Trump’s Tax Returns and the Flat Tax

I applauded when Joe Biden used clever tax strategies to reduce his (apparently unpatriotic) tax bill to the IRS. I also applauded when Bill and Hillary Clinton engaged in clever tax avoidance, as well as John Kerry and Gov. Pritzker of Illinois.

In the spirit of bipartisanship, I also applaud when Donald Trump does the same thing, and that part of what we’re going to discuss today.

First, some background: The ongoing battle over Donald Trump’s personal tax information has finally ended. If you’re curious, the New York Times has a detailed report on what Trump earned (or lost) in recent years.

And the NYT also tells us how much tax he paid during those years.

When I look at these numbers, my first thought is that Trump is not a very good businessman since he has a negative income most years.

My second thought is that I’m glad he paid a low tax rate of about 3 percent in 2018 and approximately 4 percent in 2019, the two years when his income was positive.

Why am I glad? Because money in private hands is far more likely to be utilized wisely than money that gets diverted to the IRS and then spent by the politicians in Washington.

That’s the first part of today’s column.

The second part of today’s column is to use Trump’s tax return to show why the tax system would be much better if we junked the internal revenue code and replaced it with a simple and fair flat tax.

The flat is based on the principle of equality.

All income tax taxed at the same low rate.
No income is exempt from tax, other than a family-based allowance.
No income is subject to double taxation.

A tax system based on equality also means radical simplicity. The hundreds of different tax forms in today’s tax code would get dumped in the garbage.

All that would be left is a simple tax form for households.

And a simple tax form for businesses.

What would this mean for Trump’s tax returns? I’m sure the implications would be enormous, but I want to focus on just two issues.

First, under the flat tax, business losses can not be used to lower taxes on household income (wages, salaries, and pensions). So that would probably mean a higher tax burden for Trump.

Second, the tax treatment of business changes in ways that would both help Trump and hurt Trump. The most important thing to realize is that the convoluted corporate income tax (as well as parts of the personal income tax such as Schedule C) are replaced by a very simple cash-flow system.

Here’s how Professors Robert Hall and Alvin Rabushka describe the business portion of the flat tax.

The business tax is a giant, comprehensive withholding tax on all types of income other than wages, salaries, and pensions. It is carefully designed to tax every bit of income outside of wages, but to tax it only once. The business tax does not have deductions for interest payments, dividends, or any other type of payment to the owners of the business. As a result, all income that people receive from business activity has already been taxed. …The resulting simplification and improvement in the tax system is enormous. …Eliminating the deduction for interest paid by businesses is a central part of our general plan to tax business income at the source.

One very important implication of this approach is there there no longer would be a bias for debt. This would not be good news for people like Trump who usually rely on debt to finance their businesses.

On the other hand, the net result would be a tax code more favorable to investment and entrepreneurship. So if Trump is a good businessman, he will benefit.

I’m agnostic on Trump’s entrepreneurial ability, but I’m an unabashed fan of having a better tax system for America. Replacing the internal revenue codewith a sensible tax system would mean a more prosperous country and a less corrupt Washington.

P.S. Under a flat tax, a business would be allowed to “carry forward” losses from previous years, just as is usually the case for the current system.

P.P.S. A flat tax also would replace depreciation with expensing, which is another policy favorable to smart entrepreneurs.

In 1980 I read the book FREE TO CHOOSE by Milton Friedman and it really enlightened me a tremendous amount. I suggest checking out these episodes and transcripts of Milton Friedman’s film series FREE TO CHOOSE: “The Failure of Socialism” and “The Anatomy of a Crisis” and “What is wrong with our schools?” and “Created Equal” and From Cradle to Grave, and – Power of the Market.

In this episode “How to Stay Free” Friedman makes the statement “What we need is widespread public recognition that the central government should be limited to its basic functions: defending the nation against foreign enemies, preserving order at home, and mediating our disputes. We must come to recognize that voluntary cooperation through the market and in other ways is a far better way to solve our problems than turning them over to the government.”

In this episode Milton Friedman makes the point, “There was no widespread public demand for Social Security programs… it had to be sold to the American people primarily by the group of reformers, intellectuals, new dealers, the people associated with FDR. The Social Security is one of the most misleading programs. It has been sold as an insurance program. It’s not an insurance program. It’s a program which combines a bad tax, a flat tax on wages up to a maximum with a very inequitable and uneven system of giving benefits under which some people get much, some people get little.”

Lawrence E. Spivak: I know, I believe, I say I know, I think I know, but I’ll say I believe that you felt, you blame the government for the Great Depression of 1929 through 1933 and of course, you had to blame FDR for all he did, but most people feel that he saved this free economy of ours.

Friedman: Given the catastrophe of the Great Depression, there is no doubt in my mind that emergency government measures were necessary. The government had made a mess. Not FDR’s government, it was the government that preceded him. Although it was mainly the Federal Reserve System which really wasn’t subject to election. But once FDR came in he did two very different kinds of things.

Lawrence E. Spivak: Well, had the government made a mess by what it did or but by what it didn’t do.

Friedman: By what it did. By it’s monetary policies which forced and produced a sharp decline in the total quantity of money. It was a mismanagement of the monetary apparatus. If there had been no federal reserve system, in my opinion, there would not have been a Great Depression at that time. But given that the depression had occurred, and it was a catastrophe of almost unimaginable kind, I do not fault at all, indeed on the contrary I commend Roosevelt for some of emergency measures he took. They obviously weren’t of the best, but they were emergency measures and you had an emergency you had to deal with. And the emergency measure such as relief programs, even the WPA which was a make work program, these served a very important function. He also served a very important function by giving people confidence in themselves. His great speech about the only thing we have to fear is fear itself was certainly a very important element in restoring confidence to the public at large. But he went much beyond that, he also started to change, under public pressure, the kind of government system we had. If you go beyond the emergency measures to the, what he regarded as reform measures, things like NRA and AAA, which were declared unconstitutional, but then from there on to the Social Security system, to the …

Lawrence E. Spivak: Take the Social Security System for a minute. The people wanted that, they wanted that protection. They were frightened, they wanted welfare.

Friedman: Not at all.

Lawrence E. Spivak: When you said pressure, who, pressure from whom?

Friedman: Pressure from people who were expressing what they thought the public ought to have. There was no widespread public demand for Social Security programs. The demands…….

Lawrence E. Spivak: No demand for welfare with 13 million people …….

Friedman: There was a demand for welfare and assistance I was separating out the emergency measures from the permanent measures. Social Security in the first 10 years of its existence, helped almost no one. It only took in money. Very few people qualified for benefits. It wasn’t an emergency measure. It was a long term measure. And it had to be sold to the American people primarily by the group of reformers, intellectuals, new dealers, the people associated with FDR. Lawrence E. Spivak: Would you now abolish Social Security?

Friedman: I would not go back on any of the commitments that the government has made. But I would certainly reform Social Security in a way that would end in its ultimate elimination.

Lawrence E. Spivak: If you’re not afraid then of the free market under any circumstances, where cooperation which you find necessary which you believe all to come, fails to come, where competition becomes so fierce and becomes very frequently corrupt and where, all where it becomes stupid. Take for example what’s happening in today’s market, the conglomerates. Which have been seizing up all sorts of, we happen to live in a hotel that’s run by a conglomerate. Why should ITT, for example, run a hotel and how are you going to stop that.

Friedman: Well in the first place, once again,

Lawrence E. Spivak: Without government, without…..

Friedman: Once again, it’s government measures that have promoted the conglomerates. The only major reason we have conglomerates is because they are a very effective way to get around a whole batch of tax legislation. Let me ask a different question. Who is more effected by government regulations, by government controls?

Lawrence E Spivak: I thought I was supposed to ask the questions. But I was warned that you might turn these on me.

Friedman: Well tell me, whose more effected the big fellow who can deal with it or that have a separated department to handle the red tape, or the poor fellow?

Lawrence E. Spivak: The big fellow can always take care of himself under any system.

Friedman: Right, and therefore he’ll want a system which gives the big fellow the least advantage. And the system under which he can get government to help him out, gives him the most advantage, not the least. You say am I afraid of greed, of lack of cooperation. Of course. But we always have to compare the real with the real. What are the real alternatives? And if we look at the record of history, if we go back to the 19th century which everybody always points to as the era of the robber baron who strode around the land and ground the poor under his heel, what do we find? The greatest outpouring of voluntary charitable activity in the history of the world. This University, this University of Chicago is an example. It was founded by contributions by John D. Rockefeller and other people. The colleges and universities throughout the Midwest. If you go back and ask when was the Red Cross founded, when was the Salvation Army founded, when were the Boy Scouts founded, you’ll discover all of that came during the 19th century in the era of unregulated rapacious capitalism.

