Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

The federal government debt is growing so much that it is endangering us because if things keep going like they are now we will not have any money left for the national defense because we are so far in debt as a nation. We have been spending so much on our welfare state through food stamps and other programs that I am worrying that many of our citizens are becoming more dependent on government and in many cases they are losing their incentive to work hard because of the welfare trap the government has put in place. Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back. It seems to me we have to get back to the founding  principles that made our country great.  We also need to realize that a big government will encourage waste and corruption. The recent scandals in our government have proved my point. In fact, the jokes you made at Ohio State about possibly auditing them are not so funny now that reality shows how the IRS was acting more like a monster out of control. Also raising taxes on the job creators is a very bad idea too. The Laffer Curve clearly demonstrates that when the tax rates are raised many individuals will move their investments to places where they will not get taxed as much.

The IRS Can’t Plead Incompetence

If the agency didn’t know what it was doing, it wouldn’t have done it so well.

Quickly: Everyone agrees the Internal Revenue Service is, under current governmental structures, the proper agency to determine the legitimacy of applications for tax-exempt status. Everyone agrees the IRS has the duty to scrutinize each request, making sure that the organization meets relevant criteria. Everyone agrees groups requesting tax-exempt status must back up their requests with truthful answers and honest information.

Some ask, “Don’t conservatives know they have to be questioned like anyone else?” Yes, they do. Their grievance centers on the fact they have not been. They were targeted, and their rights violated.

The most compelling evidence of that is what happened to the National Organization for Marriage. Its chairman, John Eastman, testified before the House Ways and Means Committee, and the tale he told was different from the now-familiar stories of harassment and abuse.

In March 2012, the organization, which argues the case for traditional marriage, found out its confidential tax information had been obtained by the Human Rights Campaign, one of its primary opponents in the marriage debate. The HRC put the leaked information on its website—including the names of NOM donors. The NOM not only has the legal right to keep its donors’ names private, it has to, because when contributors’ names have been revealed in the past they have been harassed, boycotted and threatened. This is a free speech right, one the Supreme Court upheld in 1958 after the state of Alabama tried to compel the NAACP to surrender its membership list.

The NOM did a computer forensic investigation and determined that its leaked IRS information had come from within the IRS itself. If it was leaked by a worker or workers within the IRS it would be a federal crime, with penalties including up to five years in prison.

In April 2012, the NOM asked the IRS for an investigation. The inspector general’s office gave them a complaint number. Soon they were in touch. Even though the leaked document bore internal IRS markings, the inspector general decided that maybe the document came from within the NOM. The NOM demonstrated that was not true.

For the next 14 months they heard nothing about an investigation. By August 2012, the NOM was filing Freedom of Information Act requests trying to find out if there was one. The IRS stonewalled. Their “latest nonresponse response,” said Mr. Eastman, claimed that the law prohibiting the disclosure of confidential tax returns also prevents disclosure of information about who disclosed them. Mr. Eastman called this “Orwellian.” He said that what the NOM experienced “suggests that problems at the IRS are potentially far more serious” than the targeting of conservative organizations for scrutiny.

In hearings Thursday, Rep. Elijah Cummings, a Maryland Democrat who disagrees with the basic stand of the NOM, said that what had happened to the organization was nonetheless particularly offensive to him. The new IRS director agreed he would look into it.

Almost a month after the IRS story broke—a month after the high-profile scandal started to unravel after a botched spin operation that was meant to make the story go away—no one has been able to produce a liberal or progressive group that was targeted and thwarted by the agency’s tax-exemption arm in the years leading up to the 2012 election. The House Ways and Means Committee this week held hearings featuring witnesses from six of the targeted groups. Before the hearing, Republicans invited Democrats to include witnesses from the other side. The Democrats didn’t produce one. The McClatchy news service also looked for nonconservative targets. “Virtually no organizations perceived to be liberal or nonpartisan have come forward to say they were unfairly targeted,” it reported. Liberal groups told McClatchy “they thought the scrutiny they got was fair.”

Some sophisticated Democrats who’ve worked in executive agencies have suggested to me that the story is simpler than it seems—that the targeting wasn’t a political operation, an expression of political preference enforced by an increasingly partisan agency, its union and assorted higher-ups. A former senior White House official, and a very bright man, said this week he didn’t believe it was mischief but incompetence. But why did all the incompetent workers misunderstand their jobs and their mission in exactly the same way? Wouldn’t general incompetence suggest both liberal and conservative groups would be abused more or less equally, or in proportion to the number of their applications? Wouldn’t a lot of left-wing groups have been caught in the incompetence net? Wouldn’t we now be hearing honest and aggrieved statements from indignant progressives who expected better from their government?

Some person or persons made the decision to target, harass, delay and abuse. Some person or persons communicated the decision. Some persons executed them. Maybe we’re getting closer. John McKinnon and Dionne Searcey of The Wall Street Journal reported this week that IRS employees in the Cincinnati office—those are the ones that tax-exempt unit chief Lois Lerner accused of going rogue and attempted to throw under the bus—have told congressional investigators that agency officials in Washington helped direct the probe of the tea-party groups. Mr. McKinnon and Ms. Searcey reported that one of the workers told investigators an IRS lawyer in Washington, Carter Hull, “closely oversaw her work and suggested some of the questions asked applicants.”

“The IRS didn’t respond to a request for comment,” they wrote. There really is an air about the IRS that they think they are The Untouchables.

Some have said the IRS didn’t have enough money to do its job well. But a lack of money isn’t what makes you target political groups—a directive is what makes you do that. In any case, this week’s bombshell makes it clear the IRS, from 2010 to 2012, the years of prime targeting, did have money to improve its processes. During those years they spent $49 million on themselves—on conferences and gatherings, on $1,500 hotel rooms and self-esteem presentations. “Maliciously self-indulgent,” said Chairman Darrell Issa at Thursday’s House Oversight and Government Reform Committee hearings.

