I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

Americans Recognize Obamacare’s Religious Liberty Problem

Americans see the problem with the religious liberty violation at the leading edge of Obamacare implementation, according to a new poll released by Rasmussen Reports this week.

The poll shows that by a margin of 46–41, likely American voters support a religious exemption for churches, religious organizations, and businesses from Obamacare’s anti-conscience Health and Human Services (HHS) mandate. Sadly, the coercive dictates of the Obamacare bureaucracy don’t hold the same respect for conscience and religious freedom.

The Obamacare anti-conscience mandate, which forces almost all employers to provide and pay for coverage of abortion-inducing drugs, contraception, and sterilization, is accompanied by an offensively narrow religious exemption that effectively covers only formal houses of worship. Countless other employers—such as religious social service providers, schools, and business owners—are forced to pay for the mandated drugs and services regardless of religious or moral objections.

The consequences for non-compliance are steep. Hefty government fines—to the tune of millions of dollars for some companies—threaten not only employers’ religious freedom but their livelihoods.

Americans’ wariness over forcing employers to pay for mandated services in conflict with their deeply held beliefs is a concern shared by more than a few federal judges. Just last week, a fourth federal court halted enforcement of the anti-conscience mandate against a business owner. Tyndale House Publishers, one of the nation’s largest Bible retailers, won a preliminary injunction against the mandate that would have forced the for-profit company to pay for abortion-inducing drugs in its employee health plan in violation of the business’s Christian principles. Three other family-owned businesses—Hercules Industries, Weingartz Supply Company, and O’Brien Industrial Holdings—have also won preliminary injunctions against the mandate.

Many Americans—and certainly the more than 110 plaintiffs suing over the mandate—understand the offensiveness of the rule’s current, miniscule religious exemption. But concern over the mandate’s assault on religious freedom isn’t merely caused by the narrowness of this particular religious exemption. The root of the mandate’s disregard for Americans’ freedoms is found in the broader coercion of an invasive health care law that dictates what insurance companies must cover, what employers must provide, and what individuals must purchase.

Under a one-size-fits-all, government-controlled health care system, conflicts with religious freedom and individual liberty are only likely to increase.

In a separate Rasmussen poll from earlier this year, more than half of likely voters admitted they hadn’t personally felt any impact of the health care law, much of which won’t be implemented until 2014. Americans have yet to experience the full weight of Obamacare’s countless, liberty-crushing mandates that will crush individual choice in health care and place burdensome costs on businesses and individuals.

The anti-conscience mandate’s assault on religious freedom is only one of the first tastes of Obamacare’s coercive takeover of the health care system. The fact that almost half of likely voters recognize the need to protect employers’ religious freedom should signal greater concern for future dictates from a law that cedes discretion over personal health care decisions and consumer choice to unelected bureaucrats.

During the big-spending Bush years, economic and fiscal people inside the Administration often would sympathize with my complaints about bad policy, but say that there was nothing they could do since all the big decisions were being made by the political types in the White House.

In other words, Karl Rove and his crew were the ones who helped encourage Bush to hurt the country for short-run political gain.

So you can imagine I’m reluctant to give favorable attention to anything associated with Rove, but this new video from one of his organizations is too good not to share. The Department of Health and Human Services has a video contest to sucker gullible young people into signing up for Obamacare, and here’s the satirical gem put together by Crossroads GPS.

Perhaps not quite as good as my all-time favorite Benson cartoon, which perfectly captures Obama’s fiscal policy, but still an excellent contribution to the debate.  I also very much like her fiscal cliff cartoon, this Keynesian economics cartoon, and this one about jump-starting the economy with tax hikes.

In conclusion, let’s remember that young people are suffering for reasons other than Obamacare. Here’s a video from the Center for Freedom and Prosperity Foundation that looks at four examples of how Obamanomics is especially bad news for those under age 30.