Lawrence E. Spivak: I’d like to go back for a minute to the question of conglomerates. Granted that what you say that the government policies concentration on central government if you will, or whatever you want to call it, are responsible for the growth of conglomerates. What would we, what should we do about them now? Government try to undue them? Or should anybody try to undue them?

Friedman: No.

Lawrence E. Spivak: Or should you just let them fail?

Friedman: You should let them fail, of course. I am strongly opposed to government bailing any of them out. You should let them fail. The best things you can do in my opinion, are first to have complete free trade so you can have conglomerates in other countries compete with conglomerates in this country. We may have only two or three automobile companies, but there’s Toyota, there’s Volkswagen, competition from abroad is effective. But in the second place…

Lawrence E. Spivak: When do you say complete free trade you mean all over the world?

Friedman: No sir. I mean the U.S. all by itself unilaterally should eliminate all trade barriers. We would be better off if all the countries did the same.

Lawrence E. Spivak: What do you think would happen if we just did it though?

Friedman: I think we’d be very much better off and a lot others would then follow our example. That’s what happened in the 19th Century when Great Britain in 1846 completed removed, unilaterally, all trade barriers so that…..

Lawrence E. Spivak: You don’t think this country would be flooded with goods of all kinds from all over the world, maybe cheaper in that we wouldn’t have great unemployment in this country?

Friedman: What would the people who sold us goods do with their money? They’d get dollars, what would they do with the dollars? Eat them. If they want to send us goods and take dollars in return, we’re delighted to have them. No. That’s not a problem as long as you have a free exchange rate. Because we cannot export without importing, we cannot import without exporting. You would not have a reduction in employment, what you’d have would be a different pattern of employment. You’d have more employment in export industries and less employment in those industries that compete with import. But go back to conglomerates, Larry for a moment. I just want to ask a very different kind of a question. Conglomerates are not very attractive, I would much rather have a lot of small enterprises. But there’s all the difference in the world between a private conglomerate and a government conglomerate. In general, the government conglomerate can get money from you without your agreeing to give it to him. You and I pay for Amtrak and for the postal deficit whether we use the services of Amtrak or the postal deficit or not. I don’t pay your conglomerate unless I rent one of their apartments. I get something for my money. So bad as private conglomerates are, they’re less bad than one of the alternatives.

Congress Guts Budget Rules and Misses Chance to Cut Spending

Republicans in Congress missed a huge opportunity to begin putting our country’s fiscal house in order.

Inflation caused by runaway government spending and money printing was the top issue on the minds of voters in the November midterm elections.

The Left’s reckless pursuit of these disastrous policies has been a boon for fiscally conservative politicians bold enough to honor their promise to the American people.

“Across the country, conservative candidates who offered courageous leadership and a clear policy agenda were rewarded,” Heritage Foundation President Kevin Roberts explained. “Candidates who focused solely on blaming President Joe Biden for the country’s problems, without offering any solutions, were disappointed.”

The lesson for politicians should be that they need to understand the issues that matter to American families, identify solutions to those challenges, and then boldly go on offense to achieve results by taking advantage of legislative opportunities.

The most important solution lawmakers could advance to address the country’s largest problem, inflation, is reducing government spending.

Republican lawmakers were handed a golden opportunity this week to single-handedly cut spending.

That’s because President Joe Biden’s $1.9 trillion American Rescue Plan Act–the spending bill that lit the inflationary fire–violated the Statutory Pay-As-You-Go rules put into place by President Barack Obama.

The Statutory PAYGO law requires deficit-increasing laws like the American Rescue Plan to be paid for with cuts elsewhere in the budget. If Congress doesn’t do its job, then the president is required to automatically carry out specified spending cuts.

Biden’s bill for his spending was set to come due in January, when the President would have been required to cut $132 billion out of the $6 trillion budget.

To reduce inflationary government spending, all Republican senators had to do was absolutely nothing. It would have been a perfect opportunity to help American families.

Of course, Biden wants to keep government spending as high as possible, inflation be damned. And some Republicans wanted to avoid the specific cuts required by Obama’s Statutory PAYGO law, which would include a 4% haircut to Medicare payments to providers.

They could have negotiated other spending cuts to replace the automatic reductions. The $80 billion IRS slush fund to add 87,000 agents would have been a popular place to start.

Because Republicans didn’t vote for the American Rescue Plan Act that triggered Statutory PAYGO rules (they didn’t vote for the Statutory PAYGO law either), they would have been totally blameless if Biden ultimately rejected common sense solutions and instead decided to enact the automatic spending cuts.

Republicans held all the leverage.

What ended up happening?

The massive omnibus spending bill introduced by the leadership of both parties in the Senate included a provision that simply turned off enforcement of the Statutory PAYGO rules not just this year, but next year as well. This would result in a $260 billion deficit-fueled spending hike.

Comically, the provision turning off budget enforcement rules were written in such a way that they violated another Senate budgetary rule.

Senator Rand Paul, R-Ky., raised a point of order, stating:

Today’s legislation breaks the Congressional Budget Act rules, so Congressional leaders have included in this monstrous spending bill language to simply waive the PAYGO rules. Congress has time and time again waived its own rules and the result has been over $31 trillion in debt, inflation, and a weakened economy. Let’s respect the American people by being responsible stewards of their tax dollars and adhering to our own budget rules.”
Unfortunately, 16 Senate Republicans and all Democrats voted to “waive all applicable budgetary discipline.”
Paul tweeted “That Point of Order was waived with the help of 16 REPUBLICANS. If it had been upheld, this monstrous spending bill would have been stopped until there were SERIOUS cuts.”
Eighteen Senate Republicans ultimately voted forfinal passage of the omnibus, pushing American taxpayers further into debt and increasing inflationary pressures.
Not taking advantage of the leverage to achieve results for the American people presented by Statutory PAYGO is a big, missed opportunity. One that will cost taxpayers hundreds of billions of dollars.
Next year will feature several important policymaking inflection points that should be opportunities for conservative lawmakers to reduce inflationary government spending by trillions of dollars, including the debt limit, government funding, and the farm bill.
The American people expect–and deserve–bold leadership. Congressional leaders must be prepared to seize these and every chance to slow the growth of government spending and save our country.

The House of Representatives voted 225 to 201 to pass the $1.85 trillion omnibus spending bill on Friday afternoon.

This comes a day after the Senate voted 68-29 for the legislation, meaning that the bill will end up on President Joe Biden’s desk for passage.

Nine Republicans voted in favor of the omnibus bill and one Democrat, Rep. Alexandria Ocasio-Cortez, D-N.Y., voted “no.”

The Republicans who voted in favor were Reps. John Katko, R-N.Y.; Chris Jacobs, R-N.Y.; Brian Fitzpatrick, R-Pa.; Fred Upton, R-Mich.; Adam Kinzinger, R-Ill.; Rodney Davis, R-Ill.; Steve Womack, R-Ark.; Jaime Herrera Beutler, R-Wash.; and Liz Cheney, R-Wyo.

Heritage Foundation policy analysts have criticized the omnibus spending bill as a “vast collection of special-interest handouts and fuel for the fires of inflation and the woke, leftist establishment” and warned that it “will stifle our economy and accelerate the dissolution of the fabric of our civil society for many years to come.” (The Daily Signal is the news outlet of The Heritage Foundation.)

It was also unprecedented in recent history that an outgoing Congress passed such a large spending bill. Since 1994, the House majority has changed four times. In each case, the outgoing majority didn’t pass an omnibus appropriations bill during the lame-duck session following the election. Instead, the outgoing majority left the hard work of legislating to the representatives the American people had just elected.

Critics note that the omnibus spending package contains 6,825 pages: 4,155 pages of legislative text plus 2,670 pages of explanatory materials to instruct agencies on how to carry out the provisions. It also includes at least 4,000 earmarks to pay for the pet projects of senators and representatives.

“With this vote, these Republican senators have committed a stunning act of betrayal of their constituents and the American people,” Richard Stern, a senior policy analyst for budget policy at The Heritage Foundation, told The Daily SignalThursday about the Senate vote. “With less than two weeks until the new Congress, they have shamefully voted to deny the incoming conservative House majority the use of its power of the purse to rein in Biden and his cronies.”

“This omnibus will add to inflationary pressures, saddling the nation with at least another $20,000 per household in needless debt and will expand the power of the woke Left,” Stern added.

In a lengthy speech House Minority Leader Kevin McCarthy, R-Calif., spoke about why he was voting against the omnibus bill.

“This is a monstrosity. That is one of the most shameful acts I’ve ever seen in his body,” McCarthy said on the House floor. “The appropriations process has failed the American public, and there’s no greater example of the nail in the coffin of the greatest failure of a one-party rule of the House, the Senate and the presidency.”

Rep. Chip Roy, R-Texas, who has been highly critical of the omnibus bill and the process that has led to its passage, noted that there were 226 proxy votes cast for the bill and said that the House lacked a physical quorum as required by the constitution.

