Dear Senator Pryor,

Why not pass the Balanced  Budget Amendment? As you know that federal deficit is at all time high (1.6 trillion deficit with revenues of 2.2 trillion and spending at 3.8 trillion).

On my blog www.HaltingArkansasLiberalswithTruth.com I took you at your word and sent you over 100 emails with specific spending cut ideas. However, I did not see any of them in the recent debt deal that Congress adopted. Now I am trying another approach. Every week from now on I will send you an email explaining different reasons why we need the Balanced Budget Amendment. It will appear on my blog on “Thirsty Thursday” because the government is always thirsty for more money to spend.

Recently I read a great article from the Heritage Foundation on the Balanced Budget Amendment. Here is a portion of that article:

In the immediate term, Congress should address this problem by pursuing a reform path that drives down federal spending and borrowing and gets to a balanced budget. Saving the American Dream is Heritage’s plan to do just that: balancing the federal budget in 10 years and keeping it balanced in the future—without raising taxes or neglecting our national defense. Starting immediately, Congress should take every opportunity to cut and cap federal spending, and that includes addressing the unsustainable costs of America’s entitlement programs.

A part of the long-term agenda to rein in government is an appropriate and sound amendment to the Constitution that would keep federal spending under control in subsequent years. Indeed, the principal reason for adopting a balanced budget constitutional amendment is to limit the size and scope of the federal government by limiting its spending.

Proponents have long advocated this extraordinary step because other methods of controlling spending—by rule or statute—have broken down. What was once considered part of the nation’s “unwritten” constitution—that as a rule the government should not spend beyond its means—has been lost. A constitutional rule, if properly written and enforced, would have more power than any legislative mechanism for maintaining a limit on spending.

As Heritage’s David Addington has previously stated, a BBA should do three core things.

  1. First, it should control spending, taxation, and borrowing by capping annual spending and requiring Congress to act by supermajority votes if Members wish to raise taxes. These requirements are especially necessary under current circumstances—prior to having seriously reduced spending and reformed entitlement programs, the main drivers of the country’s debt.
  2. Second, it should allow Congress by supermajority votes to waive temporarily compliance with the balanced budget requirement when it is essential to national security—the one core function that is the federal government’s exclusive constitutional responsibility.
  3. Third, it should provide for its own enforcement, specifically excluding courts from any enforcement and preventing government from just borrowing more money to meet the BBA requirement.

A BBA without these provisions doesn’t address the underlying spending problem, puts pressure on Congress to increase taxes or issue more debt rather than cut spending or reform entitlements, and invites unelected judges to insert themselves even more in the policymaking process. Which is to say that, rather than simplifying matters, a weak BBA would likely make the situation much worse.

Congressman Walsh Issues Statement on His Vote Against Debt Deal

WASHINGTON–  Today, Congressman Joe Walsh (IL-08) voted against the latest debt ceiling deal brokered by President Obama and Congressional leaders.

“Last night’s deal shows how far the debate has moved in just a few months,” said Congressman Walsh. “At the beginning of this debate President Obama demanded a blank check increase in the debt limit with no spending cuts attached.  When that didn’t work, he insisted on huge tax increases on American families and job creators. The Republican Party, however, stood strong and refused to pay for reckless spending withmoretax increases.”

“While I give my Republican leadership all the credit in the world, I cannot support this latest deal: it spends too much and cuts too little.  While this deal will cut $2.4 trillion from the national debt over the next 10 years, Washington will still add another $7 trillion to the national debt over that same period.”

“The fact that there are only $7 billion in cuts next year, an election year, shows how blatantly political this bill is.  We need to be slashing reckless spending now and in the future, not just when it is politically convenient for the President.”

“Democrats still don’t get it and refuse to make the spending cuts necessary to avoid a credit downgrade. I have made it clear from day one that I will never vote for an increase in the debt ceiling unless it fundamentally and structurally changes the way Washington spends money. I believe that the way to do that is through statutory spending caps and a Balanced Budget Amendment to the Constitution.”