Mitt Romney is probably the most liberal candidate the Republicans ever ran for President. Maybe it is good that he did not become President and the Republican standard bearer.

I’m delighted that Mitt Romney is floundering because of the government-run healthcare scheme he imposed on Massachusetts. Not only did it pave the way for Obamacare, but it’s also a good indicator of the awful, statist, big-government policies he would impose on all of us if he ever entered the White House.

This cartoon from the Detroit News is a pretty good summary of Mitt’s self-inflicted (and much-deserved) political problem.

As evidenced by my political cartoon contest, I’m a big fan of that form of satire.

And if I’m looking at cartoons specifically about statist economic policy, my favorites include Chuck Asay’s dead pig cartoon, as well as his cartoon about the big bad wolf.

And this Michael Ramirez headwinds cartoon is one of the most-viewed posts in the history of my blog, though I personally prefer his European lemming cartoon.

Now let’s add some more cartoons to the collection, beginning with a Michael Ramirez gem about Detroit.

Is Obama acting like a dictator with his recent actions regarding the Obamacare Program?

There’s an old joke that the definition of quandary is when your mother-in-law drives off a cliff in your new car.

But since I’m not married, I can’t use that joke.

Besides, I’m a policy wonk, so the type of quandary that catches my attention is when the Obama Administration delays big parts of Obamacare (hooray!), but does so by cavalierly deciding to disregard the law (boo!).

Unfortunately, this isn’t a joke.

I wrote about this topic last month and asserted that one of “the defining characteristics of a civilized government is adherence to the rule of law.”

Why is this important? Here’s some of George Will’s analysis of how Obama is subverting the law.

President Obama’s increasingly grandiose claims for presidential power are inversely proportional to his shriveling presidency. …at last week’s news conference he offered inconvenience as a justification for illegality. …Serving as props in the scripted charade of White House news conferences, journalists did not ask the pertinent question: “Where does the Constitution confer upon presidents the ‘executive authority’ to ignore the separation of powers by revising laws?” The question could have elicited an Obama rarity: brevity. Because there is no such authority.

Will then cites the infamous example of Nixon arguing that, “when the president does it, that means it is not illegal” and compares that to Obama’s lawlessness.

Nixon’s claim, although constitutionally grotesque, was less so than the claim implicit in Obama’s actions regarding the ACA. Nixon’s claim was confined to matters of national security or (he said to Frost) “a threat to internal peace and order of significant magnitude.” Obama’s audacity is more spacious; it encompasses a right to disregard any portion of any law pertaining to any subject at any time when the political “environment” is difficult.

And he also dings Obama for creating – out of thin air – a special handout for members of Congress and their staffs.

…his complicity in effectively rewriting the ACA for the financial advantage of self-dealing members of Congress and their staffs.  …Obama directed the Office of Personnel Management, which has no power to do this, to authorize for the political class special subsidies unavailable for less privileged and less affluent citizens. If the president does it, it’s legal? “Exactly, exactly.”

Charles Krauthammer is equally uncomfortable with the erosion of the rule of law. His column includes a good summary of how Obamacare is being arbitrarily enforced. Or, to be more accurate, how it’s not being enforced.

…the administration…unilaterally waived Obamacare’s cap on a patient’s annual out-of-pocket expenses — a one-year exemption for selected health insurers that is nowhere permitted in the law. It was simply decreed by an obscure Labor Department regulation. Which followed a presidentially directed 70-plus percent subsidy for the insurance premiums paid by congressmen and their personal staffs — under a law that denies subsidies for anyone that well-off. Which came just a month after the administration’s equally lawless suspension of one of the cornerstones of Obamacare: the employer mandate. Which followed hundreds of Obamacare waivers granted by Health and Human Services Secretary Kathleen Sebelius to selected businesses, unions and other well-lobbied, very special interests.

He then accurately explains that we are entering an unpleasant world where the law is not what’s written, but whatever politicians arbitrarily decide on any given day.