“Everything the American people is watching right now is a complete sham, it’s a fraud … the American people deserve us to be here over Christmas actually fighting for them,” Roy said.

Dear Mr. President,

The federal government debt is growing so much that it is endangering us because if things keep going like they are now we will not have any money left for the national defense because we are so far in debt as a nation. We have been spending so much on our welfare state through food stamps and other programs that I am worrying that many of our citizens are becoming more dependent on government and in many cases they are losing their incentive to work hard because of the welfare trap the government has put in place. Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back. It seems to me we have to get back to the founding principles that made our country great. We also need to realize that a big government will encourage waste and corruption. The recent scandals in our government have proved my point. In fact, the jokes you made at Ohio State about possibly auditing them are not so funny now that reality shows how the IRS was acting more like a monster out of control. Also raising taxes on the job creators is a very bad idea too. The Laffer Curve clearly demonstrates that when the tax rates are raised many individuals will move their investments to places where they will not get taxed as much.

17 Reasons the large national debt is a big deal!!!

Remember the debt? That $17 trillion problem? Some in Washington seem to think it’s gone away.

The Washington Post reported that “the national debt is no longer growing out of control.” Lawmakers and liberal inside-the-Beltway organizations are floating the notion that it’s not a high priority any more.

We beg to differ, so we came up with 17 reasons that $17 trillion in debt is still a big, bad deal.

1. $53,769 – Your share of the national debt.

As Washington continues to spend more than it can afford, every American will be on the hook for this massive debt burden.

2. Personal income will be lower.

The skyrocketing debt could cause families to lose up to $11,000 on their income every year. That’s enough to send the kids to a state college or move to a nicer neighborhood.

3. Fewer jobs and lower salaries.

High government spending with no accountability eliminates opportunities for career advancement, paralyzes job creation, and lowers wages and salaries.

4. Higher interest rates.

Some families and businesses won’t be able to borrow money because of high interest rates on mortgages, car loans, and more – the dream of starting a business could be out of reach.

5. High debt and high spending won’t help the economy.

Journalists should check with both sides before committing pen to paper, especially those at respectable outlets like The Washington Post and The New York Times. A $17 trillion debt only hurts the economy.

6. What economic growth?

High-debt economies similar to America’s current state grew by one-third less than their low-debt counterparts.

7. Eventually, someone has to pay the nation’s $17 trillion credit card bill, and Washington has nominated your family.

It’s wildly irresponsible to never reduce expenses, yet Washington continues to spend, refusing to acknowledge the repercussions.

8. Jeopardizes the stability of Medicare, Social Security, and Medicaid.

Millions of people depend on Medicare, Medicaid, and Social Security, but these programs are also the main drivers of the growing debt. Congress has yet to take the steps needed to make these programs affordable and sustainable to preserve benefits for those who need them the most.

9. Washington collects a lot, and then spends a ton. Where are your tax dollars going?

In 2012, Washington collected $2.4 trillion in taxes—more than $20,000 per household. But it wasn’t enough for Washington’s spending habits. The federal government actually spent $3.5 trillion.

10. Young people face a diminished future.

College students from all over the country got together in February at a “Millennial Meetup” to talk about how the national debt impacts their generation.

The national debt is an uphill battle in a city where politicians too often refuse to relinquish power, to the detriment of America.

Astronomical debt lowers incomes and well-being permanently, not just temporarily. A one-time major increase in government debt is typically a permanent addition, and the dragging effects on the economy are long-lasting.

13. The biggest threat to U.S. security.

14. Makes us more vulnerable to the next economic crisis.

According to the Congressional Budget Office’s 2012 Long-Term Budget Outlook, “growing federal debt also would increase the probability of a sudden fiscal crisis.”

Our nation is on a dangerous fiscal course, and it’s time for lawmakers to steer us out of the coming debt storm.

Dear Senator Lindsey Graham,

Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back.

The Bill Is a Pork-Filled Disaster

But the $1.7 trillion omnibus doesn’t just add to America’s already-ballooning $31.4 trillion national debt. It also directs funding toward a slew of wasteful agenda items that everyday Americans never asked for.

Included in the bill is an allotment of “not less than” $575 million that is “made available for family planning/reproductive health, including in areas where population growth threatens biodiversity or endangered species.” The measure also provides grants to numerous LGBT-related entities, such as $750,000 to the TransLatin@ Coalition and $3 million to the New York Historical Society’s “American LGBTQ+ Museum Partnership Project.”

Meanwhile, funding for U.S. Customs and Border Protection and Immigration and Customs Enforcement are small facets of the omnibus, with the two agencies receiving $1.56 billion and $339.6 million, respectively, for “non-detention border management requirements.”

The funding, however, comes with strings attached that hinder immigration officials’ ability to effectively deal with the ongoing border crisis. As noted in the bill, the grants are prohibited from being utilized to “acquire, maintain, or extend border security technology and capabilities,” unless they are employed to “improve Border Patrol processing.”

Meanwhile, the bill gives Ukraine an additional $45 billion in aid.

20 WAYS TO DEAL WITH A FOOLISH PERSON

The writer of Proverbs divides the world into two types of people: wise and foolish. He has much to say about both. A man is made wise by listening to the Lord and living His life in surrender to God’s will and way.

God IS wisdom and the source of all wisdom in this earth. “The fool has said in his heart, ‘There is no God,’” David said. When we reject Him, we reject the process of receiving the wisdom we need. We become foolish, vainly thinking that our mere humanistic thinking is sufficient for life.

And, fools will hurt you. They ruin relationships, cloud decision making, and lead others astray. If you are a man who is seeking wisdom, you will find that dealing with foolish people is a great burden.

I have recently been helping a pastor work through an issue with a very foolish person in his church. This individual is proud and believes their opinion is more important than anyone’s. They are creating strife and discord in the church and there is a very clear unwillingness to submit to godly spiritual leaders. A foolish person, wrapped in religious clothing, is even harder to deal with because they approach others under the guise of spirituality.

Their anger and issues are hard to deal with, which the writer of Proverbs points out. It is a very heavy weight for a leader to bear.

“A stone is heavy and the sand weighty, but the provocation of a fool is heavier than both of them.” (Proverbs 27:4)

Here are twenty instructions from Proverbs about how to recognize and deal with foolish people … some things a wise leader needs to understand.

1. They will not accept instruction

Proverbs 1 :7: The fear of the Lord is the beginning of knowledge; fools despise wisdom and instruction.

2.They will not honor others

Proverbs 3 :35: The wise will inherit honor, but fools display dishonor.

3. They will quickly gossip and slander others

Proverbs 10:18: He who conceals hatred has lying lips, and he who spreads slander is a fool.

4. They do not have real, spiritual understanding

Proverbs 10:21: The lips of the righteous feed many, but fools die for lack of understanding.

Proverbs 16:22: Understanding is a fountain of life to one who has it, but the discipline of fools is folly.

5.They always think they’re right and will not listen to nor accept humbly the counsel of others

Proverbs 12:15: The way of a fool is right in his own eyes, but a wise man is he who listens to counsel.

6. They are quick to anger

Proverbs 12:16: A fool’s anger is known at once, but a prudent man conceals dishonor.

Proverbs 29:11: A fool always loses his temper, but a wise man holds it back.

7. They will always, ultimately display their foolishness. It cannot be hidden for long.

Proverbs 13:16: Every prudent man acts with knowledge, but a fool displays folly.

8. If you associate with them, it will lead to harm

Proverbs 13:20: He who walks with wise men will be wise, but the companion of fools will suffer harm.

9. They are deceitful, often not even realizing their deception. They are full of self-deception.

Proverbs 14:8: The wisdom of the sensible is to understand his way, but the foolishness of fools is deceit.

10. They are arrogant and careless, particularly about walking into evil.

Proverbs 14:16: A wise man is cautious and turns away from evil, but a fool is arrogant and careless.

11. They are quick to tell everyone what they think, but it’s folly. They have an opinion on everything, that they believe is right.

Proverbs 15:2: The tongue of the wise makes knowledge acceptable, but the mouth of fools spouts folly.

12. They reject discipline

Proverbs 15:5: A fool rejects his father’s discipline, but he who regards reproof is sensible.

13. They do not spread real knowledge (although they think they do)

Proverbs 15:7: The lips of the wise spread knowledge, but the hearts of fools are not so.

14. Don’t give them position or honor

Proverbs 26:8: Like one who binds a stone in a sling, so is he who gives honor to a fool.

Proverbs 26:10: Like an archer who wounds everyone, so is he who hires a fool or who hires those who pass by.

15. They will not receive a healthy rebuke (because they always think they’re right)

Proverbs 17:10: A rebuke goes deeper into one who has understanding than a hundred blows into a fool.