What a culture of entitlement, and what confusion it reveals about what motivates people. You want to increase the morale, cohesion and self-respect of IRS workers? Allow them to work in an agency that is famous for integrity, fairness and professionalism. That gives people spirit and guts, not “Star Trek” parody videos.

Finally, this week Russell George, the inspector general whose audit confirmed the targeting of conservative groups, mentioned, as we all do these days, Richard Nixon’s attempt to use the agency to target his enemies. But part of that Watergate story is that Nixon failed. Last week David Dykes of the Greenville (S.C.) News wrote of meeting with 93-year-old Johnnie Mac Walters, head of the IRS almost 40 years ago, in the Nixon era. Mr. Dykes quoted Tim Naftali, former director of the Nixon Presidential Library and Museum, who told him the IRS wouldn’t do what Nixon asked: “It didn’t happen, not because the White House didn’t want it to happen, but because people like Johnnie Walters said ‘no.’ ”

That was the IRS doing its job—attempting to be above politics, refusing to act as the muscle for a political agenda.

Man—those were the days.

In 1980 I read the book FREE TO CHOOSE by Milton Friedman and it really enlightened me a tremendous amount.  I suggest checking out these episodes and transcripts of Milton Friedman’s film series FREE TO CHOOSE: “The Failure of Socialism” and “What is wrong with our schools?”  and “Created Equal”  and  From Cradle to Grave, and – Power of the Market.“If we could just stop the printing presses, we would stop inflation,” Milton Friedman says in “How to Cure Inflation” from the Free To Choose series. Now as then, there is only one cause of inflation, and that is when governments print too much money. Milton explains why it is that politicians like inflation, and why wage and price controls are not solutions to the problem.

In this episode Friedman talks about taxation without representation: Getting knocked up to higher tax brackets because of inflation!!!!

While many people have a fairly good grasp of what inflation is, few really understand its fundamental cause. There are many popular scapegoats: labor unions, big business, spendthrift consumers, greed, and international forces. Dr. Friedman explains that the actual cause is a government that has exclusive control of the money supply. Friedman says that the solution to inflation is well known among those who have the power to stop it: simply slow down the rate at which new money is printed. But government is one of the primary beneficiaries of inflation. By inflating the currency, tax revenues rise as families are pushed into higher income tax brackets. Thus, inflation transfers wealth and resources from the private to the public sector. In short, inflation is attractive to government because it is a way of increasing taxes without having to pass new legislation to raise tax rates. Inflation is in fact taxation without representation. Wage and price controls are not the cure for inflation because they treat only the symptom (rising prices) and not the disease (monetary expansion). History records that such controls do not work; instead, they have perverse effects on both prices and economic growth and undermine the fundamental productivity of the economy. There is only one cure for inflation: slow the printing presses. But the cure produces the painful side effects of a temporary increase in unemployment and reduced economic growth. It takes considerable political courage to undergo the cure. Friedman cites the example of Japan, which successfully underwent the cure in the mid-seventies but took five years to squeeze inflation out of the system. Inflation is a social disease that has the potential for destroying a free society if it is unchecked. Prolonged inflation undermines belief in the basic equity of the free market system because it tends to destroy the link between effort and reward. Volume 9 – How to Cure Inflation

Friedman: The Sierra Nevada’s in California 10,000 feet above sea level, in the winter temperatures drop to 40 below zero, in the summer the place bakes in the thin mountain air. In this unlikely spot the town of Body sprang up. In its day Body was filled with prostitutes, drunkards and gamblers part of a colorful history of the American West.
A century ago, this was a town of 10,000 people. What brought them here? Gold. If this were real gold, people would be scrambling for it. The series of gold strikes throughout the West brought people from all over the world, all kinds of people. They came here for one purpose and one purpose only, to strike it rich, quick. But in the process, they built towns, cities, in places where nobody would otherwise have dreamed of building a city. Gold built these cities and when the gold was exhausted, the cities collapsed and became ghost towns. Many of the people who came here ended up the way they began, broke and unhappy. But a few struck it rich. For them, gold was real wealth. But was it for the world as a whole. People couldn’t eat the gold, they couldn’t wear the gold, they couldn’t live in houses made of gold. Because there was more gold, they had to pay a little more gold to buy goods and services. The prices of things in terms of gold went up.
At tremendous cost, at sacrifice of lives, people dug gold out of the bowels of the earth. What happened to that gold? Eventually, at long last, it was transported to distant places only to be buried again under the ground. This time in the vaults of banks throughout the world. There is hardly anything that hasn’t been used for money; rock salt in Ethiopia, brass rings in West Africa, Calgary shells in Uganda, even a toy cannon. Anything can be used as money. Crocodile money in Malaysia, absurd isn’t it?
That beleaguered minority of the population that still smokes may recognize this stuff as the raw material from which their cigarettes are made. But in the early days of the colonies, long before the U.S. was established, this was money. It was the common money of Virginia, Maryland and the Carolinas. It was used for all sorts of things. The legislature voted that it could be used legally to pay taxes. It was used to buy food, clothing and housing. Indeed, one of the most interesting sites was to see the husky young fellows at that time, lug 100 pounds of it down to the docks to pay the costs of the passage of the beauteous young ladies who had come over from England to be their brides.
Now you know how money is. There’s a tendency for it to grow, for more and more of it to be produced and that’s what happened with this tobacco. As more tobacco was produced, there was more money. And as always when there’s more money, prices went up. Inflation. Indeed, at the very end of the process, prices were 40 times as high in terms of tobacco as they had been at the beginning of the process. And as always when inflation occurs, people complained. And as always, the legislature tried to do something. And as always, to very little avail. They prohibited certain classes of people from growing tobacco. They tried to reduce the total amount of tobacco grown, they required people to destroy part of their tobacco. But it did no good. Finally, many people took it into their own hands and they went around destroying other people’s tobacco fields. That was too much. Then they passed a law making it a capital offense, punishable by death, to destroy somebody else’s tobacco. Grecian’s Law, one of the oldest laws in economics, was well illustrated. That law says that cheap money drives out dear money and so it was with tobacco. Anybody who had a debt to pay, of course, tried to pay it in the worst quality of tobacco he had. He saved the good tobacco to sell overseas for hard money. The result was that bad money drove out good money.
Finally, almost a century after they had started using tobacco as money, they established warehouses in which tobacco was deposited in barrels, certified by an inspector according to his views as to it’s quality and quantity. And they issued warehouse certificates which people gave from one to another to pay for the bills that they accumulated.
These pieces of green printed paper are today’s counterparts of those tobacco certificates. Except that they bear no relation to any commodity. In this program I want to take you to Britain to see how inflation weakens the social fabric of society. Then to Tokyo, where the Japanese have the courage to cure inflation. To Berlin, where there is a lesson to be learned from the West Germans and how so called cures are often worse than the disease. And to Washington where our government keeps these machines working overtime. And I am going to show you how inflation can be cured.
The fact is that most people enjoy the early stages of the inflationary process. Britain, in the swinging 60’s, there was plenty of money around, business was brisk, jobs were plentiful and prices had not yet taken off. Everybody seemed happy at first. But by the early 70’s, as the good times rolled along, prices started to rise more and more rapidly. Soon, some of these people are going to lose their jobs. The party was coming to an end.
The story is much the same in the U.S. Only the process started a little later. We’ve had one inflationary party after another. Yet we still can’t seem to avoid them. How come?
Before every election our representatives would like to make us think we are getting a tax break. When they are able to do it, while at the same time actually raising our taxes because of a bit of magic they have in their kit bag. That magic is inflation. They reduced the tax rates but the taxes we have to pay go up because we are automatically shoved into higher brackets by the effective inflation. A neat trick. Taxation without representation.

Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

The federal government debt is growing so much that it is endangering us because if things keep going like they are now we will not have any money left for the national defense because we are so far in debt as a nation. We have been spending so much on our welfare state through food stamps and other programs that I am worrying that many of our citizens are becoming more dependent on government and in many cases they are losing their incentive to work hard because of the welfare trap the government has put in place. Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back. It seems to me we have to get back to the founding  principles that made our country great.  We also need to realize that a big government will encourage waste and corruption. The recent scandals in our government have proved my point. In fact, the jokes you made at Ohio State about possibly auditing them are not so funny now that reality shows how the IRS was acting more like a monster out of control. Also raising taxes on the job creators is a very bad idea too. The Laffer Curve clearly demonstrates that when the tax rates are raised many individuals will move their investments to places where they will not get taxed as much.

I have written about 66 heroes of mine in the House of Representatives that voted “no” on your debt ceiling increase request in 2011. I believe we must have representatives that will vote to restore our freedom and that means voting to cut spending and lower taxes like the Patriots of long ago wanted. Today the Tea Party represented my views the most closely.  Lord knows I have written a lot about that in the past. . I have praised over and over and over the 66 House Republicans that voted no on that before. If they did not raise the debt ceiling then we would have a balanced budget instantly.  I agree that the Tea Party has made a difference and I have personally posted 49 posts on my blog on different Tea Party heroes of mine.

I have written and emailed Senator Pryor over, and over again with spending cut suggestions but he has ignored all of these good ideas in favor of keeping the printing presses going as we plunge our future generations further in debt. I am convinced if he does not change his liberal voting record that he will no longer be our senator in 2014.

I have written hundreds of letters and emails to you and I must say that I have been impressed that you have had the White House staff answer so many of my letters. The White House answered concerning Social Security (two times), Green Technologies, welfare, small businesses, Obamacare (twice),  federal overspending, expanding unemployment benefits to 99 weeks,  gun control, national debt, abortion, jumpstarting the economy, and various other  issues.   However, your policies have not changed, and by the way the White House after answering over 50 of my letters before November of 2012 has not answered one since.    You are committed to cutting nothing from the budget that I can tell.

 I have praised over and over and over the 66 House Republicans that voted no on that before. THIS BRINGS ME TO ONE OF MY BIGGEST ECONOMIC HEROES AND IT IS THE LATE MILTON FRIEDMAN. Friedman had such revolutionary policies such as eliminating welfare and instituting the negative income tax and putting in school vouchers.

The problem in Washington is not lack of revenue but our lack of spending restraint. This video below makes that point.

I like Milton Friedman’s comments on this issue of immigration   and Ron Paul and Dan Mitchell do well on the issue too.

A reader from overseas wonders about my views on immigration, particularly amnesty.

I confess that this is one of those issues where I’m conflicted.

On the general topic of immigration, I think the United States has benefited in the past – and can benefit in the future – from newcomers. And I express that position in this interview for Fox Business News.

But the real issue, which isn’t addressed in the interview, is magnitude. I assume almost nobody wants zero immigration. On the other hand, I also assume that very few people favor totally open borders.

So where do we draw the line? I think we should welcome lots of immigration, particularly people with skills, education, and money. This is the approach that is used to varying degrees by nations such as Australia, Canada, and Switzerland, and I wrote favorably about a similar proposal by Congressman Jared Polis, a Democrat from Colorado.

And I think substantial numbers of low-skilled people who want to work also should be welcome, but I don’t think everybody in the world who wants to come to America should have that right. I haven’t met more than a tiny handful of folks who disagree with Walter Williams’ assertion that, “not…everyone on the planet had a right to live in the U.S.”

Particularly since politicians have redistribution systems that can lure people into a life of dependency. Which is presumably why Milton Friedman warned, to the dismay of some other libertarians, “You cannot simultaneously have free immigration and a welfare state.”

Even the Wall Street Journal, which is a leading voice for both increased immigration and amnesty for existing illegals, also is concerned that a growing welfare state could attract immigrants for the wrong reasons.

Speaking of amnesty, I suppose I should answer the question of how I would deal with people who are in the country illegally? And my response probably depends whether I answer with my heart or my head.

My heart tells me to give these people the benefit of the doubt. Every illegal I’ve met seems to be a good person. And I know if I lived someplace like Mexico, Somalia, or Honduras, I almost certainly would want to improve my family’s position by getting to America, legally or illegally.

