Is President Obama Correct: Is America No Longer a Christian Nation?

Over the past several years, President Barack Obama has repeatedly claimed that America is not a Christian nation. He asserted that while a U. S. Senator, 1 repeated it as a presidential candidate, 2 and on a recent presidential trip to Turkey announced to the world that Americans “do not consider ourselves a Christian nation.” 3 (He made that announcement in Turkey because he said it was “a location he said he chose to send a clear message.” 4 ) Then preceding a subsequent trip to Egypt, he declared that America was “one of the largest Muslim countries in the world” 5 (even though the federal government’s own statistics show that less than one-percent of Americans are Muslims. 6

The President’s statements were publicized across the world but received little attention in the American media. Had they been carried here, the President might have been surprised to learn that nearly two-thirds of Americans currently consider America to be a Christian nation 7 and therefore certainly might have taken exception with his remarks. But regardless of what today’s Americans might think, it is unquestionable that four previous centuries of American leaders would definitely take umbrage with the President’s statements.

Modern claims that America is not a Christian nation are rarely noticed or refuted today because of the nation’s widespread lack of knowledge about America’s history and foundation. To help provide the missing historical knowledge necessary to combat today’s post-modern revisionism, presented below will be some statements by previous presidents, legislatures, and courts (as well as by current national Jewish spokesmen) about America being a Christian nation. These declarations from all three branches of government are representative of scores of others and therefore comprise only the proverbial “tip of the iceberg.”

The Judicial Branch Affirms that America is a Christian Nation

From the Judicial Branch, consider first some declarations of prominent U. S. Supreme Court Justices regarding America as a Christian nation.

Justice Joseph Story (1779-1845) was appointed to the Court by President James Madison. Story is considered the founder of Harvard Law School and authored the three-volume classic Commentaries on the Constitution of the United States (1833). In his 34 years on the Court, Story authored opinions in 286 cases, of which 269 were reported as the majority opinion or the opinion of the Court 31 and his many contributions to American law have caused him to be called a “Father of American Jurisprudence.” Justice Story openly declared:

One of the beautiful boasts of our municipal jurisprudence is that Christianity is a part of the Common Law. . . . There never has been a period in which the Common Law did not recognize Christianity as lying at its foundations. . . . I verily believe Christianity necessary to the support of civil society. 32

His conclusion about America and Christianity was straightforward:

In [our] republic, there would seem to be a peculiar propriety in viewing the Christian religion as the great basis on which it must rest for its support and permanence. 33

Justice John McLean (1785-1861) was appointed to the Court by President Andrew Jackson. McLean served in the U. S. Congress, as a judge on the Ohio Supreme Court, and then held cabinet positions under two U. S. Presidents. His view on the importance of Christianity to American government and its institutions was unambiguous:

For many years, my hope for the perpetuity of our institutions has rested upon Bible morality and the general dissemination of Christian principles. This is an element which did not exist in the ancient republics. It is a basis on which free governments may be maintained through all time. . . . Free government is not a self-moving machine. . . . Our mission of freedom is not carried out by brute force, by canon law, or any other law except the moral law and those Christian principles which are found in the Scriptures. 34

Justice David Brewer (1837-1910), appointed to the Court by President Benjamin Harrison, agreed. Brewer held several judgeships in Kansas and served on a federal circuit court before his appointment to the Supreme Court. Justice Brewer declared:

We constantly speak of this republic as a Christian nation – in fact, as the leading Christian nation of the world. 35

Brewer then chronicled the types of descriptions applied to nations:

We classify nations in various ways: as, for instance, by their form of government. One is a kingdom, another an empire, and still another a republic. Also by race. Great Britain is an Anglo-Saxon nation, France a Gallio, Germany a Teutonic, Russia a Slav. And still again by religion. One is a Mohammedan nation, others are heathen, and still others are Christian nations. This republic is classified among the Christian nations of the world. It was so formally declared by the Supreme Court of the United States. In the case of Holy Trinity Church vs. United States, 143 U.S. 471, that Court, after mentioning various circumstances, added, “these and many other matters which might be noticed, add a volume of unofficial declarations to the mass of organic utterances that this is a Christian nation.” 36

Brewer did not believe that calling America a Christian nation was a hollow appellation; in fact, he penned an entire book setting forth the evidence that America was a Christian nation. He concluded:

[I] have said enough to show that Christianity came to this country with the first colonists; has been powerfully identified with its rapid development, colonial and national, and today exists as a mighty factor in the life of the republic. This is a Christian nation. . . . [T]he calling of this republic a Christian nation is not a mere pretence, but a recognition of an historical, legal, and social truth. 37

Justice Earl Warren (1891-1974) agreed with his predecessors. Before being appointed as Chief Justice of the U. S. Supreme Court by President Dwight D. Eisenhower, Warren had been the Attorney General of California. Warren declared:

I believe the entire Bill of Rights came into being because of the knowledge our forefathers had of the Bible and their belief in it: freedom of belief, of expression, of assembly, of petition, the dignity of the individual, the sanctity of the home, equal justice under law, and the reservation of powers to the people. . . . I like to believe we are living today in the spirit of the Christian religion. I like also to believe that as long as we do so, no great harm can come to our country. 38

There are many similar declarations by other Supreme Court Justices, but in addition to the declarations of individual judges, the federal courts have repeatedly affirmed America to be a Christian nation – including the U. S. Supreme Court, which declared that America was “a Christian country,” 39filled with “Christian people,” 40 and was indeed “a Christian nation.” 41Dozens of other courts past and present have repeated these pronouncements 42 but so, too, have American Presidents – as in 1947 when President Harry Truman quoted the Supreme Court, declaring:

This is a Christian Nation. More than a half century ago that declaration was written into the decrees of the highest court in this land [in an 1892 decision]. 43

In addition to its “Christian nation” declarations, the Supreme Court also regularly relied on Christian principles as the basis of its rulings on issues such as marriage, citizenship, foreign affairs, and domestic treaties.