16. They are dangerously protective when you deal with them. They will hurt you to protect their way.

Proverbs 17:12: Let a man meet a bear robbed of her cubs, rather than a fool in his folly.

17. They don’t want understanding, but they love to tell you what they think.

Proverbs 18:2: A fool does not delight in understanding, but only in revealing his own mind.

18. They create strife

Proverbs 18:6: A fool’s lips bring strife, and his mouth calls for blows.

19. They love to quarrel

Proverbs 20:3: Keeping away from strife is an honor for a man, but any fool will quarrel.

20. It’s useless to try to reason with them

Proverbs 23:9: Do not speak in the hearing of a fool, for he will despise the wisdom of your words.

Proverbs 26:4: Do not answer a fool according to his folly, or you will also be like him.

Proverbs 26:5: Answer a fool as his folly deserves, that he not be wise in his own eyes.

All of us are foolish at times, and we’re all capable of becoming foolish. Every leader must evaluate first his own life, to see if he is acting or living foolishly. A wise leader pursues God fervently and humbly, which is to pursue wisdom. But also, a wise leader must know how to recognize and deal with foolish people, particularly those who are causing discord, contention, and strife.

Be finding in your Bibles the book of Isaiah chapter 59; and when you’ve found it, would you look up here, and may I tell you as you’re finding it that our beloved United States of America is in a crisis. And the title of the message today: “A Nation in Crisis.” One by one, the lights of decency and the lights of hope are being blown out in America. And it seems that Americans are content to have scoundrels in leadership so long as they give us prosperity. But one day, calamity will come. One day, we will face perhaps international terrorism, perhaps unparalleled economic reversal, perhaps natural disasters over which we have no control whatsoever. And then we will fill our churches, and we will turn our eyes upward. And we will dial 911, but there will be no answer: the line will be dead. First Samuel chapter 8, verse 18, says, “And ye shall cry out in that day because of your king which ye shall have chosen you; and the Lord will not hear you in that day.” (1 Samuel 8:18) You’ll cry out; you’ll say, “O God, have mercy.” You’ll pray, and your prayers won’t be answered. Why is that?

Well, look in Isaiah chapter 59, verse 1: “Behold, the Lord’s hand is not shortened, that it cannot save; neither his ear heavy, that it cannot hear:”—God is not palsied, and God is not deaf—“but”—verse 2—“your iniquities have separated between you and your God, and your sins have hid his face from you, that he will not hear. For your hands are defiled with blood, and your fingers with iniquity; your lips have spoken lies, your tongue hath muttered perverseness. None calleth for justice, nor any pleadeth for truth: they trust in vanity, and speak lies; they conceive mischief, and bring forth iniquity.” (Isaiah 59:1–4) Now, what is Isaiah saying to a sinful nation of that day? God is well able to hear your prayers. It’s not that He cannot hear your prayers; it is that He will not hear your prayers because your sin has created a barrier between you and a holy God. And Isaiah tells us what the sin of that day was and how it tracks and parallels the sin of our day.

They Had Bloody Hands

First of all, look in verse 2. They had bloody hands. America is swimming in an ocean of blood. A modern holocaust has stained and flooded America. The blood of some thirty million preborn babies cries out from the ground against us since 1972, that horrendous Roe v. Wade ruling when nine men dressed in black robes said that a little preborn babies can be treated as a piece of protoplasm. And we in America are now killing babies at the rate of four thousand a day. Notice what Isaiah said: “Your iniquities have separated between you and your God, and your sins have hid his face from you.” (Isaiah 59:2) Verse 3: “Your hands are defiled with blood.” (Isaiah 59:3)

When you ask a politician about abortion, he’ll dodge the issue. He’ll tell you, “That’s a moral decision. It is a religious decision. That’s not a proper subject for politics, and that needs to be studied in the church between the priest, the rabbi, and the pastor. It is a personal decision, not a political decision.” But if the priest, the rabbi, or the pastor speaks about it, they’ll rise up and say, “Why doesn’t he stay out of politics?” And meanwhile, the babies die. And we are swimming in an ocean of blood, and the violence of our day has surpassed the days of Noah, the days of Lot. King Herod is in the background today. One man has wisely said, “Today we’re living in the day where twelve-year-olds are having babies, fifteen-year-olds are killing each other, seventeen-year-olds are dying of AIDS, and eighteen-year-olds are graduating from high school with a diploma they can’t read.” That’s where we are in America today: bloody hands.

They Had Lying Lips

But then he goes on to say not only bloody hands, but lying lips. Again, look, if you will, in verse 3: “Your lips have spoken lies, your tongue hath muttered perverseness.” (Isaiah 59:3) I’ve been watching the news programs lately, and we’ve been talking about lies in high places and low places. And the going merchandise among those news programs is, “Well, everybody lies. What’s so rare about lies? Everybody lies.” U. S. News & World Report in a report said this: “Governmental officials dissemble; scientists falsify research; workers alter career credentials to get jobs.” And then the magazine asks, “What’s going on here? The answer, a growing number of social critics fear, is an alarming decline in basic honesty.”

They Had Wicked Hearts

Bloody hands. Lying lips. Number three: wicked hearts. Look, if you will, in verse 4: “None calleth for justice, nor any pleadeth for truth: they trust in vanity, and speak lies; they conceive mischief, and bring forth iniquity.” (Isaiah 59:4) It’s terrible to raise teenagers today, because we have a day of moral ambivalence; we have a day of ethical fogginess. What are we being told today? We’re being told that adultery is really no big deal: everybody does that. Friend, I want to tell you, if a man will not keep a sacred vow before Almighty God to his wife, I wouldn’t trust him to keep any promise anywhere anytime. We’re being told today that private morality can be disconnected from public service. That’s not what God’s Word says. Ecclesiastes chapter 10, verse 1 says this: “Dead flies cause the ointment of the apothecary to send forth a stinking savour: so doth a little folly him that is in reputation for wisdom and honour.” (Ecclesiastes 10:1) Dead flies in the ointment, friend; something stinks in America.

Theodore Roosevelt, a man of yesteryear, won his first major election back in 1898. He was elected governor of New York. About that time, Theodore Roosevelt wrote something that’s so pertinent to our day and our age. I want you to listen to it. It sounds like it was written for today, but listen to it. He says, “No community is healthy where it is ever necessary to distinguish one politician among his fellows because ‘he is honest.’ Honesty is not so much a credit as an absolute prerequisite to efficient service to the public. Unless a man is honest we have no right to keep him in public life, it matters not how brilliant his capacity, it hardly matters how great his powers of doing good service on certain lines may be.” Now what Teddy Roosevelt said was, “If he’s not honest, then he’s just simply disqualified.”

Again, Teddy Roosevelt said this: “If a man lies under oath or procures the lie of another under oath, if he perjures himself or suborns perjury, he is guilty under the statute law. Under the higher law, under the great law of morality and righteousness, he is precisely as guilty if, instead of lying in a court, he lies in a newspaper or on the stump; and in all probability the evil effects of his conduct are infinitely more wide-spread and more pernicious. The difference between perjury and mendacity is not in the least one of morals or ethics. It is simply one of legal forms.” Now what he is saying is the same thing that Jesus said when He said, “[When you speak] let your yea be yea; and your nay, nay.” (James 5:12) It doesn’t matter whether you’re under oath or whether you’re not under oath.

We’re being told today that somehow public approval validates wrong behavior. This same Isaiah, whose book we’re reading, said in Isaiah chapter 5, verse 20, “Woe unto them that call evil good, and good evil; that put darkness for light, and light for darkness; that put bitter for sweet, and sweet for bitter!”(Isaiah 5:20) We’re being told that if a man is approved by society, that that is good. It is not good, no matter how many times we take a poll. We’re being told that a lie about adultery is permissible and that a lie while under oath is not acceptable. And Jesus said, “Let your yea be yea; and your nay, nay.” (James 5:12)

Now, what has brought about this condition? Why is it that Isaiah’s people came to a place where they would look up to God and say, “God have mercy on us,” and God said, “No, I’m not going to hear your prayer”? What brought about bloody hands, lying lips, and wicked hearts? Three things—I want you to see them right here in this text.

A Diet of Deception

Number one: The people had been feeding on a diet of deception. Look in verse 5: “They hatch [viper’s] eggs, and weave the spider’s web: he that eateth of their eggs dieth, and that which is crushed breaketh out into a viper.” (Isaiah 59:5) Now if you’ll look at verse 5, and link verse 5 to verse 4, you’re going to find out that those viper’s eggs, those snake eggs that he’s talking about that are hatched in hell’s incubators, they are devilish lies and philosophies that are being hatched—were hatched in Isaiah’s day and also being hatched in our day—lying, poisonous philosophies that are being swallowed down by adults and by youth alike. Our world, our nation, is on a snake egg diet—a diet of deception. The incubators that hatch those eggs are materialism, humanism, New Ageism, liberalism. They’ve hatched these out. The old granddaddy serpent who has spawned and fertilized these eggs is Satan himself because he is a liar, and the father of all lies. (John 8:44) There are certain philosophical underpinnings that are so incipient in American life today that are poisoning our educational, our philosophical, our religious, and political outlook.