The point is whether a president, charged with faithfully executing the laws that Congress enacts, may create, ignore, suspend and/or amend the law at will. …Such gross executive usurpation disdains the Constitution. It mocks the separation of powers. And most consequentially, it introduces a fatal instability into law itself. If the law is not what is plainly written, but is whatever the president and his agents decide, what’s left of the law? The problem is not just uncertain enforcement but the undermining of the very creation of new law. What’s the point of the whole legislative process — of crafting various provisions through give-and-take negotiation — if you cannot rely on the fixity of the final product, on the assurance that the provisions bargained for by both sides will be carried out?

He closes by noting that Obama seems quite proud of his illegal behavior and he warns that America is becoming a banana republic.

…this president is not only untroubled by what he’s doing, but open and rather proud. As he tells cheering crowds on his never-ending campaign-style tours: I am going to do X — and I’m not going to wait for Congress. That’s caudillo talk. That’s banana republic stuff. In this country, the president is required to win the consent of Congress first. At stake is not some constitutional curlicue. At stake is whether the laws are the law. And whether presidents get to write their own.

This is a very troubling issue, so let’s enjoy some gallows humor with some cartoons about Obama’s lawlessness.

Let’s close with a final serious point.

Here’s some of what I wrote a couple of years ago to describe the banana republic of Argentina.

…the problem is crony capitalism. Argentina’s economy, for all intents and purposes, is one giant Fannie Mae/Freddie Mac/Obamacare/General Motors/Goldman Sachs Obamaesque dystopia. Government has enormous influence over every major economic decision. It’s like being in the middle of Atlas Shrugged, as political connections are the way to get rich. This type of approach is far worse than the Scandinavian welfare state. Yes, the official size of government is bigger in places such as Sweden, but the negative role of government intervention is far more pervasive in Argentina.

But I actually understated the problem.

Much of what I wrote was a critique of interventionism and the corruption that is facilitated by big government.

That’s part of what defines a banana republic (with Obamacare being a perfect example), but arbitrary law is another characteristic.

And that’s what’s so worrisome about what the Obama Administration is doing.

The IRS has to make sure all of us abide by Obamacare but they want to be exempt from it!!!!

There are lots of despicable people in Washington engaged in a lot of unsavory behavior, so it would be very difficult to get agreement if you asked regular people to select the most odious feature of the political class.

HypocrisyMany people would probably choose corruption as the defining characteristic of Washington, and it would be hard to argue with that choice, but I think hypocrisy is an even better choice.

There’s something fundamentally wrong when people push for policies while making sure they don’t have to abide by the results. Yet it happens all the time in government.

1. It galls me that the pro-tax bureaucrats at the OECD get tax-free salaries while pushing for higher taxes on everyone else.

2. Or how about rich left wingers who bleat about compassion but who are stingy with their own money.

3. And the wealthy leftists who use tax havens while trying to deny others from protecting their money.

4. There are members of the Washington elite who don’t have to live under the gun control laws they impose on others.

5. What about the politically connected business types who endorse higher taxes in exchange for favors from Washington.

6. Or the politicians who evade the taxes they impose on ordinary citizens.

7. How about Canadian politicians who support government-run healthcare but then come to America when they need treatment.

8. To close this list on a humorous note, we also have Occupy Wall Street protesters who fight “The Man” while wanting to make “The Man” more powerful.

But if you want a really powerful example of hypocrisy, nothing stands out more than politicians trying to exempt themselves from Obamacare.

Crocodile TearsThey’ve even been complaining that the law is so bad that they may quit their jobs. And they’re so disconnected from reality that they think we’ll be upset at the loss of their “seniority” and “experience” – as if taxpayers value their ability to squander money.

But it’s not just politicians who are being hypocritical. The bureaucrats at the IRS also don’t want to live under Obamacare – even though they’re the ones who will be forcing us to live under that misguided law!

Here are some excerpts from a report in the Washington Examiner.

