

The slim reed on which Illinois and Nevada base their claim is that Congress placed the 1972 ERA’s ratification deadline in the wrong place. It appears in the introductory clause of the proposing resolution rather than the text of the proposed amendment itself, and advocates claim that, therefore, it was not part of what the states ratified.

Everything rests on that distinction making an enormous constitutional difference. That’s the issue that the appeals court explored on Wednesday.

Where the deadline appears on the page, however, is irrelevant to whether the ERA remains open for ratification 40 years after everyone agreed it had died.

When Congress proposes a constitutional amendment, it votes on the proposing resolution, not simply on the amendment text. Testimony in 1978 during hearings on the ERA’s ratification extension established that 25 states passed an ERA ratification resolution that quoted Congress’ resolution in its entirety, including the ratification deadline.

In five other states, the record shows that the deadline was an explicit consideration during the ratification process.

ERA advocates are throwing some pretty dry legal spaghetti against the judicial wall and hoping it sticks in this case. Reviving the ERA, which—to again quote the Congressional Research Service—“formally died” 40 years ago is their only hope of ever getting something like this in the Constitution.

The original case for the ERA—namely, that states would not eliminate discriminatory laws and the courts would not interpret the Constitution to do so without it—evaporated long ago.

After joining the Supreme Court, Ginsburg said in a 1997 interview that “[t]here is no practical difference between what has evolved and the ERA.” In this case, the U.S. District Court dismissed the states’ lawsuit, finding that the states did not have legal standing to sue the archivist and that “even if Plaintiffs had standing, Congress set deadlines for ratifying the ERA that expired long ago. Plaintiffs’ ratifications came too late to count.”

The appeals court panel hearing from Illinois and Nevada included Judges Neomi Rao, appointed by President Donald Trump; Robert Wilkins, appointed by President Barack Obama; and, in her first oral argument, Michelle Childs, appointed by President Joe Biden.

During the argument, Wilkins acknowledged the Supreme Court precedents upholding Congress’ authority to set a ratification deadline, and Rao called the standing issue “tricky.” Since the requisite number of approving states, not the archivist’s announcement, determines final ratification, Rao said, the archivist’s decision not to issue that announcement does not legally harm Illinois or Nevada.

The Justice Department filed a brief agreeing with the 2020 opinion that Illinois and Nevada do not have legal standing to bring the lawsuit. Attorney Sarah Harrington suggested that a case in which legal standing is clear might be a better way to address the underlying issue of the ERA’s status.

This case in the D.C. Circuit parallels one brought in the 1st Circuit, which last year affirmed a district court’s dismissal on standing grounds.

The ERA has certainly acquired symbolic significance, even as the concrete need for it has disappeared. Its backers want to hang onto it for a host of other purposes, including to reestablish a constitutional right to abortion and block state pro-life laws.

But expiration dates matter, and even then-Justice Ginsburg said that the proposal and ratification process should start over. That should be an easy decision.

Today I posted an article today talking about what John MacArthur said last Sunday in a sermon about a letter he wrote to Governor Gavin Newsom about taking state money and purchasing billboards across the country to encourage people to come to California and have abortions. Here is the letter that John MacArthur wrote:

Sir,
Almighty God says in His Word, “Righteousness exalts a nation, but sin is a disgrace to any people” (Proverbs 14:34). Scripture also teaches that it is the chief duty of any civic leader to reward those who do well and to punish evildoers (Romans 13:1–7). You have not only failed in that responsibility; you routinely turn it on its head, rewarding evildoers and punishing the righteous.
The Word of God pronounces judgment on those who call evil good and good evil (Isaiah 5:20), and yet many of your policies reflect this unholy, upside-down view of honor and morality. The diabolical effects of your worldview are evident in the statistics of California’s epidemics of crime, homelessness, sexual perversions (like homosexuality and transgenderism), and other malignant expressions of human misery that stem directly from corrupt public policy. I don’t need to itemize or elaborate on the many immoral decisions you have perpetrated against God and the people of our state, which have only exacerbated these problems. Nevertheless, my goal in writing is not to contend with your politics, but rather to plead with you to hear and heed what the Word of God says to men in your position.

“It is an abomination for kings to commit wicked acts, for a throne is established on righteousness” (Proverbs 16:12).

What God said to Cyrus is a truth you should take to heart: “I am the LORD, and there is no other; besides Me there is no God. I will gird you, though you have not known Me; that men may know from the rising to the setting of the sun that there is no one besides Me. I am the LORD, and there is no other” (Isaiah 45:5–6).

In mid-September, you revealed to the entire nation how thoroughly rebellious against God you are when you sponsored billboards across America promoting the slaughter of children, whom He creates in the womb (Psalm 139:13–16; Isaiah 45:9–12). You further compounded the wickedness of that murderous campaign with a reprehensible act of gross blasphemy, quoting the very words of Jesus from Mark 12:31 as if you could somehow twist His meaning and arrogate His name in favor of butchering unborn infants. You used the name and the words of Christ to promote the credo of Molech (Leviticus 20:1–5). It would be hard to imagine a greater sacrilege.

Furthermore, you chose words from the lips of Jesus without admitting that in the same moment He gave the greatest commandment: “You shall love the LORD your God with all your heart, and with all your soul, and with all your mind, and with all your strength” (Mark 12:30). You cannot love God as He commands while aiding in the murder of His image-bearers.

Psalm 50:16–19 speaks to people who pervert the Word of God for their own sinful ends:

But to the wicked God says,
“What right have you to recount My statutes And to take My covenant in your mouth?
For you hate discipline,
And you cast My words behind you.
When you see a thief, you are pleased with him, And you associate with adulterers.
You let your mouth loose in evil
And you harness your tongue for deceit.”

My concern, Governor Newsom, is that your own soul lies in grave, eternal peril. “Each one of us will give an account of himself to God” (Romans 14:12). One day, not very long from now, you will face that reality. Nothing is more certain. “It is appointed for men to die once and after this comes judgment” (Hebrews 9:27). You will stand in the presence of the Holy God who created you, who is your Judge, and He will demand that you give an account for how you have flouted His authority in your governing, and how you have twisted His own Holy Word to rationalize it. As you look over the precipice of eternity, what will your answer be? When you look ahead of you and see that nothing awaits you but eternal misery—the just punishment for your sins—what will all the clever rationalizations and political talking points avail for you then? And by then it will be too late for any remedy or redemption. “It is a terrifying thing to fall into the hands of the living God” (Hebrews 10:31).

My plea to you, Sir, is that you would not let it come to that—that you would not go to that day of judgment apart from receiving forgiveness and righteousness through faith in Christ alone. In Psalm 50, after rebuking the wicked for uttering God’s words in a profane way, Scripture makes this promise: “Now consider this, you who forget God, lest I tear you in pieces, and there will be none to deliver. He who offers a sacrifice of thanksgiving glorifies Me; and he who orders his way, I shall show the salvation of God” (vv. 22–23).

So there is salvation for those who repent. Christ purchased full redemption for all who will turn from wickedness, forsake their evil thoughts and actions, and trust fully in Him as Lord and Savior.

Our church, and countless Christians nationwide, are praying for your full repentance. Please respond to the gospel, forsake the path of wickedness you have pursued all your life, turn to Christ, ask for forgiveness, and use your office to advance the cause of righteousness (as is your duty) instead of undermining it (as has been your pattern).

Seek the LORD while He may be found; call upon Him while He is near. Let the wicked forsake his way and the unrighteous man his thoughts; and let him return to the LORD, and He will have compassion on him, and to our God, for He will abundantly pardon. (Isaiah 55:6–7)