And our young people are going to public schools, and each morning they’re served a snake egg omelet. They swallow these things down. You see, dramatic changes have taken place in America, and in twenty years—twenty years that most of us have lived through—there has been a complete reversal. From 1962 to 1982, let me tell you what has happened in twenty years. In 1962, the Supreme Court ruled that voluntary prayer in public schools is unconstitutional. Now they tell us that our children must be in the public schools, but they say, “You cannot have voluntary prayer. We’ll put you there, but you cannot pray.” That’s 1962. Then, in 1963, the same court dismantled classroom Bible reading: no room for the Bible in our halls of education. Then, in 1980, the posting of the Ten Commandments was declared unconstitutional. Now when kids are bringing guns to school, we cannot post on the walls of our schoolrooms, “Thou shalt not kill.” (Exodus 20:13; Deuteronomy 5:17) In 1982, the court prohibited the teaching of biblical creation. In twenty years, God has been expelled from our public schools and been told not to return. Now abortion, infanticide, euthanasia all become possible in a world where you believe that man is the creation of some blind, evolutionary force; that he is not created in the image of God, but he has evolved from some primordial ooze.

So, what do we have today? What is it like? Well, today, children, if they go to school, must receive parental permission before a school-based clinic can prescribe an aspirin. But yet in America a little teenage girl can be given an abortion—abortion guidance counsel, and the abortion itself—without the parents even knowing that this is taking place. That is in America. School-based clinics dispense birth control devices and parental counseling without notification or approval. What is happening in America is that our kids are being served snake eggs everyday. Prayer is out; policemen are in. Bibles are out; values clarification is in. The Ten Commandments, yes, they’re out; but rape and armed robbery, gang warfare, murder, and cheating are in. Creation instruction is out; evolution and blind chance is in. Corporal punishment is out; disrespect and rebellion are in. Traditional values are out; unwed motherhood is in. Abstinence is out; condoms and abortion are in. Learning is out; social engineering is in. History is out; revisionism is in. Is it any wonder that the suicide rate of our teenagers is soaring, runaway statistics are soaring, promiscuity problems, violent crime? Our kids are not being raised in a society, in a school, that says that they have rights that are given to them, unalienable rights given by Almighty God, but they are told that the universe itself exists—not that it was created—and the wisdom that built this great nation is being laughed at.

But here’s the sad thing. Look, if you will, in verse 5: “They hatch [viper’s] eggs, and weave the spider’s web: he that eateth of their eggs dieth,”—now, watch that—“and that which is crushed breaketh out into a viper.” (Isaiah 59:5) When you come against these things and try to stamp them out, all you do is create more snakes. To stamp out these snake eggs is not the answer.

A Web of Wickedness

Now not only is there a diet of deception, but that is compounded by a second thing in America that makes our nation a nation in crisis: not only a diet of deception, but a web of wickedness. Look again in verse 5, if you will. He says here in verse 5, “They … weave the spider’s web.” I got down my encyclopedia and read something about spiders. I don’t know whether you have a love affair with spiders or not. I don’t. But spiders weave a web—almost invisible, very sticky. And the purpose of that web is to catch an unsuspecting insect who will fly into that web and become entangled in that web where the spider can come out and wrap him out in more strands of that web. Then the spider injects poison into the body of that insect, and the spider sucks that insect dry.

Now Satan has woven some webs, and he is poisoning and sucking dry the generation of young people today. Satan has a network—are you listening to me?—a web of evil that is absolutely terrifying, and our young people can hardly see the web. They don’t understand it.

The Web of Pornography

There’s pornography, for example: the web of pornography. “Pastor Rogers, does pornography lead to degeneracy?” Pornography is degeneracy. That’s what it is. Our kids today can get on the Internet and watch unspeakable, unmentionable things, even in school, as they can access these things. At home they can pick up the phone, dial-a-porn, and listen to lesbian sexual activities, sodomy, rape, incest, bestiality, or sex with other children. There are more adult bookstores in America today than there are McDonald’s restaurants. Pornography is a multibillion-dollar industry. That is a web, and so many kids and adults alike are being caught in it.

The Web of Drugs and Alcohol

Satan has his web of drugs and alcohol—a deadly trap. America is filled today with walking dead, whose lives have been sucked dry by the spiders of alcohol and drug abuse. I read recently where students spend 5.5 billion dollars on alcohol: more than they spend on nonalcoholic drinks like Pepsi or Coke or 7 Up and books put together—on alcoholic beverages! Now these Madison Avenue people come into the living room through their beer ads, and through their sports ads, and they’ll have these boys, as I’ve said before, out there on the bass boat somewhere hoisting a six-pack, and one of them smiles and says to the other one, “It doesn’t get any better than this.” Boy, they’re right: it always gets worse. “It doesn’t get any better than this.” And we have a generation of walking dead, who have been sucked dry, embalmed, by alcohol.

The Web of Sexual Immorality

There’s a sticky web of immorality. Young people are being told today there are no fixed standards of right or wrong, and the media, or entertainment, has created the myth that premarital sex, extramarital sex, and homosexuality are on the same level as chastity, monogamy, and heterosexuality. And in our so-called sex education classes in many of our schools they have a threefold goal—and that is to teach children how to fornicate without guilt, without catching a disease, and without conceiving a baby. That’s called “sex education” today.

How would you like your child to go to school and hear what some are being taught? Here’s what they’re being taught. Here’s the textbook. Quote: “Premarital sexual intercourse is both acceptable for men and women if they are involved in a stable, loving relationship. It has been suggested by some marriage counseling authorities that all couples should live together before they’re married.” How would you like that for education? Or listen to this: “Often, promiscuity is labeled as bad by persons who do not accept this type of behavior. As with other patterns of sexual behavior, one should not pin ‘good’ or ‘bad’ on a practice.” Here’s another: “Morality is individual; it’s what you think it is. Your conception of what is right or wrong morally is an individual decision.”

May God have mercy upon us when these tell us we cannot pray, we cannot read God’s Word, we cannot post the Ten Commandments, but we can denigrate God’s Word and God’s law. And kids today talk about “going all the way.” My God, that’s the one thing they don’t do. They haven’t gone all the way. They go a little further when they catch a disease along the way; a little further when a baby is conceived and they have to tell their father or mother; a little further if they decide to murder that baby. But they really haven’t gone all the way until they stand before a holy God who says, “Thou shalt not commit adultery”; (Exodus 20:14) a holy God who says, “Flee fornication.” (1 Corinthians 6:18)

III. A Trashing of Truth

Friend, we are in a terrible situation. What has brought about this crisis in America? Number one: a diet of deception. Number two: a web of wickedness. Number three: the trashing of truth. Fast-forward to verse 12: “For our transgressions are multiplied before thee, and our sins testify against us: for our transgressions are with us; and as for our iniquities, we know them; In transgressing and lying against the Lord, and departing away from our God, speaking oppression and revolt, conceiving and uttering from the heart words of falsehood.” Now, watch this: “And judgment is turned away backward, and justice standeth afar off:”—why has judgment been turned away backward? Why does justice wait in the wings? Here it is—“for truth is fallen in the street, and equity cannot enter. Yea, truth faileth; and he that departeth from evil maketh himself a prey.” (Isaiah 59:12–15) That is, when you stand up and speak against it, you become the bad guy.

Listen. I have been preaching too many years for me not to know that I am the heavy today; I am the bad guy today; I’m making myself a prey when I say “This is wrong” when I speak against these things. When you call for justice, when you call for truth, you become the guy in the black hat. That’s the state to which we have come today. But notice what he says. He says there’s a traffic jam. Justice, equity, cannot come through the streets, because “truth is fallen.”And all of the traffic is backed up, because “truth is fallen in the street.” (Isaiah 59:14)

Well, what caused truth to fall? Notice truth is not dead. There is a traffic jam. Judgment, justice, and equity cannot enter. It’s not that truth is nonexistent. You can’t ever murder truth. It is not that truth is dead. Truth will not die. But truth has stumbled. Truth is lying prostrate on the ground. Why? Well, she has been knocked down in America by doctors of philosophy. She has been tripped up in America by dishonest politicians. And she has been chloroformed by liberal preachers. And she’s lying there in the street. May I say with all of the unction, function, and emotion of my soul; God help me to say it: The job in America today is to put truth back on her feet. That is the job in America: to put truth back on her feet. And I really believe there is not a lot wrong in America that could not be put right quickly, dramatically, if across America, in the pulpits of America, from sea to shining sea, this Sunday and every Sunday, a generation of preachers would open the book of truth and preach “Thus saith the Lord God Almighty” without fear or failure.