IRS employees have a prominent role in Obamacare, but their union wants no part of the law. National Treasury Employees Union officials are urging members to write their congressional representatives in opposition to receiving coverage through President Obama’s health care law. …Like most other federal workers, IRS employees currently get their health insurance through the Federal Employees Health Benefits Program, which also covers members of Congress. House Ways and Means Committee Chairman Dave Camp offered the bill in response to reports of congressional negotiations that would exempt lawmakers and their staff from Obamacare. …Camp spokeswoman Allie Walker said. “If the Obamacare exchanges are good enough for the hardworking Americans and small businesses the law claims to help, then they should be good enough for the president, vice president, Congress and federal employees,” she also said.

To augment the remarks of Rep. Camp’s spokeswoman, it also would be good to somehow figure out a way to make the lobbyists and other Washington insiders participate in the Obamacare exchanges.

There aren’t many “sure things” in life, but one of them is that Obamacare would be repealed almost instantaneously if the bigwigs in Washington actually had to live under the law designed for peasants like you and me.

Unfortunately, that’s why Congressman Camp’s legislation will never get approved.

Obamacare will self-destruct!!!!

We have a very interesting question from a reader in Nebraska. Is Obamacare such a cluster-you-know-what that the law will self-destruct?

Well, I’ve already explained why I’m optimistic about the possibility of turning Obamacare lemons into free-market lemonade.

Simply stated, the law took a healthcare system that already was a mess because of government intervention and subsidies and it doubled down on that misguided approach!

And since it’s highly unlikely that more government is the solution to problems created by government in the first place, I think we’ll have great fun being able to highlight all the bad consequences of Obamacare and make a principled case for pro-market reform (meaning not only Medicaid reform and Medicare reform, but also tax reform to help deal with the third-party payer crisis).

That being said, I don’t think Obamacare will collapse on its own. We’re going to have to give it a push. A big push.

This is because legislation will be required to undo all the taxes and subsidies in the law. And even though we have the bizarre situation of the Obama Administration deciding to deliberately ignore a legal requirement to impose an employer mandate beginning in 2014, we’ll also need legislation to undo both the individual and the employer mandate.

In other words, the fact that the law won’t achieve any of its goals (such as lower costs and universal insurance coverage) won’t cause the bad policy to disappear.

But it will make the law even more unpopular – particularly if we do our job.

That’s why we should relentlessly highlight examples of wasteful Obamacare spending. The Washington Post, for instance, is reporting on “the extreme measures states are taking to get young people signed up for Obamacare programs.”

And when even the Washington Post thinks politicians and bureaucrats are going above and beyond in their efforts to waste money, you know it’s something especially foolish. But when you’re trying to trick young people into signing up for insurance policies designed to subsidize richer seniors, you don’t really have much choice.

Oregon might do branded coffee cups, for example, whereas Seattle is looking at doing outreach at music festivals. It only makes sense, then, that Kentucky would be doing outreach at multiple bourbon festivals across the state.

From a big picture perspective, this type of waste in just a penny or two on the dollar, but it’s very symbolic of a law that is poorly designed and unworkable.

I also think political cartoonists are very helpful allies since they’re so effective at illustrating some of the worst parts of Obamacare. So let’s wrap up this post with a new batch of cartoons.

We’ll start with a couple that skirt the edge of appropriateness by playing off the recent airline crash in San Francisco. The first one is by Steve Breen.

One final warning. We’re not guaranteed of victory simply because Obamacare is leading to bad results. The statists are going to try and seize control of the narrative by asserting that the higher costs and greater inefficiencies could be fixed by squandering more money in the short run and imposing a single-payer system in the long run.

That’s a very perverse example of Mitchell’s Law and it surely doesn’t make sense to normal people. But it’s an approach that plays to the worst instincts of politicians, many of who will grab any excuse to increase the size and scope of Washington.