On the other hand, I believe in the rule of law and I’m a bit uncomfortable rewarding those who jumped the line at the expense of those who followed the rules.

And to be perfectly honest, I also worry about the political implications of any policy that increases the number of people who – on net – will vote for redistribution. I could do without the partisan implications, but this Chuck Asay cartoon captures my concerns.

I also think that people respond to incentives. Another round of amnesty almost surely will encourage further illegal immigration. Putting myself in the position of a poor person in the developing world, I would logically conclude that it would just be a matter of time, so I would sneak across the border in order to take advantage of that future amnesty.

That doesn’t strike me as a good approach. Far better to figure out how to genuinely reform the system.

By the way, a senior staffer on Capitol Hill floated to me the idea of a new status that enables illegals to stay in the country, but bars them from citizenship unless they get in line and follow the rules. I’m definitely not familiar with the fault lines on these issues, but perhaps that could be a good compromise.

And it goes without saying that I want the strictest possible limits on access to welfare programs and other government handouts for immigrants, regardless of their status.

So, like everybody else, I want border security and some form of legalization as part of a new system that brings people to America for the right reason. See, I’m the epitome of reasonableness.

Back in 1980 I read the book “Free to Choose” by Milton and Rose Friedman. I noticed that Milton made it clear both in the book and in the film series of the same name that immigration was good for America in the past. However, since the USA changed to a welfare state, we could no longer have a tremendous amount of legal immigration because it was overload the welfare state!!!!

Milton Friedman in a lecture at Stanford asserted:

“I’ve always been amused by a kind of a paradox. Suppose you go around and ask people: ‘The United States before 1914, as you know, had completely free immigration. Anybody could get in a boat and come to these shores and if landed at Ellis Island he was an immigrant. Was that a good thing or a bad thing?”

You will find that hardly a soul who will say that it was a bad thing. Almost everybody will say it was a good thing. ‘But what about today? Do you think we should have free immigration?’ ‘Oh, no,’ they’ll say, ‘We couldn’t possibly have free immigration today. Why, that would flood us with immigrants from India, and God knows where. We’d be driven down to a bare subsistence level.’

What’s the difference? How can people be so inconsistent? Why is it that free immigration was a good thing before 1914 and free immigration is a bad thing today? Well, there is a sense in which that answer is right. There’s a sense in which free immigration, in the same sense as we had it before 1914 is not possible today. Why not?

Because it is one thing to have free immigration to jobs. It is another thing to have free immigration to welfare. And you cannot have both. If you have a welfare state, if you have a state in which every resident is promises a certain minimal level of income, or a minimum level of subsistence, regardless of whether he works or not, produces it or not. Then it really is an impossible thing.

I was perplexed at the time that Friedman’s ideology had to take a backseat to the real world that liberals had taken over!!! That is exactly the case here.

According to Wikipedia here are Ron Paul’s views on Borders and immigration:

Paul considers it a “boondoggle” for the U.S. to spend much money policing other countries’ borders (such as the Iraq–Syria border) while leaving its own borders porous and unpatrolled;[32] he argues the U.S.–Mexico border can be crossed by anyone, including potential terrorists.[52] During the Cold War, he supported Reagan’s Strategic Defense Initiative,[53] intended to replace the “strategic offense” doctrine of mutual assured destruction with strategic defense.

Paul believes illegal aliens take a toll on welfare and Social Security and would end such benefits, concerned that uncontrolled immigration makes the U.S. a magnet for illegal aliens, increases welfare payments, and exacerbates the strain on an already highly unbalanced federal budget.[54]

Paul believes that illegal immigrants should not be given an “unfair advantage” under law.[55] He has advocated for a “coherent immigration policy”, and has spoken strongly against amnesty for illegal aliens because he believes it undermines the rule of law, grants pardons to lawbreakers,[56] and subsidizes more illegal immigration.[57] Paul voted for the Secure Fence Act of 2006, authorizing an additional 700 miles (1100 kilometers) of double-layered fencing between the U.S. and Mexico mainly because he wanted enforcement of the law and opposed amnesty, not because he supported the construction of a border fence.[58]

Paul believes that mandated hospital emergency treatment for illegal aliens should be ceased and that assistance from charities should instead be sought because there should be no federal mandates on providing health care for illegal aliens.[58]

Paul also believes children born in the U.S. to illegal aliens should not be granted automatic birthright citizenship.[59] He has called for a new Constitutional amendment to revise fourteenth amendment principles and “end automatic birthright citizenship”,[60] and believes that welfare issues are directly tied to the illegal immigration problem.[61]

Your Tax Dollars at Work: Subsidizing the Security of Wealthy Allies

It’s Tax Day, and for millions of Americans that means ponying up to the IRS. The federal government does many things these days—most of which would be more efficiently carried out at the local level, or in the private sector. But Uncle Sam also engages in a particular form of charity that many Americans overlook: spending many tens of billions of dollars to defend wealthy, developed nations.

A new Cato infographic puts it all in perspective. It shows how much American taxpayers spend to subsidize the security, and to defend the interests, of other nations that are more than capable of defending themselves.

The average American spends $2,300 on the military, based on the latest data available. That is roughly four and a half times more than what the average person in other NATO countries spends. These countries boast a collective GDP of approximately $19 trillion, 25 percent higher than the U.S. They obviously can afford to spend more. So why don’t they? Because Uncle Sucker picks up nearly the entire tab.

Looked at another way, U.S. alliances constitute a massive wealth transfer from U.S. taxpayers (and their Chinese creditors) to bloated European welfare states and technologically-advanced Asian nations.

Despite the size and wealth of our allies, they are military dwarfs compared to the United States. The particularly galling comparison is the disparity between what the United States spends on the military as a percentage of the federal budget and what other countries spend on their military relative to total government spending.

While the United States spends 20 percent of the budget on the military, Japan spends a paltry 2.3 percent. Our NATO allies? The average is 3.6 percent. Even South Korea’s share of military spending is roughly half of our total, and they have much bigger threats to worry about. By providing for their security, we have encouraged allies to divert resources elsewhere.