For example, when some federal territories attempted to introduce the practice of bigamy and polygamy, the Supreme Court disallowed those practices because:

Bigamy and polygamy are crimes by the laws of all civilized and Christian countries. 44

In another case, the Court similarly explained:

The organization of a community for the spread and practice of polygamy is . . . . contrary to the spirit of Christianity and of the civilization which Christianity has produced in the Western world. 45

And when the issue arose of whether marriages made in foreign nations would be recognized in the United States, the federal court held that foreign marriages would be recognized only if they were not “contrary to the general view of Christendom.” 46

The Supreme Court also decided military service issues in accord with Christian principles and standards. For example, in 1931, when a Canadian immigrant refused to take the oath of allegiance to the United States, the Supreme Court explained why he was therefore excluded from citizenship:

We are a Christian people (Holy Trinity Church v. United States. 143 U.S. 457, 470 , 471 S., 12 S. Ct. 511), according to one another the equal right of religious freedom and acknowledging with reverence the duty of obedience to the will of God. But also we are a nation with the duty to survive; a nation whose Constitution contemplates war as well as peace; whose government must go forward upon the assumption (and safely can proceed upon no other) that unqualified allegiance to the nation and submission and obedience to the laws of the land, as well those made for war as those made for peace, are not inconsistent with the will of God. 47

The Supreme Court also relied on Christian principles in its rulings on international policies. For example, if an American citizen living in a foreign land was accused of a crime under the laws of a fundamentally different nation (such as in Islamic nations, secular nations, and most recently in Japan following World War II), by means of international treaties, the U. S. citizen would be tried in front of the U. S. Consul in that nation (in what were called Consular Tribunals) rather than before the courts of that country. Of this practice, the Supreme Court explained:

In other than Christian countries, they [the Consuls] were by treaty stipulations usually clothed with authority to hear complaints against their countrymen and to sit in judgment upon them when charged with public offenses. . . . The intense hostility of the people of Moslem faith to all other sects, and particularly to Christians, affected all their intercourse [transactions] and all proceedings had in their tribunals. Even the rules of evidence adopted by them [the Muslims] placed those of different faith on unequal grounds in any controversy with them. For this cause, and by reason of the barbarous and cruel punishments inflicted in those countries and the frequent use of torture to enforce confession from parties accused, it was a matter of deep interest to Christian governments to withdraw the trial of their subjects, when charged with the commission of a public offense, from the arbitrary and despotic action of the local officials. Treaties conferring such jurisdiction upon these consuls were essential to the peaceful residence of Christians within those countries. 48

For example, an Islamic nation might charge an American with the capital-offense crime of blasphemy merely because the American attended Christian worship or used a Bible in that country; or a secular nation might accuse an American of the crime of proselytizing simply for sharing his faith with another (currently a crime in France, 49 across India, 50 Pakistan,51 Saudi Arabia, 52 Malaysia, 53 and many other nations). In such cases, the Consul tried the offense under America’s laws as a Christian nation. However, if another nation accused an American of a crime such as murder, the charge would stand since murder was also a crime in our Christian nation. 54

The Supreme Court commended this position 55 and federal courts observed the policy until deep into the twentieth century, 56 when many foreign nations finally began to adopt what the Supreme Court had earlier called “a system of judicial procedure like that of Christian countries.” 57

Federal domestic treaties were yet another area in which the federal judiciary relied on Christian principles and standards. For example, by 1877 a number of disputes had arisen in which Indian lands were wrongly being taken for timber, minerals, and other resources. When those cases reached the Supreme Court, the Court affirmed the occupancy rights of the tribes to the lands because:

It is to be presumed that in this matter the United States would be governed by such considerations of justice as would control a Christian people . . . 58

The Court repeated this position on numerous subsequent occasions – as in 1903 when it reiterated:

[I]n decisions of this court, the Indian right of occupancy of tribal lands, whether declared in a treaty or otherwise created, has been stated to be sacred. . . . Thus. . . . “It is to be presumed that in this matter the United States would be governed by such considerations of justice as would control a Christian people . . . ” 59

The Court’s position was subsequently enacted into federal statutory law in 1906, 60 and in 1955, the Supreme Court was still praising this position 61 – a position regularly cited by other courts for decades, 62 including in the late 1990s. 63

These are just a few examples of the literally hundreds of similar cases at both federal and state levels affirming that America is indeed a Christian nation.

The U. S. Congress Affirms that America is a Christian Nation

Declarations from the Legislative Branch affirming America as a Christian nation are abundant. For example, in 1852-1853 when some citizens sought a complete secularization of the public square and a cessation of all religious activities by the government, Congress responded with unambiguous declarations about America as a Christian nation:

HOUSE JUDICIARY COMMITTEE: Had the people, during the Revolution, had a suspicion of any attempt to war against Christianity, that Revolution would have been strangled in its cradle. At the time of the adoption of the Constitution and the amendments, the universal sentiment was that Christianity should be encouraged, not any one sect [denomination]. Any attempt to level and discard all religion would have been viewed with universal indignation. . . . In this age there can be no substitute for Christianity; that, in its general principles, is the great conservative element on which we must rely for the purity and permanence of free institutions. 24

SENATE JUDICIARY COMMITTEE: We are Christians, not because the law demands it, not to gain exclusive benefits or to avoid legal disabilities, but from choice and education; and in a land thus universally Christian, what is to be expected, what desired, but that we shall pay a due regard to Christianity? 25