We’re in a situation today that’s in a crisis. Why did God write a Bible? He calls that Bible “the Word of truth.” Why did God send the Holy Spirit? He calls the Holy Spirit “the Spirit of truth.” How does God describe Himself? He describes Himself as “the Truth.” Who is Jesus? Jesus said, “I am the way, the truth, and the life.” (John 14:6) What is the church? The church is called “the pillar and ground of the truth.” (1 Timothy 3:15) The Apostle John said, “I have no greater joy than to hear that my children walk in truth.” (3 John 1:4) We can get facts from the Internet. There’s a difference between facts and truth. Knowledge may double; truth will never double. There is eternal truth. Truth is what food is to your body, light is to your eyes, and melody is to your ears.

Now, do you know what most of us want to do? Most of us want to be stamping out snake eggs. Most of us want to be sweeping down spider’s webs. But, friend, you stamp out a snake egg: just more snakes. You sweep down a spider’s web—you’ve done it before: it’s back the next morning, is it not? We need something that will slay the snake and destroy the spider—and that is truth. Only truth can keep this daddy serpent from spawning those eggs. Only truth can keep that spider from weaving those sticky webs. We need to lift up truth in America today, to put truth on her feet. And I want to call upon you and every believer to rededicate himself to the truth. Parents, teach your children to live the truth, to love the truth, to tell the truth, to know the truth, and to believe the truth. Jesus said, “Sanctify them through thy truth: thy word is truth.” (John 17:17)

Conclusion

Let me give you a proverb here, and I’m almost finished—Proverbs 23, verse 23: “Buy the truth, and sell it not.” (Proverbs 23:23) There is a prize to possess: it is truth. There is a price to pay: you must buy the truth. You must study it, pore over it, live it, know it. And you must preserve the truth. Don’t let anybody take the truth from you. That truth is in God’s Word. The early Christians did not argue over the Bible. They loved it. They believed it. They expounded it. They poured it forth as white-hot lava.

Now, one by one, person by person, family by family, city by city, church by church, we’ve go to take America back. My heart is broken over snake eggs, spider webs, and traffic jams. What about you? I’m not talking about the person sitting next to you. What about you? Are you right with God? Do you think it’s somebody else’s problem? What about your home? What about your business relationships? Have you been feeding on snake eggs? Some right now are wrapped up in spider’s webs. There’s only one thing that will set you free. Jesus said, “Ye shall know the truth, and the truth shall make you free.” (John 8:32)

I want to tell you, the truth is today that God loves you. The truth is today that Jesus Christ died for you. He carried your sins to the cross, and with His blood, He paid your sin debt. The truth is that He walked out of that grave, and He has ascended to high hills of glory. The truth is that one day—soon and very soon, I hope—He’s coming again. And the truth is, if you will believe on Him and trust Him, He will save you. I promise you on the authority of the Word of God not only will have save you, but—praise His holy name—He will satisfy you. What you’re longing for, you’ll never find, until you find it in the Lord Jesus. And not only will He save you, and satisfy you; He will sanctify you. He’ll begin to make you more and more and more and more and more like Him. Now when you come to Jesus, you’re not going to sprout wings and get a halo right away; you’ll have to grow. But this saving Jesus is the satisfying, sanctifying Jesus. And I’ll tell you something else: He will secure you. He will keep you. It’s not a matter of your holding on to Him; He’ll hold you—if you truly give Him your heart and your life.•^[1]

Five Things to Know About the Monstrous Lame Duck Omnibus

Just as I predicted back in October, Congress pushed its discretionary spending deadline back by one week, from December 16 to December 23. This comes as no surprise as congressional leadership is once again trying to ram through a massive omnibus bill before the year ends. The Friday deadline gives leadership leverage, as they threaten a partial government shutdown that might keep members of Congress in Washington over Christmas. Vote as you’re told, or you’re not going home is the name of this game.

Yet in the same vein that Congress managed to punt on appropriations when they were due on September 30, and again on December 16, Congress could punt on appropriations once more. The December 23 deadline is rather arbitrary—except for the fact that a new Congress will take power next year. As I’ve argued previously, the American people would be better served by Congress extending the continuing resolution into 2023 for the new House majority can take another crack at putting discretionary spending on a more responsible path.

Here are five quick things legislators and the public should know about what Congress would do with this lame duck omnibus:

Congress would spend too much, increasing deficits and adding to inflation. The omnibus would increase discretionary spending by about $200 billion or 13 percent, compared to extending the continuing resolution in effect now through the end of this fiscal year (September 30, 2023). Put another way, if Congress didn’t alter the current spending trajectory at all, the federal government would spend that much less.

Part of that increase comes from $85 billion in new emergency supplemental spending that should be offset with other spending reductions. Emergency spending is on the rise as lawmakers are increasingly using this designation—intended for severe, unpredictable, and urgent needs— as a piggybank for non‐emergency priorities.

With the fiscal year (FY) 2023 deficit projected to clock in at more than $1.2 trillion as the Federal Reserve continues rate hikes to control inflation, Congress should not add fuel to the inflationary fire. The more responsible path would reduce discretionary spending (the one‐third of the budget that Congress reviews each year) back to pre‐pandemic levels, cutting crisis excess.

Congress would waive required PAYGO spending cuts. Previously enacted deficit‐spending bills, including the $1.9 trillion American Rescue Plan Act, are set to trigger spending cuts of roughly $130 billion per year. The omnibus waives those required cuts for two years, increasing deficits by about $260 billion. Statutory PAYGO is a budget rule to encourage Congress to offset new mandatory spending increases or tax reductions by tracking related deficits and forcing sequestration (“automatic spending cuts”) if the scorecard shows a balance. The Heritage Foundation’s Matthew Dickerson has been beating the drum about PAYGO for some time now, asking Congress to put forth alternative, targeted spending reductions to avoid automatic cuts. And yet here we are, with Congress once again considering the myopic easy‐way‐out by waiving PAYGO as part of the omnibus spending bill.

With annual deficits projected at $1.6 trillion on average for each of the next 10 years, Congress should take steps now to rein in deficits and debt. Foregoing required spending cuts in FY23 and FY24 while at the same time increasing deficits yet further (see above) is heading in the wrong direction.

Most members of Congress will not read the bill before voting on it. As the Heritage Foundation’s David Ditch pointed out on Twitter, the 4,155 pages of legislative text are accompanied by another 2,670 pages of explanatory documents for 6,825 pages of omnibus content. Even the most dedicated members of Congress and their staff won’t be able to read through this massive spending package before they’ll be asked to vote for it before the end of this week.

And that’s intentional. The current legislative process does not intend for members of Congress to carefully deliberate policy decisions. The more time legislators would have to ponder the details of the bill, the more opposition to it would likely arise. Unless members of Congress refuse to pass bills they haven’t had a chance to read, this practice will continue. Unfortunately, some members prefer it this way. It’s more difficult for constituents to hold their representatives accountable for bad policy they had little chance of influencing.

Congress would waste taxpayer dollars on thousands of earmarks. Earmarks, also referred to as pork‐barrel spending or the currency of corruption, are specific spending requests by members of Congress that supersede competitive award processes and other guidelines. They have a history of waste and abuse. Congress should ban earmarks and focus time and energy on fixing the federal government’s unsustainable spending trajectory instead. Some examples of earmarks in this omnibus include:

$750,000 for the Connecticut Trolley Museum
$1,000,000 for the Rock and Roll Hall of Fame and Museum in Cleveland, OH
$4,000,000 for the Covina High School pool
$5,000,000 for the Upper Columbia United Tribes Salmon Reintroduction Project
$7,500,000 for the Jimmy Carter Presidential Library and Museum in Atlanta, GA

Congress would enact other legislation that is not related to appropriations, such as the Secure 2.0 Act. The omnibus is loaded down with additional legislation, such as the Secure 2.0 Act, which would make several changes to retirement account rules alongside policies to expand the welfare state. I wrote about three troubling provisions that look to hitch a ride on the omnibus here.

This monstrous omnibus is a perfect example of why lame duck legislating is terrible policy. Instead of rushing this bill through this week, Congress should punt on appropriations until 2023. Members should instead take time over the Christmas holiday to deeply reflect on their responsibilities and return refreshed in the new year with a strong fiscal agenda that would put the U.S. budget on a sustainable path and avert a future fiscal crisis.

The GOP’s omnibus betrayal is complete.

Senate Minority Leader Mitch McConnell, R-Ky., and 17 other Republicans joined Democrats as the Senate passed a $1.85 trillion monstrosity of a spending bill Thursday that does a whole lot more than just waste money. The vote was 68-29.

The bill moves to the House of Representatives, where the lame-duck, majority-Democrat ghost of Congress past almost certainly will vote in favor.