The Constitution stipulates that the federal government should provide for the “common defence.” But the document never talks about providing for the defense of other nations. Their citizens are not party to our unique social contract. On this tax day, you might rest assured that wealthy citizens around the world are grateful that you are defending them, but don’t hold your breath waiting for a word of thanks.

It is time to rethink our alliances and the culture of dependency we have created among our allies. They have become wards to Uncle Sam’s dole. Only by ceasing to foot the security bill for them will we create an incentive for them to spend more.

Feds and the States Tag-Teaming on Corporate Welfare

In a recent op-ed for the Indianapolis Star I discussed the symbiotic relationship between federal and state government when it comes to doling out corporate welfare subsidies. The focus was primarily on Indiana, but the issue is a national concern. 

A good example is the $2 billion Shepherd’s Flat wind farm in Oregon that was largely financed with federal and state taxpayer support. Ted Sickinger, a reporter for theOregonian, has done an excellent job of digging into details behind the project (see here thenhere then here) and it appears that Shepherd’s Flat was one big taxpayer handout. In fact, the Obama administration signed off on the federal government’s share of the subsidies even though it knew the project didn’t need any support from taxpayers: 

In 2010, Shepherd’s Flat attracted national notoriety for its subsidies. In a briefing memo for the President leaked to the media, Obama’s top advisors worried that the U.S. Department of Energy’s loan guarantee program was subsidizing projects that didn’t need it. 

Shepherd’s Flat was their case in point. 

Treasury Secretary Larry Summers, energy czar Carol Browner, and Vice President Joe Biden’s chief of staff Ron Klain said Shepherd’s Flat was “double-dipping” on $1.2 billion in federal and state subsidies – 65 percent of its projected cost. The incentives included a $500 million federal grant, $200 million in federal and state tax benefits from accelerated depreciation, $220 million in premium power prices attributed to state renewable energy mandates, and a $1 billion loan guarantee with a value of $300 million to the developers. 

They concluded that Caithness has “little skin in the game” – about 10 percent of the project’s cost – but stood to earn a 30 percent return on its investment. It also speculated that Shepherd’s Flat would likely go ahead without the federal loan guarantee because “the economics are favorable for wind investment given tax credits and state renewable energy standards.” 

Caithness Energy is the wind farm’s owner and operator. General Electric supplied the wind turbines (a $1.4 billion contract with Caithness) and part of the financing – financing backed by the federal loan guarantee. Both companies made sure they had Washington’s attention: 

Nationally, powerful interests were pushing in the same direction. A new president’s desire to build environmental credibility became an economic keystone to restore the collapsed economy. The Obama administration fast tracked loan guarantees to pump stimulus money into job-generating projects. Meanwhile, deep-pocketed companies with powerful lobbying arms were busy greasing the skids. 

The political action committee, employees and affiliates of General Electric – Shepherds Flat’s turbine supplier and an equity investor – gave more than a half million dollars to Obama’s 2008 campaign. The PACs for both GE and Caithness also have sprinkled sprinkled money among Oregon’s congressional delegation during the last five years, including Sens. Ron Wyden and Jeff Merkley, Reps. Earl Blumenauer, Greg Walden and Peter DeFazio. 

According to e-mails released by the House Oversight Committee investigating federal subsidies after the bankruptcy of solar startup Solyndra, the Obama administration pushed hard on incentives for Shepherds Flat. Months before officials at the U.S. Department of Energy approved a loan guarantee for the project, General Electric was being told it was a done deal. 

In April 2010, Kevin Walsh, managing director of GE’s renewables business, emailed the director of the U.S. DOE’s loan program: “We have been advised by the White House and other sources that we are likely to get the “green light” this week to move forward with the Shepherds Flat wind project…Les Gelber (a partner at Caithness Energy) and I will be in DC tomorrow and would like to stop by any time between noon and 2pm to briefly discuss.” 

The deal took more time to fully bake. Four months later, DOE Loan Program Office Credit Advisor Jim McCrea emailed a contractor: “Pressure is on real heavy on SF due to interest from VP.” 

Later that day, McCrea sent staff an all points bulletin to promptly provide answers on Shepherds Flat: “To do otherwise would leave us firmly on the political path and give agencies an opportunity to blame us when they are pressures (sic) to make decisions. As you all know, the pressures to make decisions on this transaction are high so speed is of the essence.” 

But the shenanigans don’t stop at the federal level. 

Even though the wind farm is clearly a single entity, it somehow managed to qualify for three separate $10 million state tax credits after the Oregon Department of Energy (ODOE) agreed with Caithness’s claim that Shepherd’s Flat was three separate entities. According to Sickinger, the ODOE’s decision was bogus: 

Yet limited and often non-responsive information about the review provided to The Oregonian suggests it was neither rigorous nor consistent with state rules governing tax credits. In its review, ODOE ignored clear evidence in its own files and additional records identified by The Oregonian that should have disqualified $20 million of the $30 million in tax credits. It failed to ask for contracts or other documentation to answer fundamental questions that state rules pose about ownership, financing, construction, operation and maintenance.

Instead, ODOE made assumptions, relied again on statements made by developers before the project was built, and reversed its own analysts’ earlier conclusions. Its review apparently tapped only one new source: a report by ODOE’s own staff for an entirely different purpose and largely irrelevant regarding tax credit eligibility. In the end, ODOE failed to apply its rules on separate and distinct facilities to Shepherd’s Flat. 

The result: “free” money for Caithness: 

The company, like many other tax credit recipients, received approval to sell the credit in exchange for cash. The pass-through option will net Caithness $20 million, but leave the state’s general fund out the full $30 million. 

There are more stories like the crony Shepherd’s Flat deal out there waiting to be uncovered. More state and local reporters should follow Sickinger’s example and start digging into these shady government-private collaborations that politicians and the financially-benefitting interests want the public to believe are so critical for “creating jobs.”

Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

In 1980 I read the book FREE TO CHOOSE by Milton Friedman and it really enlightened me a tremendous amount.  I suggest checking out these episodes and transcripts of Milton Friedman’s film series FREE TO CHOOSE: “The Failure of Socialism” and “The Anatomy of a Crisis” and “What is wrong with our schools?”  and “Created Equal”  and  From Cradle to Grave, and – Power of the Market.

In this episode “How to Stay Free” Friedman makes the statement “What we need is widespread public recognition that the central government should be limited to its basic functions: defending the nation against foreign enemies, preserving order at home, and mediating our disputes. We must come to recognize that voluntary cooperation through the market and in other ways is a far better way to solve our problems than turning them over to the government.”

Milton Friedman says this in the following episode:
I believe that there is a strong enough component of freedom in our society that we will be able to preserve it, that we’re going to turn this trend back, that we are going to cut government down to size, we’re going to lay the ground work for a resurgence for a, a flowering, of that diversity which has been the real product of our free society.

Lawrence E. Spivak: Milton, how bad is the state of freedom in this country today?
Friedman: It’s a mixed bag. In some areas we have more freedom than we’ve ever had before. In some other areas our freedom has been drastically reduced. Our freedom to spend our own money as we want has been cut sharply. Our freedom to go into whatever occupation we want has been reduced sharply. Our freedom to have various businesses has been reduced sharply. And these restrictions in our economic freedoms have carried over to restrictions on the freedom with which we speak and we talk, the activities we carry on, our attitudes toward governmental officials and all the rest. In those areas, our freedoms have been very seriously restricted.
Lawrence E. Spivak: What about your yourself? You as an individual and we really have to do with, deal with millions of hundreds, two hundred million, two hundred twenty million individuals. What about you? What freedom do you think you’ve lost?
Friedman: Well, I have been a very fortunate individual. I always have…
Lawrence E. Spivak: That sounds like a cop out.
Friedman: No, it’s not a cop out because I’m going to add to it. I’ve always said about the only people who have effective freedom of speech these days in the United States are tenured professors at private universities who are on the verge of retirement or have retired. And that’s been my situation in these recent years. Consider the freedom of, for example, a professor of medicine at any one of our great institutions. He’s almost certainly having his research financed by the Federal Government. Don’t you suppose he’d think two or three times before he gave a lecture on the evils of socialized medicine? Or consider one of my colleagues at the University who happens to be getting grants of money from the National Science Foundation. Do you think he really feels free to speak out on the issue of whether government ought to be financing such research. Of course, you ought not to have freedom without costs. But the costs ought to be reasonable. They ought not to be disproportionate, there’s no businessmen in this country today who can speak out. Why is it, why is it that the businessmen today are so mealy-mouthed in what they say? There are very few of them who are willing to come out and say openly what they believe. Why?
Lawrence E. Spivak: About what?
Friedman: About anything. Take for example the recent attempts by President Carter to impose voluntary wage and price controls. There’s hardly a businessman in this country who doesn’t think it’s terrible. There are only about two or three businessmen who have had the courage to stand up and say something about that. But again, as I say, go to my academic colleagues. Many of them feel as I do that government is devoting altogether too much money. That there’s been altogether too much subsidization of state universities and colleges all along the line. Yet very few of them are willing to speak out.
Lawrence E. Spivak: What about the generation that doesn’t know what freedom is as you knew it, and therefore, doesn’t mind so much what has happened. Just takes for granted what he’s living under now.
Friedman: I think that’s a very real problem. I think we’re living on our inheritance. We have inherited a philosophy and a set of attitudes and they tend to be eroded. People get accustomed to what they know. There’s an enormous tear in the status quote and most people, most of the time, accept the circumstances that are around them. There’s a natural human drive for freedom which always expresses itself. But, its stronger or weaker and I think a great danger in continuing along the path that we’ve been going on is that we will lose still more of our inheritance, still more of our basic values of our basic beliefs in freedom and that we will have still less protest as more and more freedoms are taken away. The real value of freedom is that it provides diversity and diversity is in turn the real protection of freedom. People who like to live in small cities, can live in small cities. People who like the impersonality of the metropolis can live in a metropolis. We have loyalties to our churches, we have loyalties to our universities, to our schools, to our clubs, to our cities, to our states. It’s this diversity. That fact that there isn’t a monolithic conformity imposed on us, that is, the source of protection for our freedom and also the fruit of freedom. It’s because freedom protects diversity, allows, you will remember the phrase when Mao said he was going to allow a 100 flowers to bloom. But of course he didn’t. As soon as people spoke out and 100 flowers bloomed, he cut them off. But it’s the blooming of many flowers, the fact that you have all of these different expressions of people’s individuality and produces the great achievements of civilization and that provides the great hope a protection of our freedom.
Lawrence E. Spivak: Why are you saying that there are pockets of freedom still existing in the countries?
Friedman: As I said before, the picture’s a mixed bag. In certain respects we have more freedom than we’ve ever had, but in other respects we’ve had very much less freedom. Of course there are great pockets of freedom, this is predominantly still a free country. We must not confuse the trend with the situation. We have been moving away from freedom. Our freedom is in jeopardy but by no means has been completely destroyed. I believe that there is a strong enough component of freedom in our society that we will be able to preserve it, that we’re going to turn this trend back, that we are going to cut government down to size, we’re going to lay the ground work for a resurgence for a, a flowering, of that diversity which has been the real product of our free society.

Dear Mr. President,

I know that you receive 20,000 letters a day and that you actually read 10 of them every day. I really do respect you for trying to get a pulse on what is going on out here.