In 1856, the House of Representatives also declared:

[T]he great vital and conservative element in our system is the belief of our people in the pure doctrines and divine truths of the Gospel of Jesus Christ. 26

On March 3, 1863 while in the midst of the Civil War, the U. S. Senate requested President Abraham Lincoln to “designate and set apart a day for national prayer and humiliation” 27 because:

[S]incerely believing that no people, however great in numbers and resources or however strong in the justice of their cause, can prosper without His favor; and at the same time deploring the national offences which have provoked His righteous judgment, yet encouraged in this day of trouble by the assurances of His word to seek Him for succor according to His appointed way through Jesus Christ, the Senate of the United States do hereby request the President of the United States, by his proclamation, to designate and set apart a day for national prayer and humiliation. 28(emphasis added)

President Lincoln quickly complied with that request, 29 and issued what today has become one of the most famous and quoted proclamations in America’s history. 30

Across the generations, our national reliance on God, the Bible, and Christianity has been repeatedly reaffirmed. In fact, consider five representative images produced by the U. S. Government. The first three are from World War II: one shows the Nazis as the enemy because they want to attack the Bible, and the other two encourage Americans to buy War Bonds by pointing to Christian images. The fourth and fifth images are from the Department of Agriculture in the 1960s, using the Bible and even Smokey Bear in prayer as symbols to encourage Americans to be conscious of fire safety and to help preserve and conserve nature.

The general principles on which the fathers achieved independence were. . . . the general principles of Christianity. 13JOHN ADAMS

[T]he teachings of the Bible are so interwoven and entwined with our whole civic and social life that it would be literally….impossible for us to figure to ourselves what that life would be if these teaching were removed. 14 TEDDY ROOSEVELT

America was born a Christian nation – America was born to exemplify that devotion to the elements of righteousness which are derived from the revelations of Holy Scripture. 15WOODROW WILSON

American life is builded, and can alone survive, upon . . . [the] fundamental philosophy announced by the Savior nineteen centuries ago. 16 HERBERT HOOVER

This is a Christian Nation. 17 HARRY TRUMAN

Let us remember that as a Christian nation . . . we have a charge and a destiny. 18 RICHARD NIXON

There are many additional examples, including even that of Thomas Jefferson.

Significantly, Jefferson was instrumental in establishing weekly Sunday worship services at the U. S. Capitol (a practice that continued through the 19th century) and was himself a regular and faithful attendant at those church services, 19 not even allowing inclement weather to dissuade his weekly horseback travel to the Capitol church. 20

(The fact that the U. S. Capitol building was available for church on Sundays was due to the Art. I, Sec. 7 constitutional requirement that forbade federal lawmaking on Sundays; and this recognition of a Christian Sabbath in the U. S. Constitution was cited by federal courts as proof of the Christian nature of America. 21 While not every Christian observes a Sunday Sabbath, no other religion in the world honors Sunday except Christianity. As one court noted, the various Sabbaths were “the Friday of the Mohammedan, the Saturday of the Israelite, or the Sunday of the Christian.” 22 )

Why was Jefferson a faithful attendant at the Sunday church at the Capitol? He once explained to a friend while they were walking to church together:

No nation has ever existed or been governed without religion. Nor can be. The Christian religion is the best religion that has been given to man and I, as Chief Magistrate of this nation, am bound to give it the sanction of my example. 23

President Jefferson even closed presidential documents with “In the year of our Lord Christ” (see below).

Even President Jefferson recognized and treated America as a Christian nation. Clearly, President Obama’s declaration is refuted both by history and by his own presidential predecessors.

Is President Obama Correct: Is America No Longer a Christian Nation?

Over the past several years, President Barack Obama has repeatedly claimed that America is not a Christian nation. He asserted that while a U. S. Senator, 1 repeated it as a presidential candidate, 2 and on a recent presidential trip to Turkey announced to the world that Americans “do not consider ourselves a Christian nation.” 3 (He made that announcement in Turkey because he said it was “a location he said he chose to send a clear message.” 4 ) Then preceding a subsequent trip to Egypt, he declared that America was “one of the largest Muslim countries in the world” 5 (even though the federal government’s own statistics show that less than one-percent of Americans are Muslims. 6

The President’s statements were publicized across the world but received little attention in the American media. Had they been carried here, the President might have been surprised to learn that nearly two-thirds of Americans currently consider America to be a Christian nation 7 and therefore certainly might have taken exception with his remarks. But regardless of what today’s Americans might think, it is unquestionable that four previous centuries of American leaders would definitely take umbrage with the President’s statements.

Modern claims that America is not a Christian nation are rarely noticed or refuted today because of the nation’s widespread lack of knowledge about America’s history and foundation. To help provide the missing historical knowledge necessary to combat today’s post-modern revisionism, presented below will be some statements by previous presidents, legislatures, and courts (as well as by current national Jewish spokesmen) about America being a Christian nation. These declarations from all three branches of government are representative of scores of others and therefore comprise only the proverbial “tip of the iceberg.”

Defining a Christian Nation

Contemporary post-modern critics (including President Obama) who assert that America is not a Christian nation always refrain from offering any definition of what the term “Christian nation” means. So what is an accurate definition of that term as demonstrated by the American experience?