The omnibus spending bill effectively sets federal spending for all of fiscal year 2023, which began Oct. 1, kneecapping the new Congress not just on budget issues but oversight of the Biden administration and a whole lot more.

Merry Christmas.

Given that Republicans will take the House majority Jan. 3, the Senate Republicans who signed on to this bill effectively are saying they would rather that a fully Democrat-controlled Congress negotiate its final shape.

The Wall Street Journal’s Kimberley Strasselcalled the omnibus “one of the ugliest, least transparent bits of lawmaking I’ve ever seen”—which is saying something, given the usual nonsense on Capitol Hill. It’s that and much more.

If you’ve been following our work here at The Daily Signal, you know that the omnibus spending bill is filled with a huge amount of garbage. On top of the raw dollars at stake, it will fund all kinds of woke nonsense.

Just look at this Twitter thread from Rep. Chip Roy, R-Texas, on 55 out of thousands of earmarks attached to the omnibus. It’s like looking down a bottomless well of lunacy.

This is about more than just funding, too. The omnibus makes substantial changes to health care laws, government agencies, and the election process that will affect Americans for years to come.

One would think that this kind of legislation would merit more consideration than a last-minute term paper submitted by a hungover college freshman.

Despite all this, McConnell, as Senate minority leader, has insisted that Republicans are getting a good deal here.

Republicans who support the bill argue that the omnibus deal is a win because they increased some defense spending and got a cut in nondefense domestic spending.

But as Sen. Ron Johnson, R-Wis., points out, even this is a shallow victory. Because of inflation, the amount of money appropriated for defense is worth a good deal less than before the explosive inflation of the past two years.

You know it’s bad when Republicans are celebrating a 2% cut to the funding for theextensive IRS expansion. Great work; the republic is saved.

Some argue that, politically, it’s a good thing for Republicans that they caved on this bill. After all, the GOP got at least some things it wanted, and the last-minute deal prevented a government shutdown in the new year, the argument goes.

But that argument is based on a flawed premise.

In my observations of American politics over the past decade, the ironclad rule of Washington seems to be that whenever the government shuts down, the Republican Party pays the price. According to this view, the public will side with Democrats who want to spend more money, and it’s best to give them what they want to avoid bad press and defeats at the ballot box.

To my mind, this is a convenient excuse for Republican leadership that isn’t really concerned about reining in spending and is happy to get a few scraps at the table rather than resist the radicalism from the other side of the aisle.

As if it were not painful enough for Republicans to watch the vaunted red wave merely ripple across their ankles, they now must endure 2022’s final insult: A red wave of deficit spending courtesy of lame-duck House Democrats, triumphant Senate Democrat leader Chuck Schumer of New York, and Senate GOP “leader” Mitch McConnell of Kentucky.

Fiscal responsibility be damned, Democrats are riding one whale of an omnibus spending bill. The $1.7 trillion Consolidated Appropriations Act, 2023 washed in on Monday at 11:48 p.m.

Its 4,155 pages are thrice as long as Leo Tolstoy’s classic doorstop, “War and Peace.” This averages $409,145,607.70 per page. Taxpayers should be seasick.

The omnibus’ 3,213 Democrat earmarks include “federal funds for LGBTQ+ museums in New York, community spaces for gender-expansive people in Ohio,” the Club for Growth discovered, “and $3.5 million to fund the Office of Diversity and Inclusion in Congress.”

It also allocates:

—$300,000 for a “Continuous Plankton Recorder survey.”

—$3 million for bee-friendly highways.

—$3.6 million for the “Michelle Obama Trail” in Georgia.

—$212.1 million available for federal prosecutionsrelated to Jan. 6 —essentially an anti-Trump slush fund.

—$410 million for “enhanced border security” —in Egypt, Jordan, Lebanon, Oman, and Tunisia.

—$575 million for family planning “in areas where population growth threatens biodiversity or endangered species.”

—$1,563,143,000 for “border management requirements” that shall not “be used to acquire, maintain, or extend border security technology and capabilities.” So, $0 to stop illegal-alien invaders but $1.56 billion to “process” and rush them into the homeland.

Want border security? Move to Egypt.

Even worse, the omnibus runs through fiscal year 2023. The American people just gave Republicans a House majority of 222 versus Nancy Pelosi’s 218. But the omnibus snatches the GOP’s power of the purse until Oct. 1.

Voters hired a Republican House to tell President Joe Biden: “No DHS money until you seal the border. No HHS funds until you demand China’s answers on COVID-19’s origins. No Pentagon budget until it stops its newfangled, gender-bending ways. No FBI outlays until it sings about pressuring Twitter to censor the New York Post’s Hunter Biden laptop story.”

McConnell is helping Democrats castrate House Republicans for 10 months. If they took control on, say, Aug. 1, waiting two months might be tolerable. But they take the gavel 13 days from this writing.

Jan. 3 is two Tuesdays hence, just 48 hours after the Times Square ball drop. The Revolutionary Army is at Yorktown’s city limits, and McConnell is surrendering to General Cornwallis.

Despicable.

Even worse, this is anti-democratic.

Democrats screamed all fall about “democracy!” Now—along with their jumped-up bootblack, McConnell—they grind the popular will into the garbage disposal. Rather than scream, “Bloody murder!” McConnell laughs with Democrats as the Republican House’s fiscal-restraint tools slide into the sewer for half of its two-year mandate.

McConnell could lead 40 other GOP senators, filibuster this trash, and demand a short-term continuing resolution until the GOP House arrives. But that would take courage.

A half-eaten plate of calamari could lead the Senate GOP more valiantly than the live squid who now fails this duty. As McConnell gurgled in a floor speech on Monday: “The Senate should pass this bill.”

McConnell has turned the Senate GOP minority into the Make a Wish Foundation for Democrats. From helping to raise the national debt limit twice (in exchange for nothing), pass a $1 trillion infrastructure bill, and adopt the $52 billion CHIPS corporate-welfare extravaganza, McConnell repeatedly recruits enough gelatinous Republicans to help Democrat dreams come true.

McConnell rarely gets anything in return. When he trades horses, Schumer scores two stallions, and McConnell wins a wheelbarrow of fertilizer.

This is revolting, repugnant, and reprehensible. And, as 2024 approaches, this fiasco will convince the already demoralized GOP base that there really is no point in knocking on doors, manning phone banks, or voting Republican.

2021 Democrats control Government but has our National Debt reached a Tipping Point?

Is America Approaching the Tipping Point of Too Much Debt?

Yesterday, the Congressional Budget Office released updated budget projections. The most important numbers in that report show what’s happening with the overall fiscal burden of government – measured by both taxes and spending.

As you can see, there’s a big one-time spike in coronavirus-related spending this year. That’s not good news, but more worrisome is the the longer-run trend of government spending gradually climbing as a share of economic output (and the numbers are significantly worse if you look at CBO’s 30-year projection).

Most reporters and fiscal wonks overlooked the spending data, however, and instead focused on the CBO’s projection for government debt.

Since government spending is the problem and borrowing is merely a symptom of that problem, I think it’s a mistake to fixate on red ink.

That being said, Figure 3 from the CBO report shows that there’s also an upward-spike in federal debt.

And it is true (remember Greece) that high levels of debt can, by themselves, produce a crisis. This happens when investors suddenly stop buying government bonds because they think there’s a risk of default (which happens when a government is incapable or unwilling to make promised payments to lenders).

I think some nations are on the verge of having that kind of crisis, most notably Italy.

But what about the United States? Or Japan? And how’s the outlook for Europe’s welfare states?

In other words, what nations are approaching a tipping point?

A new study from the European Central Bank may help answer these questions. Authored by Pablo Burriel, Cristina Checherita-Westphal, Pascal Jacquinot, Matthias Schön, and Nikolai Stähler, it uses several economic models to measure the downside risks of excessive debt.

The 2009 global financial and economic crisis left a legacy of historically high levels of public debt in advanced economies, at a scale unseen during modern peace time. …The coronavirus (COVID-19) pandemic is a different type of shock that has dramatically affected global economic activity… Fiscal positions are projected to be strongly hit by the crisis…once the crisis is over and the recovery firmly sets in, keeping public debt at high levels over the medium term is a source of vulnerability… The main objective of this paper is to contribute to the stabilisation vs. sustainability debate in the euro area by reviewing through the lens of large scale DSGE models the economic risks associated with regimes of high public debt.

Here’s what they found, none of which should be a surprise.

…we evaluate the economic consequences of high public debt using simulations with three DSGE models… Our DSGE simulations also suggest that high-debt economies…can lose more output in a crisis…have less scope for counter-cyclical fiscal policy and…are adversely affected in terms of potential (long-term) output, with a significant impairment in case of large sovereign risk premia reaction and use of most distortionary type of taxation to finance the additional public debt burden in the future.