The federal government debt is growing so much that it is endangering us because if things keep going like they are now we will not have any money left for the national defense because we are so far in debt as a nation. We have been spending so much on our welfare state through food stamps and other programs that I am worrying that many of our citizens are becoming more dependent on government and in many cases they are losing their incentive to work hard because of the welfare trap the government has put in place. Other nations in Europe have gone down this road and we see what mess this has gotten them in. People really are losing their faith in big government and they want more liberty back. It seems to me we have to get back to the founding  principles that made our country great.  We also need to realize that a big government will encourage waste and corruption. The recent scandals in our government have proved my point. In fact, the jokes you made at Ohio State about possibly auditing them are not so funny now that reality shows how the IRS was acting more like a monster out of control. Also raising taxes on the job creators is a very bad idea too. The Laffer Curve clearly demonstrates that when the tax rates are raised many individuals will move their investments to places where they will not get taxed as much.

I have written about 66 heroes of mine in the House of Representatives that voted “no” on your debt ceiling increase request in 2011. I believe we must have representatives that will vote to restore our freedom and that means voting to cut spending and lower taxes like the Patriots of long ago wanted. Today the Tea Party represented my views the most closely.  Lord knows I have written a lot about that in the past. . I have praised over and over and over the 66 House Republicans that voted no on that before. If they did not raise the debt ceiling then we would have a balanced budget instantly.  I agree that the Tea Party has made a difference and I have personally posted 49 posts on my blog on different Tea Party heroes of mine.

I have written and emailed Senator Pryor over, and over again with spending cut suggestions but he has ignored all of these good ideas in favor of keeping the printing presses going as we plunge our future generations further in debt. I am convinced if he does not change his liberal voting record that he will no longer be our senator in 2014.

I have written hundreds of letters and emails to you and I must say that I have been impressed that you have had the White House staff answer so many of my letters. The White House answered concerning Social Security (two times), Green Technologies, welfare, small businesses, Obamacare (twice),  federal overspending, expanding unemployment benefits to 99 weeks,  gun control, national debt, abortion, jumpstarting the economy, and various other  issues.   However, your policies have not changed, and by the way the White House after answering over 50 of my letters before November of 2012 has not answered one since.    You are committed to cutting nothing from the budget that I can tell.

 I have praised over and over and over the 66 House Republicans that voted no on that before. THIS BRINGS ME TO ONE OF MY BIGGEST ECONOMIC HEROES AND IT IS THE LATE MILTON FRIEDMAN. Friedman had such revolutionary policies such as eliminating welfare and instituting the negative income tax and putting in school vouchers.

The problem in Washington is not lack of revenue but our lack of spending restraint. This video below makes that point.

I have written about the tremendous increase in the food stamp program the last 9 years before and that means that both President Obama and Bush were guilty of not trying to slow down it’s growth. Furthermore, Republicans have been some of the biggest supporters of the food stamp program. Milton Friedman had a good solution to help end the welfare state and wish more people would pay attention to it.   Growing government also encourages waste and hurt growth but more importantly it causes people to become dependent on the government as this article and cartoon below show.

My great fear is that the “social capital” of self reliance in America will slowly disappear and that the United States will turn into a European-style welfare state.

That’s the message in the famous “riding in the wagon” cartoons that went viral and became the most-viewed post on this blog.

Well, this Glenn McCoy cartoon has a similar theme.

The only thing I would change is that the rat would become a “pro-government voter” or “left-wing voter” instead of an “Obama voter.” Just like I wasn’t satisfied with an otherwise very good Chuck Asay cartoon showing the struggle between producers and moochers.

That’s for two reasons. First, I’m not partisan. My goal is to spread a message of liberty, not encourage people to vote for or against any candidate.

Second, I’ve been very critical of Obama, but I was also very critical of Bush. Indeed, Bush was a bigger spender than Obama! And Clinton was quite good, so party labels often don’t matter.

But I’m getting wonky. Enjoy the cartoon and feel free to share it widely.

Why is President Obama reluctant to talk about terrorism?

Yesterday’s appalling attack on a London street in the middle of the day, which left a British solider dead, was a barbaric act of terrorism perpetrated by Islamist fundamentalists. British Prime Minister David Cameron acknowledged the motivations behind yesterday’s cowardly act by saying:

This country will be absolutely resolute in its stand against violent extremism and terror. We will never give in to terror—or terrorism—in any of its forms. Second, this view is shared by every community in our country. This was not just an attack on Britain—and on our British way of life. It was also a betrayal of Islam—and of the Muslim communities who give so much to our country. There is nothing in Islam that justifies this truly dreadful act. We will defeat violent extremism by standing together.

In stark contrast, the Obama Administration’s response has been to avoid calling the attack terrorism, let alone terrorism motivated by a radical Islamic ideology. Instead the Administration, via the State Department, said it stood with the U.K. in the face of “such senseless violence.”

Senseless violence? One can hardly term a targeted attack on a U.K. soldier in broad daylight — where the assailants gleefully admit the radical motivation behind their attack — “senseless violence.”

Yet, use of this terminology is nothing new for the Obama Administration. “Senseless violence” is the Administration’s catch-all phrase loyally called upon whenever motivations for a despicable act should not be ascribed, lest someone take offense.

Particularly troubling is that “senseless violence” is the same terminology the Administration used when describing the terrorist attack in Benghazi that killed the American Ambassador and three other U.S. citizens.

The terrorist attack in London was indeed a senseless act of violence; however, in refusing to admit the nature and motivations behind the attack, the Obama Administration does disservice to the men and women killed in terrorist attacks. As Heritage’s Nile Gardiner advises in The Telegraph:

It’s time for President Obama to acknowledge reality. This is a global war between the free world and the forces of Islamist terror. These are not acts of “senseless violence.” They are acts of brutal terrorism aimed against Great Britain, the United States and all who defend the principles of liberty, freedom and Western-style democracy. It is important that political leaders on both sides of the Atlantic identify exactly who the enemy is, what their aims are, and why they must be emphatically defeated.

For the Administration to do otherwise would be, well, senseless.

Defunding COPS: Eliminating a Wasteful and Ineffective Grant Program

The House of Representatives Appropriations Committee marked up the Commerce, Justice, Science, and Related Agencies Appropriations Bill for fiscal year 2014 last week. While the bill still allocates too much funding for activities that are duplicative or inappropriate for the federal government to undertake, the committee did get something right: It eliminated funding for the failed Office of Community Oriented Policing Services (COPS).