Contrary to what critics imply, a Christian nation is not one in which all citizens are Christians, or the laws require everyone to adhere to Christian theology, or all leaders are Christians, or any other such superficial measurement. As Supreme Court Justice David Brewer (1837-1910) explained:

[I]n what sense can [America] be called a Christian nation? Not in the sense that Christianity is the established religion or that the people are in any manner compelled to support it. On the contrary, the Constitution specifically provides that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” Neither is it Christian in the sense that all its citizens are either in fact or name Christians. On the contrary, all religions have free scope within our borders. Numbers of our people profess other religions, and many reject all. Nor is it Christian in the sense that a profession of Christianity is a condition of holding office or otherwise engaging in public service, or essential to recognition either politically or socially. In fact, the government as a legal organization is independent of all religions. Nevertheless, we constantly speak of this republic as a Christian nation – in fact, as the leading Christian nation of the world. 8

So, if being a Christian nation is not based on any of the above criterion, then what makes America a Christian nation? According to Justice Brewer, America was “of all the nations in the world . . . most justly called a Christian nation” because Christianity “has so largely shaped and molded it.” 9

Constitutional law professor Edward Mansfield (1801-1880) similarly acknowledged:

In every country, the morals of a people – whatever they may be – take their form and spirit from their religion. For example, the marriage of brothers and sisters was permitted among the Egyptians because such had been the precedent set by their gods, Isis and Osiris. So, too, the classic nations celebrated the drunken rites of Bacchus. Thus, too, the Turk has become lazy and inert because dependent upon Fate, as taught by the Koran. And when in recent times there arose a nation [i.e., France] whose philosophers [e.g. Voltaire, Rousseau, Diderot, Helvetius, etc.] discovered there was no God and no religion, the nation was thrown into that dismal case in which there was no law and no morals. . . . In the United States, Christianity is the original, spontaneous, and national religion. 10

Founding Father and U. S. Supreme Court Chief Justice John Marshall agreed:

[W]ith us, Christianity and religion are identified. It would be strange, indeed, if with such a people our institutions did not presuppose Christianity and did not often refer to it and exhibit relations with it. 11

Christianity is the religion that shaped America and made her what she is today. In fact, historically speaking, it can be irrefutably demonstrated that Biblical Christianity in America produced many of the cherished traditions still enjoyed today, including:

  • A republican rather than a theocratic form of government;
  • The institutional separation of church and state (as opposed to today’s enforced institutional secularization of church and state);
  • Protection for religious toleration and the rights of conscience;
  • A distinction between theology and behavior, thus allowing the incorporation into public policy of religious principles that promote good behavior but which do not enforce theological tenets (examples of this would include religious teachings such as the Good Samaritan, The Golden Rule, the Ten Commandments, the Sermon on the Mount, etc., all of which promote positive civil behavior but do not impose ecclesiastical rites); and
  • A free-market approach to religion, thus ensuring religious diversity.

Consequently, a Christian nation as demonstrated by the American experience is a nation founded upon Christian and Biblical principles, whose values, society, and institutions have largely been shaped by those principles. This definition was reaffirmed by American legal scholars and historians for generations 12 but is widely ignored by today’s revisionists.

The Founders believed national leaders should believe in a God that will punish evil

Roger Ebert called this flick one of Allen’s best. The director, pictured with cinematographer Sven Nykvist on set, was nominated for three Academy Awards, including best director and writing. “Who else but Woody Allen could make a movie in which virtue is punished, evildoing is rewarded and there is a lot of laughter – even subversive laughter at the most shocking times?” wrote the famous reviewer.

The founding fathers believed that it benefitted the government for it’s leaders to believe in God and with that would come the view that evil will be punished and good will be rewarded in the afterlife. John Quincy Adams said: There are three points of doctrine the belief of which forms the foundation of all morality. The first is the existence of God; the second is the immortality of the human soul; and the third is a future state of rewards and punishments. Suppose it possible for a man to disbelieve either of these three articles of faith and that man will have no conscience,

This point of view is not held by many today. I noticed in Woody Allen’s film “Crimes and Misdemeanors” you can see how Allen’s agnostic worldview permits him to allow the lead character to have his mistress killed when she threatens to call the cops. Judah noted, “God is a luxery I can not afford.” Earlier in the film Judah is terrified when he thinks there is a living God that will punish him in an afterlife, but only after he convinces himself there is no God is he at peace with his decision to have this troublesome lady killed. Check out this movie on Netflix and you will see what I mean about this potential moral problem that atheists can not answer. (I have looked this question many times in my previous posts.)

David Barton is a Christian historian and he has quoted many of the founders concerning their views of the afterlife and how their views impact what is done while leading the nation:

Did David Barton fabricate quotes and attribute them to the founding fathers? NO HE DIDN’T!

On the Arkansas Times Blog on June 17, 2012 I noted:

Google the phrase ” David Barton fabricated quotes” and you will get many websites that claim this is true and Rob Boston’s 1996 article “consumer alert” in the Church and State Magazine is what prompted this reaction throughout the country. As a journalist you would think people like Max would call Boston out on this. An apology should have been issued by Boston years ago.

Hopefully today when you google that phrase you will be taken to my website, www.thedailyhatch.org, and you will not have to read all those lies that were prompted by Rob Boston about David Barton.

If you go to http://www.youtube.com and type in “Rob Boston Fake Quotes” you will get a 6 min, 47 sec clip with Rob Boston being interview on February 10, 2010 on Countdown with Keith Olbermann. The origin of this “fake quote scandal” was my 1996 encounter with Rob Boston. Looking back I think it was my trusting nature that got me in trouble.  (I should have known that Boston could be quite rude at times and that should tipped me off to a character flaw.)

It all started because I was involved in a series of correspondence with  Boston who is the senior policy analyst at the Americans United for the Separation of Church and State (AU) and a board member of the American Humanist Society.