Burton Opposes Sham Deficit Reduction Deal

WASHINGTON, D.C. – Representative Dan Burton (R-IN-05) issued the following statement after the House of Representatives’ approved the deficit reduction deal negotiated with President Obama and Senate Democrats:

“Our nation has never defaulted in its history and we must take action to continue to meet our financial obligations.  However, in good conscience I could not support the deficit reduction package worked out this past weekend.  I have said repeatedly that Washington does not have a revenue problem, it has a spending problem and this bill does nothing to change the spending culture ingrained in Washington. 

“First, A Balanced Budget Amendment is the ONLY way to finally force Washington to live within its means.  However, unlike the Cut, Cap and Balance Act or the Boehner proposal passed by the House of Representatives, the deficit reduction deal does not require a Balanced Budget Amendment be sent to the States for ratification before the President is granted a debt ceiling increase; it merely requires a vote on a Balanced Budget Amendment.  Passing a Balanced Budget Amendment requires a 2/3rds vote in the House and Senate and a majority of Democrats have already expressed opposition to a Balanced Budget Amendment, so obtaining the necessary votes without significant leverage – such as the threat of default – is highly unlikely;

“Second, the deficit reduction deal does not prevent future tax increases or reduce the size of government.   In fact, the deficit reduction deal assumes that all the Bush tax cuts expire in December 2012.  In other words the additional revenue is already built into the bill which would make it difficult if not impossible to meet the deficit reduction targets AND extend the Bush tax cuts beyond 2012.  In addition, the suggestion that it is impossible for the Joint Committee to raise additional tax revenue simply is not accurate, it’s false;

“Third, the automatic spending cuts placed in the deal to force Congress to maintain fiscal discipline are unrealistic and unworkable.  Half of the proposed automatic cuts would come from defense programs which will undermine our ability to project power, strengthen our adversaries, and weaken our alliances.  Additional automatic cuts will come from Medicare providers; already underpaid by Medicare.  Historically Congress has rolled back any proposed cuts to Medicare providers and there is no reason to believe Congress won’t do so again.  It is also unrealistic to believe Congress will allow substantial cuts to defense spending while our troops are engaged in three wars (Iraq, Afghanistan, and Libya);

“Finally, the deficit reduction deal may be unconstitutional.  The deficit reduction deal allows the President to unilaterally raise the debt ceiling subject to a resolution of disapproval by the Congress (which the President can veto).  The debt limit is a statutory requirement and must therefore be changed by law.   ONLY Congress has the power to make law not the President; and Congress cannot, and most importantly should not, surrender this power to the president.

“The American people want a solution to this crisis, not a deal that allows Washington to kick the can down the road once again. Regrettably, the deficit reduction deal is not that solution.”

Congressman Walsh Introduces Balanced Budget Amendment

 Washington, D.C. –  As part of his ongoing effort to restore fiscal responsibility in Washington, Congressman Joe Walsh (R-IL) today introduced H.J.Res.54, a Balanced Budget Amendment to the United States Constitution that provides a framework for putting our country on a path economic stability. This amendment is the House-companion to the Senate amendment that all 47 Republicans unanimously introduced last week, which would require the President to submit a balanced budget to Congress prior to each fiscal year.

“The federal government cannot continue to burden our children with this crushing deficit,” said Congressman Walsh. “American families have been working through a recession for the past three years by spending less and saving more, yet the federal government continues to spend money it simply does not have. Congress has neglected the real root cause and continues to be part of the problem, not part of the solution.”

“This amendment is the solution. If the average American family has to find a way to balance their checkbook each year and live within their means, there is no reason that the federal government can’t do the same.”    

“It was important to me that my first piece of legislation as a United States Congressman serves the American people by easing the burden of the government in their daily lives.A key provision to this amendment is to ensure that the budget is not balanced on the backs of hard working Americans, and thus H.J.Res.54 would require a 2/3 super-majority in both Houses for any tax increase.”

“Most importantly, this amendment shows families and businesses across America that Congress is serious about stabilizing our economy long-term. It’s time to bring our country out of the red.”