Created in the middle of President Bill Clinton’s first term, COPS promised to add 100,000 new state and local law enforcement officers on the streets by 2000. Research by The Heritage Foundation has demonstrated that COPS not only failed to add 100,000 additional officers to America’s streets but was ineffective at reducing crime.

State and local officials, not the federal government, are responsible for funding the staffing levels of police departments. By paying for the salaries of police officers, COPS funds the routine, day-to-day functions of police and fire departments. In Federalist No. 45, James Madison wrote:

The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State.

When Congress subsidizes local police departments in this manner, it effectively reassigns to the federal government the powers and responsibilities that fall squarely within the expertise, historical control, and constitutional authority of state and local governments. The responsibility to combat ordinary crime at the local level belongs wholly and exclusively to state and local governments.

The COPS program has an extensive track record of poor performance and should be eliminated. These grants also unnecessarily perform functions that are the responsibility of state and local governments. For this particular program, the House Appropriations Committee made a fiscally wise decision that follows the wisdom of our founders and core principles of our government. When the bill is considered by the entire House, hopefully the majority of Representatives will exercise the same fiscal discipline.

Targeting the Constitution

It is now well known that the IRS targeted tea party organizations. What is less well known, but perhaps even more scandalous, is that the IRS also targeted those who would educate their fellow citizens about the United States Constitution.

According to the inspector general’s report (pp. 30 & 38), this particular IRS targeting commenced on Jan. 25, 2012 — the beginning of the election year for President Obama’s second campaign. On that date: “the BOLO [‘be on the lookout’] criteria were again updated.” The revised criteria included “political action type organizations involved in … educating on the Constitution and Bill of Rights.”

Grass-roots organizations around the country, such as the Linchpins of Liberty (Tennessee), the Spirit of Freedom Institute (Wyoming), and the Constitutional Organization of Liberty (Pennsylvania), allege that they were singled out for special scrutiny at least in part for their work in constitutional education. There may have been many more.

The tea party is viewed with general suspicion in some quarters, and it is not difficult, alas, to imagine the mindset of the officials who decided to target tea party organizations for special scrutiny. But federal officers swear an oath to “support and defend the Constitution of the United States against all enemies, foreign and domestic.” It is chilling to think that these same officials who are suspicious of the tea party are equally suspicious of the Constitution itself.

What is most corrosive about this IRS tripwire is that it is triggered by a particular point of view; it is not, as First Amendment scholars say, viewpoint-neutral. It does not includeobfuscating or denigrating the Constitution; only those “involved in … educating on the Constitution” are captured by this criterion. This viewpoint targeting potentially skews every national debate about politics or government. And the skew in not strictly liberal; indeed, it should trouble liberals as much as conservatives. The ultimate checks on executive power are to be found in the United States Constitution. Insidiously, then, suppressing those “involved in … educating on the Constitution” actually skews national debate in favor of unchecked executive power.

For example, this IRS tripwire would not be triggered by arguing that the NSA should collect the phone records of every American citizen. But it would be triggered by teaching that the Fourth Amendment forbids “unreasonable searches and seizures.” This tripwire would not be triggered by arguing that the president should unilaterally suspend politically inconvenient provisions of federal law, like ObamaCare. But it would be triggered by teaching that, under Article II, section 3, the president “shall take care that the laws be faithfully executed.” This tripwire would not be triggered by arguing that the president should appoint NLRB members unilaterally. But it would be triggered by teaching that, under Article II, section 2, such appointments require “the Advice and Consent of the Senate.” This tripwire would not be triggered by arguing that the president should target and kill U.S. citizens abroad. But it would be triggered by teaching that, per the Fifth Amendment, no person shall “be deprived of life … without due process of law.” This tripwire would not be triggered by arguing that the president should declare war unilaterally. But it would be triggered by teaching that, under Article I, section 8, “Congress shall have Power … To declare War.” In short, the IRS was “on the lookout,” not for those who preach unlimited executive power, but for those who would teach about constitutional constraints.

Even more to the point, perhaps, this IRS tripwire would not be triggered by arguing that the IRS should discriminate against the tea party. But it would be triggered by teaching that such discrimination constitutes unfaithful execution of the tax laws. And thus, alas, there is a perverse logic to targeting constitutional educators alongside tea party organizations. Political discrimination in the administration of the tax laws is not merely “outrageous,” as President Obama has said; it is an assault on our constitutional structure itself. For an official who has chosen to go down this road and target the tea party, there is an Orwellian logic to targeting constitutional educators as well. After all, they are the ones who might shed light on this very point.

This is a new low for American government — targeting those who would teach others about its founding document. Forty years ago, President Richard Nixon went to great lengths to try to conceal the facts of his constitutional violations, but it never occurred to him to conceal the meaning of the Constitution itself, by targeting its teachers. Politicians have always been tempted to try to censor their political adversaries; but none has been so bold as to try to suppress constitutional education directly. Presidents have always sought to push against the constitutional limits of their power; but never have they targeted those who merely teach about such limits. In short, never before has the federal government singled out for special scrutiny those who would teach their fellow citizens about our magnificent Constitution. This is the new innovation of Obama’s IRS.

“We the People” do not yet know who first decided to target “political action type organizations involved in … educating on the Constitution and Bill of Rights.” But there is at least one person who does know. Ironically, though, Lois Lerner, former director of the Exempt Organizations Division of the IRS, is making full use of her own constitutional education: “I have been advised by my counsel to assert my constitutional right not to testify …. One of the basic functions of the Fifth Amendment is to protect innocent individuals, and that is the protection I’m invoking today.”

Five years ago, President Obama, our constitutional law professor-in-chief, presented his first, ringing Constitution Day proclamation: “To succeed, the democracy established in our Constitution requires the active participation of its citizenry. Each of us has a responsibility to learn about our Constitution and teach younger generations about its contents and history.” Quite so. Perhaps this year, Obama could explain why his IRS would target those who answered this call.