(Portions of this below appeared in an article I did for the Freedom Writer in May/June 1997 issue which is a publication friendly to Boston and not to me but they felt the record should be set straight concerning the misleading article that Boston had written in 1996 in Church & State titled “Consumer Alert.”.)

Let me start from the very beginning. As an evangelical Christian and a member of the Christian Coalition, I felt obliged to expose a misquote of John Adams’ I found in an article entitled “America’s Unchristian Beginnings” (Los Angeles Times, August 3, 1995, p.B-9) by the self-avowed atheist Dr. Steven Morris. However, what happened next changed my focus to the use of misquotes, unconfirmed quotes, and misleading attributions by the religious right.

In the process of attempting to correct Morris, I was guilty of using several misquotes myself. Dr John George  coauthor (with Paul Boller Jr.) of the book They Never Said It! (Oxford University Press, 1989) set me straight. George pointed out that George Washington never said, “It is impossible to rightly govern the world without God and the Bible.” (They Never Said It! pp. 126-127). I had cited page 18 of the 1927 edition of Halley’s Bible Handbook. This quote was probably generated by a similar statement that appears in A Life of Washington (New York: Harper and Brothers, 1835) by James Paulding. Sadly, no one has been able to verify any of the quotes in Paulding’s book since no footnotes were offered.

After reading They Never Said It! I had a better understanding of how widespread the problem of misquotes is. Furthermore, I discovered that many of these had been used by the leaders of the religious right. I decided to confront some individuals concerning their misquotes. WallBuilders, the publisher of David Barton’s The Myth of Separation (published in 1989), helped me further by providing me with their “Questionable Quote” list. The list contained a dozen quotes of the founders that Barton could only confirm with secondary sources.

Proverbs 19:25 states, “…rebuke a discerning man, and he will gain knowledge.” Since I was rebuking fellow Christians, I felt certain they would all gladly quit using unconfirmed or questionable quotes. The religious right leaders I contacted had three different responses.

The first was the reaction that I expected. Several thanked me for bringing these corrections to their attention. They agreed that it is wrong to use disputed quotes as if they were authentic.

The second, which was the most common response, was to claim that their critics were biased skeptics who find the truth offensive. The premise of this argument is, “We know our critics are 100% wrong all the time, so who cares what they have to say anyway. We are the only unbiased ones.”

And the third response was from one who defended his method of research and his method of confirming sources. Furthermore, he said that he pursued his graduate education in order to improve his level of scholarship. Nevertheless, that respondent never provided me with his original sources.

There are some misquotes used commonly by separationists, but evidently the religious right has a much more widespread problem. One illustration demonstrates just how widespread the problem is among religious right lay historians. When David Barton wrote The Myth of Separation he used many secondary sources for the 500 quotes that appeared in his book published in 1989. After an effort to find primary sources for these quotes, Barton complied the “Questionable Quote” list with the 12 quotes that could only had confirmation through secondary sources. None of these questionable quotes originated with Barton.

After confronting over thirty religious right authors, I turned my attention to individuals from the separationist point of view. During this time I provided Rob Boston, of Americans United, with the “questionable quote” list in the hope that he would confront some individuals on his  side of the ideological fence. I even included my correspondence from several religious right leaders such as the late D. James Kennedy. Nevertheless, based upon the “Questionable Quote” list that I provided to him, Boston wrote the slanted article for Church & State titled “Consumer Alert.” (July /August 1996). In this article he implies that Barton made up the dozen quotes on the “Questionable Quote” list.

In “Consumer Alert,” these words appeared in bold print: “Mything in action: David Barton’s ‘Questionable Quotes.'” Barton was called a “double fraud.” 

Professor Fritz Detweiler of Adrian College’s religion and philosophy department responded to this controversy in his weekly column stating that Barton “made up quotes and attributed them to James Madison, Patrick Henry, George Washington, Benjamin Franklin, and other leading Americans…. Barton’s fabricating quotes to serve his purpose is particularly disturbing on two fronts. First, Barton was not content to let the record speak for itself because it didn’t say quite what he wanted it to say. Second, the fraudulent construction of quotes poses a particular problem for [historians] seeking to verify their accuracy.”

In response to that article, David Barton wrote in WallBuilders‘ summer 1996 newsletter that “the article,  “Consumer Alert”‘ is agenda driven. Our honest efforts to clear the ‘world’s rhetorical rivers,’ as we casually stated in the earlier draft, were twisted and misconstrued to sound as if we created the quotes… We regret that the unconfirmed quotations have been circulated over the last century-and-a-half, and WallBuilders acknowledges the errors of using secondary sources for primary historical figures. (These quotes have been purged from our materials wherever possible.) David Barton went on to make clear that his current level of scholarship as of the early 1990’s was not to use founders quotes unless they are documented by a primary source.

I had the opportunity to talk to Rob Boston on the phone about this on November 19, 1996. I told him that people all across this country have been writing letters to the editor of their local newspapers blasting David Barton because of Boston’s article and many more have been posting articles on the internet.) Boston said he was very glad people were on to Barton.

Then I pointed out to Boston that many of these people were accusing Barton of knowingly using bad quotes. Furthermore, one individual accused Barton of “creating quotes.” These people could be sued for libel. Boston replied, “No malice can be proved. I don’t know much about law, but I at least know that much.” Shortly after that Boston hung up on me, but not before he claimed “poetic license” and said he was glad that Barton’s reputation had been damaged. (Blair Scott, Alabama State Director, American Atheists, Inc. has since claimed, “David Barton was cornered and he admitted to fabricating the quotes, okay he actually called them “spurious,” but we all know that means he made them up.”)