One of history’s worst butchers, Josef Stalin, is rumored to have said that, “The death of one man is a tragedy, the death of millions is a statistic.”

Sadly, there’s probably some truth in that statement.

I’ve shared a bunch of horror stories about the U.K.’s government-run healthcare system (see hereherehereherehere,hereherehereherehereherehereherehere and here) and I challenge you to read them without feeling some mix of anger, sadness, despair, and disgust.

Now read these passages from a story earlier this year in the UK-based Daily Mail.

As many as 1,165 people starved to death in NHS hospitals over the past four years… According to figures released by the Office for National Statistics following a Freedom of Information request, for every patient who dies from malnutrition, four more have dehydration mentioned on their death certificate. …In 2011, 43 patients starved to death and 291 died in a state of severe malnutrition, while the number of patients discharged from hospital suffering from malnutrition doubled to 5,558. …NHS hospitals have also stood accused of fiddling figures to mask the numbers of patients dying needlessly.

Without names, faces, and specific details, it’s easy to read the words, shrug your shoulders, and remain emotionally detached.

“I’m Josef Stalin and I approve government-run healthcare”

But there’s probably a gripping and tragic story for every one of those 1,165 people who died, as well as the 5,558 people who suffered from malnutrition.

You’re probably wondering whether the doctors and nurses in the United Kingdom are especially incompetent and/or inhumane. That may be true, but these nauseating statistics also are the result of a deliberate government policy to hasten death. If you think I’m kidding, read this story about children being put on the “Liverpool Care Pathway.” But only if you have a strong stomach.

Makes you wonder what Paul Krugman was thinking when he asserted that, “In Britain, the government itself runs the hospitals and employs the doctors. We’ve all heard scare stories about how that works in practice; these stories are false.”

By the way, I’m not implying that the American health care system is the ideal approach. Our system is grossly inefficient and wasteful thanks to government-caused third-party payer.

But with Obamacare being implemented, including the IPAB “death panels,”maybe we’ll have the worst of both worlds. The inefficiency and expense of American-style third-party payer and the clinical cruelty of British-style single-payer.

Obamacare will grow government like nothing ever has in our country’s history!!!

If you to cut the size of government then you don’t add a program like Obamacare. It will grow government like nothing ever has in American history.

The political elitists in Washington are worried that the American people are lukewarm – or even downright hostile – about Obamacare.

You can imagine two of them having a conversation, with the first saying, “Don’t these stupid peasants realize we’re giving them stuff?!?” and the second responding “We need the riff-raff in flyover country to feel grateful so they’re more likely to vote in favor of continued dependency!”

It never occurs to them that maybe, just maybe, people value freedom. Or, even if they don’t care about liberty, perhaps they object to the fact that government costs a lot and delivers very little. Nobody likes paying for a steak and getting a hamburger, after all.

But the statists think it’s just a matter of messaging, and this mindset is even seen in news coverage.

Here’s some of what Politico wrote today.

Obamacare MessagingThe Obama administration and its health-law allies are gearing up this summer to slice through three years of confusion and opposition to Obamacare. They’ve got their work cut out for them. Obamacare won’t have a shot at success unless millions of people sign up for insurance — the healthy as well as the sick. …Organizing for Action, spun off from President Barack Obama’s campaign operation, went up with a seven-figure TV ad buy in June, touting the new benefits and promising to offer “the truth” about the law. Enroll America, a nonprofit group with ties to the White House, wants to leverage the grass roots across the country and engage big-name celebrities for the cause.

To put it mildly, they have their work cut out for them.

Thanks to absurd regulations and mandates that prevent the insurance market from working properly, young people and healthy people will have to pay far more than the market rate to obtain insurance.

Needless to say, not that many people will be dumb enough to take that deal, regardless of how many empty-headed Hollywood millionaires take part in a PR campaign telling them it’s the “cool” thing to do.