The Balanced Budget Amendment resolution features the following key provisions:

  • Presidential requirement to submit a balanced budget and Congressional requirement to pass a balanced budget;
  • Federal spending cap that Congress must limit outlays to no more than 18 percent of GDP, in line with the historical average of revenues over the last 40 years (this year, the federal government is projected to spend close to 25% of GDP);
  • Prohibits the courts from ordering revenue increases.

The Debt Ceiling and the Balanced Budget Amendment

The Washington Post editorializes:

A balanced-budget amendment would deprive policymakers of the flexibility they need to address national security and economic emergencies.

A fair point. Statesmen should have the ability to “address national security and economic emergencies.” But the same day’s paper included this graphic on the growth of the national debt:

Does this look like the record of policymakers making sensible decisions, running surpluses in good year and deficits when they have to “address national security and economic emergencies”? Of course not. Once Keynesianism gave policymakers permission to run deficits, they spent with abandon year after year. And that’s why it makes sense to impose rules on them, even rules that leave less flexibility than would be ideal if you had ideal statesmen. Indeed, the debt ceiling itself should be that kind of rule, one that limits the amount of debt policymakers can run up. But it has obviously failed.

We’ve become so used to these stunning, incomprehensible, unfathomable levels of deficits and debt — and to the once-rare concept of trillions of dollars — that we forget how new all this debt is. In 1980, after 190 years of federal spending, the national debt was “only” $1 trillion. Now, just 30 years later, it’s sailing past $14 trillion.

Historian John Steele Gordon points out how unnecessary our situation is:

There have always been two reasons for adding to the national debt. One is to fight wars. The second is to counteract recessions. But while the national debt in 1982 was 35% of GDP, after a quarter century of nearly uninterrupted economic growth and the end of the Cold War the debt-to-GDP ratio has more than doubled.

It is hard to escape the idea that this happened only because Democrats and Republicans alike never said no to any significant interest group. Despite a genuine economic emergency, the stimulus bill is more about dispensing goodies to Democratic interest groups than stimulating the economy. Even Sen. Charles Schumer (D., N.Y.) — no deficit hawk when his party is in the majority — called it “porky.”

Annual federal spending rose by a trillion dollars when Republicans controlled the government from 2001 to 2007. It has risen another trillion during the Bush-Obama response to the financial crisis. So spending every year is now twice what it was when Bill Clinton left office. Republicans and Democrats alike should be able to find wasteful, extravagant, and unnecessary programs to cut back or eliminate. They could find some of them here in this report by Chris Edwards.

In the Kentucky Resolutions, Thomas Jefferson wrote, “In questions of power, then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the Constitution.” Just so. When it becomes clear that Congress as a body cannot be trusted with the management of the public fisc, then bind them down with the chains of the Constitution, even — or especially — chains that deny them the flexibility they have heretofore abused.

Dear Mr. Hatcher,

Thank you for contacting me regarding a Constitutional amendment requiring a balanced federal budget. I appreciate hearing from you.

I am deeply concerned about current spending levels and our ever-growing national debt, and I believe Congress can and should balance the federal budget. As a nation, we have been living beyond our means for a long time. Balancing the budget will require both parties to work together to achieve this goal.

Amending the Constitution is a step that should never be taken lightly. A poorly drafted balanced budget amendment could prevent the federal government from being able to respond appropriately to national emergencies, cause drastic cuts to important programs, such as Social Security and Medicare, and result in an automatic tax increase. However, I remain open to considering a balanced budget amendment, and will give my full attention and thought to any balanced budget amendments the Senate considers.

In the meantime, I will continue to introduce legislation to eliminate ineffective and unnecessary programs, and use my position in Congress to further reduce wasteful spending. I appreciate hearing from you. Your input helps me make better decisions, and I will be sure to keep your specific comments in mind as I work to come up with better fiscal solutions for the American people.

Hultgren Statement On Opposition To Budget Control Act

Washington, D.C. – U.S. Rep. Randy Hultgren (IL-14) released the following statement after voting against the Budget Control Act.

“Tonight, I voted against a flawed bill that doesn’t go far enough,” said Hultgren. “I’ve been clear from the very beginning I would not support any effort to increase our nation’s debt ceiling if the proposal does not hold true to the values of Cut, Cap, and Balance, as well as enact serious structural changes.