Later I got several board members of Americans United to contact Boston on my behalf and voice their opinion of how unfair Boston had been to Barton in his article  “Consumer Alert”. On March 7, 1997, I spoke with Barry Lynn the executive director of Americans United. Lynn was very gracious on the phone and  promised to consider an article from me in response to the slanted  “Consumer Alert” article Boston had written earlier. Americans United board member Dr. Paul Simmons of Louisville helped me write the aritcle, but ultimately it was never published.

The real scandal is that this same lie caused by Boston’s article about Barton is still today being spread throughout the world on youtube and on TV. On Feb 10, 2010 on MSNBC’s show Countdown with Keith Olberman, Rob Boston was the guest and Olberman opened the show with these words:

“What happens if you want your audience to believe that the the founding fathers did not want the separation of church and state when obviously and clearly and repeatedly they did. Well you make up quotes defending your position and dishonestly attribute them to the likes of James Madison and Thomas Jefferson… More on Mr Barton and those quotes in a moment.”

Then Olbermann and Boston go on to criticize  Barton throughout the remainder of the program. However, in this interview Boston never says that Barton manufactured quotes, but he doesn’t stop Olbermann from telling the same old lie about Barton that came from this 1996 scandal. Boston knew that his article  “Consumer Alert” from 1996 was responsible for Olbermann’s inaccurate words about Barton, but Boston didn’t lift a finger to set the record straight. In 2009 Boston finally admitted concerning Barton “Unconfirmed Quote List”: “He didn’t make the stuff up, he just relied on bad sources.” Boston should have admitted this in 1996 and apologized and then tried to correct the record anytime he saw it on the internet.

Furthermore this youtube video clip has received over 75,000 hits. The clip was put on youtube by a person going by the username “JesusSavesAtCitibank” whoever that is. If you click on the username you will be provided several links to articles. The first link will bring you to Boston’s 1996 article  “Consumer Alert”.

David Barton has tried to raise the level of scholarship in the debate concerning the founders by committing to use only quotes that have been confirmed by primary sources. Dr. John George has commented, “While not agreeing with Barton concerning separation of church and state, I must say he has done everyone a service by circulating the ‘Questionable Quote List.’ Especially gratifying is his encouraging those in his own Religious Right camp to cite only primary sources for the quotes they utilize. Unfortunately, a sizable minority will ignore the advice.”

Many separationists like Dr. George praised Barton for challenging others to a higher level of scholarship concerning these unconfirmed quotes. Instead, of complimenting Barton when I provided this information to Boston in 1996, he chose to imply that Barton was guilty of making up quotes.

Now Barton is being attacked on the Arkansas Times Blog June 15, 2012 by the username “Deathbyinches”for making up quotes and attributing them to the founders and another blogger even provided a link to the People for the American Way website which includes many criticisms of Barton concerning these quotes. Last year when Barton was scheduled to come hold a seminar for state legislators and constitutional officers on Jan 25 and 26 in Little Rock,one liberal media person (Max Brantley) in Arkansas associated with Americans United had called him the “bogus Texas historian.” That is when I knew I had to set the record straight concerning Rob Boston’s fake quote youtube clip.

I read back on Dec 8, 2011 that Tony Perkins, president of Family Research Council, a social conservative advocacy organization, said in 2011 that President Obama has been “hostile” and “disdainful” toward Christianity. Rick Perry actually said President Obama had a war on religion. One of the most basic things that our founding fathers did is base our laws on the ten commandments. At the Supreme Court there is one depiction showing Moses sitting, holding two blank stone tablets. There is one depiction showing Moses standing holding one stone tablet. There are two stone tablets depicted with Roman Numbers I-X carved in the oak doors.

Do not murder.

56. The next several commands form much of the heart of our criminal laws, and, as noted by Noah Webster, one of the first founders to call for the Constitutional Convention, the divine law is the original source of several of those criminal laws:

The opinion that human reason left without the constant control of Divine laws and commands will . . . give duration to a popular government is as chimerical as the most extravagant ideas that enter the head of a maniac. . . . Where will you find any code of laws among civilized men in which the commands and prohibitions are not founded on Christian principles? I need not specify the prohibition of murder, robbery, theft, [and] trespass.

57. The early civil laws against murder substantiate the influence of the Decalogue and divine laws on American criminal laws. For example, a 1641 Massachusetts law declared:

4. Ex. 21.12, Numb. 35.13, 14, 30, 31. If any person commit any willful murder, which is manslaughter committed upon premeditated malice, hatred, or cruelty, not in a man’s necessary and just defense nor by mere casualty against his will, he shall be put to death.

5. Numb. 25.20, 21. Lev. 24.17. If any person slayeth another suddenly in his anger or cruelty of passion, he shall be put to death.

6. Ex. 21.14. If any person shall slay another through guile, either by poisoning or other such devilish practice, he shall be put to death.

58. Perhaps the point is too obvious to belabor, but similar provisions can be found in the Connecticut laws of 1642, the New Hampshire laws of 1680, etc.

59. Courts, too, have been very candid in tracing civil murder laws back to the Decalogue. For example, a 1932 Kentucky appeals court declared:

The rights of society as well as those of appellant are involved and are also to be protected, and to that end all forms of governments following the promulgation of Moses at Mt. Sinai has required of each and every one of its citizens that “Thou shalt not murder.” If that law is violated, the one guilty of it has no right to demand more than a fair trial, and if, as a result thereof, the severest punishment for the crime is visited upon him, he has no one to blame but himself.

60. Even the “severest punishment for the crime” is traced back to divine laws. As first Chief Justice John Jay explained:

There were several divine, positive ordinances . . . of universal obligation, as . . . the particular punishment for murder.