Especially when another brainless part of Obamacare basically allows people to wait until they get sick and then get insurance. If you’re wondering how that will work, just imagine how auto insurance would work if you could wait until after your DUI accident to get a policy – and you got subsidized by all the responsible drivers!

Obamacare defenders may delude themselves into believing that the mandate will work, but the penalty for noncompliance (oops, apologies Chief Justice Roberts, I meant the “tax” for noncompliance) is a lot less than the cost of an insurance policy.

And I don’t think the American people will be pleased when the army of new IRS agents starts harassing them to sign up for a bad deal.

It’s almost enough to make me feel sorry for the hacks at OFA and elsewhere who are trying to sell this lemon.

Simply stated, it doesn’t matter how much lipstick you put on a pig.

For what it’s worth, some of us were predicting runaway costs even before the legislation was enacted.

Though I imagine she thinks we just need some clever messaging so we understand why it’s okay that bad things are happening to childrenretirees, and low-income workers.

Open letter to President Obama (Part 331)

Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

There is a better way to lower healthcare costs and it is not by a government takeover of healthcare.

When I travel, particularly overseas, I run into a lot of people who are totally confused about the American healthcare system.

For all intents and purposes, they think the United States relies on the free market and that government (at least in the pre-Obamacare era) was largely absent.

So they are baffled when I tell them that nearly one-half of all health expenditures in America are directly financed by taxpayers  and that the supposedly private part of our healthcare system is massively distorted by government interference and intervention.

When explaining how government has screwed up private health insurance, I talk about third-party payer and  how genuinely private insurance works for home ownership and automobiles. And I cite examples of genuine free markets for cosmetic surgery and even (regardless of your views) abortion.

But from now on, I think I will simply tell people to watch this superb video from Reason TV.

Oklahoma Doctors vs. Obamacare

Three years ago, Dr. Keith Smith, co-founder and managing partner of the Surgery Center of Oklahoma, took an initiative that would only be considered radical in the health care industry: He posted online a list of prices for 112 common surgical procedures. The 51-year-old Smith, a self-described libertarian, and his business partner, Dr. Steve Lantier, founded the Surgery Center 15 years ago, after they became disillusioned with the way patients were treated at St. Anthony Hospital in Oklahoma City, where the two men worked as anesthesiologists. In 1997, Smith and Lantier bought the shell of a former surgical center with the aim of creating a for-profit facility that could deliver first-rate care at a fraction of what traditional hospitals charge.

The major cause of exploding U.S. heath care costs is the third-party payer system, a text-book concept in which A buys goods or services from B that are paid for by C. Because private insurance companies or the government generally pick up most of the tab for medical services, patients don’t have the normal incentive to seek out value.

The Surgery Center’s consumer-driven model could become increasingly common as Americans look for alternatives to the traditional health care market—an unintended consequence of Obamacare. Patients may have no choice but to look outside the traditional health care industry in the face of higher costs and reduced access to doctors and hospitals.

This shows how a true free market operates. Efficiency and low prices are the norm, and consumers get a good deal.

My only quibble is that the video doesn’t explain how government policies – such as the healthcare exclusion in the tax code – should be blamed for the grotesque waste, inefficiency, and featherbedding in most parts of the medical industry.

But that’s a minor gripe. You should share this post with any and all fuzzy-headed friends and colleagues and tell them this is how smoothly the market would work if the government simply would get out of the way.

And if they want another example, here’s a report from North Carolina on free-market healthcare in action.

If we want this kind of system to be the rule rather than the exception, we need to scrap the healthcare exclusion in the tax code as part of a switch to a simple and fair flat tax. That will help bring some rationality to the health insurance market and address the part of the third-party payer crisis caused by indirect government intervention.

Then we also should reform Medicaid and Medicare to help address the part of the third-party payer crisis caused by the direct government intervention.

P.S. As this poster cleverly illustrates (and as Ronald Reagan correctly warned in the second video of this post), government is the problem, not the solution.