“It is my opinion that the proposal approved by the House tonight falls short of what we need to do to put our country back on the right track. By failing to require Congress to approve a Balanced Budget Amendment (BBA) prior to any further increases in the debt ceiling, this bill does not provide the structural changes that I stated were necessary to earn my support.

“When leadership changed the bill on Thursday night to strengthen the BBA provision, that change earned my support; in failing to keep that strong language, I could not, in good conscience, support this bill.”

(CNSNews.com) – Rep. Louie Gohmert (R-Texas) will not vote for a balanced budget amendment proposal unless it includes a cap on federal spending. However, he is undecided whether the amendment absolutely must require a supermajority of Congress to approve a tax hike for him to support it.

“The most important element is the cap on spending,” Gohmert told CNSNews.com. “If there is no cap on spending, then the balanced budget amendment is a formula for ever- increasing spending and ever-increasing taxing that will just spiral upward and upward again. So there’s got to be included a cap on spending, and best if it’s related to a percentage of GDP. But, absolutely, if there is no cap on spending, I could not vote for it.”

The actual language of the balanced budget amendment that Congress will vote on before the end of the year has not yet been determined. However, many conservatives fear that Republican leaders may agree to vote on a stripped down amendment that requires Congress to balance the budget but does not cap spending as a percentage of GDP or require supermajorities to raise taxes. They fear that an amendment of that nature–which might win the backing of some incumbent congressional liberals–would become a constitutional lever for sustaining big government via ever-escalating federal taxation.

When the Republican-controlled-House approved the cut, cap and balance plan last on July 19 in 234-190 vote, it included a version of the balanced budget amendment to cap federal spending at 19.9 percent of GDP. The GOP originally sought to hold federal spending to 18 percent of GDP.

The version of the balanced budget amendment in the cut, cap and balance plan also required two-thirds majorities in both houses to approve a tax increase. The amendment also would have prohibited deficit spending unless there was a national security emergency or a supermajority of Congress voted for it. On July 22, the Senate voted 51-46 to approve a procedural motion that blocked substantive consideration of the cut, cap and balance bill in that body.

The debt-limit deal reached by President Barack Obama, House Speaker John Boehner (R-Ohio) and Senate Majority Leader Harry Reid (D-Nev.) requires that both houses of Congress give an up or down vote to a balanced budget amendment before the end of the year. However, it does not specify what the language of the amendment would be.

If two-thirds of Congress votes to approve a balanced budget amendment, it would then have to be ratified by 38 states, or three-fourths.

The House passed that debt-limit deal by a 269-161 vote on Aug. 1. Gohmert was one of 66 Republicans who voted against it.

“As far as the supermajority to raise taxes, that’s our preference, but the key element, the most important element is the cap on spending,” Gohmert said. “If there is no supermajority to raise taxes then I’d just have to look at it more closely to see what all was there to see if it was something I could vote for or not.”

Gohmert believes this is a winning issue for Republicans.

“Well, I think it’s like this: We either have a legitimate Balanced Budget Amendment pass with a cap on spending, or I really believe if it does not pass, you will see many of those who voted against it turned out both in the House and Senate in the next election,” Gohmert said. “So I think it’s an either/or. Either people vote for it and it passes, or we have a significant change in the people that are in the House and Senate that voted against it.”

We have stared hard into the abyss of a national default, and the close call with financial Armageddon is starting to make a balanced-budget amendment look good.

A stringent restriction on public borrowing, if properly crafted, offers the hope for more fiscal responsibility, less wasteful spending and a slightly less terrifying budgetary process. Yet while a well-crafted amendment looks a little better, there are enormous challenges in creating a sensible measure that balances fiscal restraint with the ability to adapt to new circumstances.

Balanced-budget amendments have been in circulation for decades; Minnesota Representative Harold Knutson proposed a constitutional limit on borrowing back in 1936. In 1982, the Senate approved an amendment requiring that “prior to each fiscal year, the Congress shall adopt a statement of receipts and outlays for that year in which total outlays are no greater than total receipts,” but that proposal died in the House. In 1995, the House passed an amendment requiring that “total outlays for any fiscal year shall not exceed total receipts for that fiscal year;” it failed in the Senate.