61. There certainly exist more than sufficient cases with declarations similar to that made by the Kentucky court above to demonstrate that the sixth commandment of the Decalogue exerted substantial force on American civil law and jurisprudence.

52. This fifth command begins the so-called second “tablet” of the Decalogue-the section addressing “civil” behavior that even critics acknowledge to be appropriate for public display. This portion of the Decalogue formed the basis of many of our current criminal laws and modern courts are not reticent to acknowledge and enforce these commandments. As the Supreme Court of Indiana declared in 1974:

Virtually all criminal laws are in one way or another the progeny of Judeo-Christian ethics. We have no intention to overrule the Ten Commandments.

53. Yet the mandates of the Decalogue currently embodied in our criminal laws are no less religiously-based than were the first four commandments. For example, a 1642 Connecticut law addressing the fifth commandment specifically cited both the Decalogue and additional Bible verses as the basis for its civil laws related to honoring parents:

If any child or children above sixteen years old, and of sufficient understanding shall curse or smite their normal father or mother, he or they shall be put to death; unless it can be sufficiently testified that the parents have been very unchristianly negligent in the education of such children, or so provoke them by extreme and cruel correction that they have been forced thereunto to preserve themselves from death [or] maiming. Ex. 21:17, Lev. 20, Ex. 20:15

This law also appears in other State codes as well.

54. Even three centuries after these early legal codes, this commandment was still influencing civil laws-as confirmed in 1934 by a Louisiana appeals court that cited the fifth commandment of the Decalogue as the basis of civil policy between parents and children:

” ˜Honor thy father and thy mother,’ is as much a command of the municipal law as it is a part of the Decalogue, regarded as holy by every Christian people. ˜A child,” says the code, ˜whatever be his age, owes honor and respect to his father and mother.’ “

55. Other courts have made similar declarations, all confirming that the fifth commandment of the Decalogue was an historical part of American civil law and jurisprudence.

Was this country founded by Christians?

I really don’t think we need to be ashamed our Christian origins in this country. Abraham Lincoln wasn’t. In this discussion about the Christian origins of our country Greg Koukl quotes from President Lincoln:

After that you can reflect on Lincoln’s Thanksgiving Proclamation of October 3, 1863. It begins this way: “It is the duty of nations, as well as of men, to own their dependence upon the overruling power of God, to confess their sins and transgressions [By golly, how did that get in there?] in humble sorrow, yet with assured hope that genuine repentance will lead to mercy and pardon. And to recognize the sublime truth announced in the Holy Scriptures and proven by all history, that those nations are blessed whose God is the Lord.”

America’s Unchristian Beginnings?

There has been a lot of confusion on the issue of whether or not we’ re a Christian nation, and I’m not exactly sure why. But it is hotly debated in our culture right now. The reason I say I’m not sure why is because the historical record is quite clear. I think that Christians, though, often make inappropriate, unfounded, or inaccurate applications of some of the information, and I want to speak to that in just a moment.As to the faith content of those who were our Founding Fathers, there can be absolutely no confusion about the fact that virtually every single one of them shared a Christian, biblical world view. There is some question as to whether every single one of them held to all the orthodox teachings of classical Christianity; but it seems to me that there is very little question as to what their religious persuasions and world views were.There was a piece in the L.A. Times on the third of this August on the Op-Ed page entitled “America’s Unchristian Beginnings.” It is subtitled “Founding Fathers: Despite preachings of our pious Right, most were deists who rejected the divinity of Jesus.” There are a couple things that trouble me about this article, the biggest thing is the word “most” in the subtitle. “Most of our Founding Fathers” apparently were deists, according to this person’s assessment. This is a canard that’s been tossed around even by some Christians who ought to know better. This piece was written by Steven Morris who is a professor of physics at L.A. Harbor College and he is also a member of the L.A.-based Atheists United.Some might say, what does a physicist know about history? Just because he is a physicist doesn’t mean that he can’t have an accurate opinion about this particular issue. I take issue with his research. It’ s simply bad.He goes on to reply to the Christian Right, who he says is trying to rewrite the history of the United States in its campaign to force its view of religion on others. His approach is to quote seven different people: Thomas Paine, George Washington, John Adams, Thomas Jefferson, Ethan Allen, James Madison, and Ben Franklin. His point is to quote these individuals who he thinks apparently are, first of all, Founding Fathers, and secondly, characteristic of the lot of them in rejection of Christianity and in acceptance of deism.

I am frustrated by this because it is characteristic of the way a lot of people want to treat this issue. They think that they can take names that we associate with that period and are well known, sift through their writings and find some things that they think are hostile to Christianity, and therefore conclude that not only these people are anti-Christian, but all of the rest of them are anti-Christian, as well.

It’s an example of Steven Morris turning the exception into the rule. Since he can find what he thinks are seven different people that are important personalities during this period of time, who at some time in their lives may have written something that can be understood to be non-Christian, then that characterizes the whole group of them as deists, ergo the subtitle “Most were deists who rejected the divinity of Jesus.”

Morris’ sightings are simply specious. Thomas Payne and Ethan Allen, for example, were in no- wise intellectual architects of the Constitution. Rather, they were firebrands of the Revolution. Was that important? Sure, they made an important contribution, but they weren’t Founding Fathers. Period.

Now, as for Washington, Sam Adams, Jefferson, and Madison. If one looks at the literature of the time–the personal correspondence, the public statements, the biographies–he will find that this literature is replete with quotations by these people contrary to those that Mr. Morris very carefully selected for us. Apparently, he also very carefully ignored other important thinkers: John Witherspoon, for example, Alexander Hamilton, John Jay, John Adams, Patrick Henry. All individuals who were significant contributors to the architectural framework of this country and who had political philosophies that were deeply influenced by Christianity, especially Calvinism.