Here’s a useful chart from the study. It shows some sort of shock on the left (2008 financial crisis or coronavirus being obvious examples), which then produces a recession (lower GDP) and rising debt.

That outcome isn’t good for nations with “low” levels of debt, but it can be really bad for nations with “high” debt burdens because they have to deal with much higher interest payments, much bigger tax increases, and much bigger reductions in economic output.

For what it’s worth, I don’t think the study actually gives us any way of determining which nations are near the tipping point. That’s because “low” and “high” are subjective. Japan has an enormous amount of debt, yet investors don’t think there’s any meaningful risk that Japan’s government will default, so it is a “low” debt nation for purposes of the above illustration.

By contrast, there’s a much lower level of debt in Argentina, but investors have almost no trust in that nation’s especially venal politicians, so it’s a “high” debt nation for purposes of this analysis.

The United States, in my humble opinion, is more like Japan. As I wrote last year, “We probably won’t even have a crisis in the next 10 years or 20 years.” And that’s still my view, even after all the spending and debt for coronavirus.

The study concludes with some common-sense advice about using spending restraint and pro-market reforms to create buffers (some people refer to this as “fiscal space“).

Overall, once the COVID-19 crisis is over and the economic recovery firmly re-established, further efforts to build fiscal buffers in good times and mitigate fiscal risks over the medium term are needed at the national level. Such efforts should be guided by risks to debt sustainability. High debt countries, in particular, should implement a mix of fiscal discipline and wide-ranging growth-enhancing reforms.

Needless to say, there’s an obvious and successful way of achieving this goal.

P.S. Here’s another chart from the ECB study that is worth sharing because it confirms that not all tax increases do the same amount of economic damage.

We see that consumption taxes (red line) are bad, but income taxes on workers (green line) are even worse.

And if the study included an estimate of what would happen if there were higher income taxes on saving and investment, there would be another line showing even more economic damage.

P.P.S. History shows that nations can reduce very large debt burdens if they follow my Golden Rule.

P.P.P.S. There’s a related study from the IMF that shows how excessive spending is a major warning sign that nations will be vulnerable to fiscal crisis.

Positive Rights vs Negative Rights

Back in 2017, I compared the welfare state vision of “positive rights” with the classical liberal vision of “negative rights.”

To elaborate, here’s a video from Learn Liberty that compares these visions.

For what it’s worth, I don’t like the terms “positive rights” and “negative rights” for the simple reason that an uninformed person understandably might conclude that “positive” is good and “negative” is bad.

Needless to say, I don’t think it’s good for people to think they have a right to other people’s money.

That’s why I prefer Professor Skoble’s use of the terms “liberties” and “entitlements,” which we also find in this slide from Professor Imran Ahmad Sajid of the University of Pakistan.

As you might expect, there are plenty of politicians who try to buy votes with an agenda of “positive rights.” Bernie Sanders, for instance, constantly argued that people have a “right” to all sorts of goodies.

But he wasn’t the first to make the case for unlimited entitlements.

Franklin Roosevelt was one of America’s worst presidents, in part because his policies deepened and lengthened the Great Depression. But also because he pushed the idea that people have the right to get all sorts of taxpayer-financed handouts.

Let’s see what some other people have to say about this topic.

In his National Review column, Kevin Williamson looks at the logical fallacy of positive rights.

Positive rights run into some pretty obvious problems if you think about them for a minute, which is why so much of our political discourse is dedicated to moralistic thundering specifically designed to prevent such thinking. Consider, in the American context, the notion that health care is a right. Declaring a right in a scarce good such as health care is intellectually void, because moral declarations about rights do not change material facts.If you have five children and three apples and then declare that every child has a right to an apple of his own, then you have five children and three apples and some meaningless posturing — i.e., nothing in reality has changed, and you have added only rhetoric instead of adding apples. In the United States, we have so many doctors, so many hospitals and clinics, so many MRI machines, etc. This imposes real constraints on the provision of health care. If my doctor works 40 hours a week, does my right to health care mean that a judge can order him to work extra hours to accommodate my rights? For free? If I have a right to health care, how can a clinic or a physician charge me for exercising my right? If doctors and hospitals have rights of their own — for example, property rights in their labor and facilities — how is it that my rights supersede those rights?

And here’s what he says about “negative rights.”

A negative right is a right to not be constrained. The right to free speech, for example, implies only non-interference. The right to freedom of the press doesn’t mean the government has to give you a press. The good of negative freedom is, in the economic sense, not rivalrous — your exercise of free speech doesn’t leave less freedom of speech out there for others to enjoy

And Larry Reed opines on the issue for the Foundation for Economic Education.

America is a nation founded on the notion of rights. …Despite the centrality of rights in American history, it’s readily apparent todaythat Americans are of widely different views on what a right is, how many we have, where rights come from, or why we have any in the first place. …if you need something, does that mean you have a right to it? If I require a kidney, do I have a right to one of yours? Is a right something that can or should be granted or denied by majority vote?

He helpfully provides a list of negative rights (a.k.a., liberties).

And he argues that positive rights (a.k.a., entitlements) are not real rights.

The bottom line, he explains, is that so-called positive rights impose obligations on other people.

Indeed, they can only be provided by coercion.

The first list comprises what are often called both “natural rights” and “negative rights”—natural because they derive from our essential nature as unique, sensate individuals and negative because they don’t impose obligations on others beyond a commitment to not violate them. The items in the second are called “positive rights” because others must give them to you or be coerced into doing so if they decline. …while I believe neither you nor I have a right to any of those disparate things in the second list, I hasten to add that we certainly have the right to seek them, to create them, to receive them as gifts from willing benefactors, or to trade for them. We just don’t have a right to compel anyone to give them to us or pay for them.

There’s not much I can add to this issue, given the wisdom contained in the video and in the articles by Williamson and Reed.

So I’ll close with the should-be-obvious point that a system based on entitlements only works if there are enough people pulling the wagon to support all the people riding in the wagon.

But that kind of society contains the seeds of its own downfall(think Greece or Venezuela) because it subsidizes dependency and penalizes production.

Which means, as Margaret Thatcher warned us, that positive rights can’t be provided when politicians run out of other people’s money.

But perhaps motivated by the scandal of giving welfare to terrorists, this new video is the most amusing thing I’ve seen from across the ocean.

I almost didn’t post this because it singles out immigrants from the developing world, but since I’ve shared horror stories from home-grown moochers in the U.K., as well as examples of scroungers from Europe who are robbing British taxpayers, I think I’ve covered all the bases.

Dear Senator Richard Shelby,

Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back.

Rep. Dan Bishop co-signs letter suggesting omnibus spending bill is ‘indefensible assault’

Bishop wrote that:

“The American people did not elect us to continue the status quo in Washington. This omnibus spending bill is the worst of business as usual in Washington and is an indefensible assault on the American people. We will not abide it.
“The omnibus package, released this morning, includes another $47 billion for the war in Ukraine. It would bring our total Ukraine spending to more than $100 BILLION. One of many reasons to vote NO on this monstrosity of a bill.
“4,155 pages. $1.7 trillion. All produced in swampy backroom deals. For those happy with the status quo but wondering why Congress has a 75% disapproval rating – you should take a look in the mirror.

He continued to post about the bill and to analyze passages he found objectionable.

Electoral reform act

Although the other GOP representatives elected to serve the Triad next year – Virginia Foxx (R-Banner Elk) and Richard Hudson (R-Southern Pines) – did not immediately post positions about the omnibus bill, they joined Bishop (and outgoing Triad reps Ted Budd and Patrick McHenry) in opposing the Presidential Reform Act when it passed the House in September.

That bill was approved, 229-203, with only nine Republicans joining Democrats in supporting legislation to ensure that the process last overseen by Vice President Mike Pence on Jan. 6, 2021, when Congress confirmed the vote of the Electoral College, would go unimpeded.

Pence had declined requests by Trump and some of his allies that he reject the electors and delay the transfer of power to President Joe Biden, who decisively won in November 2020. Trump has claimed without evidence that the election results weren’t valid, a claim he still makes to this day despite no supporting evidence. That led to the insurrection at the Capitol.

There is a companion, bipartisan bill in the Senate that was introduced by Sen. Thom Tillis (R-N.C.) and 15 other senators to reform the rules established by Congress in 1887. It is in tandem with the “Enhanced Election Security and Protection Act,” to specify how to ensure that elections are safe.

This bill would:

Affirm the vice president’s role is ceremonial in the electoral certification and affirm the Jan. 6 date and procedure in Congress.
Specify the formal certification of electors and public inspection.
Formalizing the process for appealing any elector, including establishing the judicial panel to do so.
Provide for an extension of the election process based on a catastrophic event (which is specified as “a major natural disaster, a terrorist attack or a widespread power outage.”
Smooth existing deadlines, dates and processes for delivery of certified electors.