The possibility of a balanced-budget amendment is back, and the case today seems a lot stronger than it did in the 1980s and 1990s. I rarely favor changing the Constitution, which can lead to fits of folly like the 18th Amendment that brought about prohibition. Moreover, Congress can run a balanced budget any time it wants simply by cutting spending and raising taxes.

Broken Process

Throughout most of my life, the debt has seemed manageable and the budgetary process seemed to work, more or less. The robust deficits of the Reagan era were reduced with a bipartisan deal signed by President George H.W. Bush. During the Clinton years, the combination of a centrist Democrat who cared about bond markets and an empowered Republican House led to budget surpluses.

During those years, it seemed clear that deficits were rarely the real enemy. The big social costs from big government came from wasteful spending, not from financing that spending with taxes today or tomorrow. If you spend $100 million on a bridge to nowhere, it doesn’t much matter if that bridge is paid for with taxes or debt.

The best argument for balanced budgets is that forcing governments to pay for their spending with current taxes will produce less wasteful spending. The past decade has done much to illustrate the allure of spending without taxation in Washington. The rotation of the parties was supposed to cycle gently back and forth between Democratic generosity and Republican thrift, but that model disappeared in the 1980s. Instead, Democratic taxing and spending is succeeded by Republican spending and not taxing.

Political Pandering

And it’s hard to give any government much credit for cutting taxes without cutting spending. That’s not political courage; it’s pandering.

If we were confident that federal spending was delivering great bang for the buck and that the U.S. was going to be much richer in the future, then perhaps high interest payments could be accepted as the cost of a better tomorrow. But there is plenty of federal spending that could be cut, such as agricultural subsidies, new highway construction and subsidies for homebuilding inTexas. Surely, not every dollar of defense procurement is absolutely necessary.

State Beneficiaries

Another reason to favor more federal fiscal restraint is that we could use a better balance between state and federal spending. Over the past 50 years, the federal government has become heavily involved in financing infrastructure, even when those projects overwhelmingly serve in-state users and could be funded with user fees. Why is it so obvious that the federal government has a role in funding rail between Tampa and Orlando, or a big tunnel in Boston?

Washington’s prominence is explained primarily by the federal government’s ability to borrow, and not by any inherent edge it has in infrastructure development. Federalizing expenditures breaks the connection between the projects’ funders and the projects’ users. Any instance when we’re spending other people’s money is an invitation for waste.

States and localities saddled with balanced-budget rules are relatively parsimonious and spend a fair amount of time debating even relatively modest public investments. That’s far more desirable than the federal government’s freedom to distribute billions without imposing taxes on voters.

Responding to Downturns

The current system’s pathologies should leave us open to the possibility of a new budgeting procedure, but the literature on state balanced-budget rules teaches us that the devil is in the details. In many cases, the state rules have weak teeth, and do little. When they do work, they can seriously constrain a state’s ability to respond to downturns.

During the recent collapse, the federal ability to borrow has thrown a lifeline to local governments, leading to greater preservation of important local services, such as education. Although the federal government could benefit from a little less budgetary freedom, the states either need more ability to borrow during downturns or more investment in rainy-day funds.

Any federal balanced-budget amendment should allow the government to spend more than it collects in taxes during wars and recessions, with the understanding that it will spend less during peaceful times of plenty. If the budget is to be balanced, it should be balanced over the business cycle, not year by year.

State of Emergency

But the crafting of such an amendment won’t be easy. The most natural out, perhaps, is to allow Congress to declare an economic emergency, which would temporarily eliminate the budgetary straightjacket. But then what’s to prevent lawmakers from declaring a perpetual state of emergency?

Another worry is that freezing the federal ability to borrow will create more pseudo-borrowing through semi-public entities, such as the mortgage lenders Fannie Mae and Freddie Mac.

I dreaded the prospect of default and would love to see a system that ensures the books are regularly balanced except during extreme times. A balanced-budget amendment might make that happen, but it would have to be done right. It would be far better if we could just count on Congress to live within its means, but the fiscal experience of the last decade has made such optimism untenable.