But there is another thing that he completely overlooks in this analysis. Something that makes a mockery out of his analysis, and also answers the question quite simply and directly and in the affirmative for us about the Christian beginnings of our Republic.

This issue is actually very simple. The phrase “Founding Fathers” is a proper noun. In other words, Founding Fathers refers directly to a very specific group of people (although I think you could be a little bit flexible and include a little wider group of people). Those who intellectually contributed to the Constitutional convention were the Founding Fathers. If we want to know whether our Founding Fathers were Christian or deists, one needs only to look at the individual religious convictions of those 55 delegates of the Constitutional convention.

How would we know that? We look at their church membership primarily, and also at their correspondence. Back then church membership was a big deal. In other words, to be a member of a church back then, it wasn’t just a matter of sitting in the pew or attending once in a while. This was a time when church membership entailed a sworn public confession of biblical faith, adherence, and acknowledgment of the doctrines of that particular church.

Of those 55 Founding Fathers, we know what their sworn public confessions were. Twenty-eight were Episcopalians, eight were Presbyterians, seven were Congregationalists, two were Lutheran, two were Dutch Reformed, two were Methodist, two were Roman Catholic, one is unknown, and only three were deists–Williamson, Wilson, and Franklin.

To heap more fuel on the fire of my point, of the 55, the Episcopalians, the Presbyterians, the Congregationalists, and the Dutch Reformed (which make up 45 of the 55) were Calvinists, for goodness sake! In other words, these weren’t just Christians, these were among the most extreme and doctrinally strict Christians around. Of the 55 delegates, virtually all of them were deeply committed Christians. Only three were deists. Even Franklin is equivocal because, though not an orthodox Christian, Franklin seems to have abandoned his deism early in life and moved back towards his Puritan roots. Indeed, it was 81 year old Franklin’s emotional call to humble prayer on June 28, 1787, that was actually the turning point for a hopelessly stalled Constitutional convention. We have his appeal on record thanks to James Madison who took copious notes of the whole proceeding. His appeal contained no less than four direct quotations from Scripture. This does not sound like a man who was hostile to the Christian religion.

But this assessment doesn’ t answer a more fundamental question: Are we a Christian nation? It seems clear that most of the Founders were Christians, not deists. But what about the question “Are we a Christian nation?” I think the answer depends entirely on what is meant by “Christian nation.”

Are the theological doctrines of the Bible explicitly woven into the fabric of government? The answer is no. The non-establishment clause of the First Amendment absolutely prohibits such a thing. However, was the Biblical view of the world–the existence of God who active in human history, the authority of the Scripture, the inherent sinfulness of man, the existence of absolute objective morality, and God-given transcendent rights–was that the philosophic foundation of the Constitution? The answer is, without question, yes. The American community presumed a common set of values which were principally biblical. Further, the founding principles of the Republic were clearly informed by biblical truth.

A question can be asked at this point. Given the fact that most of the Founding Fathers–either those who are among the 55 delegates to the Constitutional convention or those outside of that number who were significant architects to the Constitution–were in fact biblical Christians and had sworn to that, and those that weren’t were at least deeply moved and informed by a biblical moral view, one could ask the question, “So what? What does that have to do with anything today?”

I think that Christians may be a little out of line on this part of the issue, and I want to bring it into balance. Regarding the question, Is America a Christian nation?, if we mean by that that Christianity is the official, doctrinal religion of this country, the answer is of course not. That’s prohibited by the exclusion clause of the First Amendment. If we mean that we were founded on Biblical principles by Christian men who had a deep commitment to the Scriptures by and large, the answer is certainly yes.

But then the question is, So what? How does what happened 200 years ago influence what is going on now? I actually have two points to make.

This fact doesn’ t give Christians a trump card in the debate on public policy, in my view. Just because Christians were here first doesn’t mean that their views should continue to prevail. Within the limits of the Constitution, the majority rules. That’s the way this government works, ladies and gentlemen.

But let’s not rewrite history to relegate those with religious convictions to the sidelines. That is the other half of this. The privilege of citizenship remains the same for all despite their religious convictions. Everyone gets a voice and everyone gets a vote. Christians don’t have a leg up on everyone else because we were here first. Even the Christians who wrote the rules didn’t give us that liberty. They didn’t give us that leg up. They made the playing ground even for everyone, every ideology, every point of view.

Having said that, though, in writing the First Amendment and the non-establishment clause, they did not have in view this current idea of separation–that the state is thoroughly secular and not informed at all by religious values, especially Christian. This view that is popular now was completely foreign, not just to the Founders, but to the first 150 years of American political thought. It’s absolutely clear that the Fathers did not try to excise every vestige of Christian religion, Christian thought, and Christian values from all facets of public life. In fact, they were friendly to religion in general, and to Christianity in particular, and encouraged its education and expression.

As to the durability of this tradition, I suggest that anyone who has any doubts about this simply read Lincoln’s second inaugural address, which is etched into the marble of the northern wall of the Lincoln Memorial. Go there and read it. Face Lincoln, turn right, and there it is. It contains no less than three or four biblical references.

After that you can reflect on Lincoln’s Thanksgiving Proclamation of October 3, 1863. It begins this way: “It is the duty of nations, as well as of men, to own their dependence upon the overruling power of God, to confess their sins and transgressions [By golly, how did that get in there?] in humble sorrow, yet with assured hope that genuine repentance will lead to mercy and pardon. And to recognize the sublime truth announced in the Holy Scriptures and proven by all history, that those nations are blessed whose God is the Lord.”

I think that pretty much settles it.
